S 7 3 RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO PAY TO CLARIBEL MATTEO, WITH- OUT THE ADMISSION DOLLARSLIABILITY, 000T00)SUM IN OF FIVE THOUSAND FULL AND COMPLETE SETTLEMENT OF ALL BODILY INJURY PERSONAL INJURY PROTECTION LIENS, AND WORKMEN'S COMPENSATION LIENS, ALL F CLAIMS AND DEMANDS AGAINST THE CITY OF MIAMI, AND UPON EXECUTION OF A RELEASE, RELEASING THE CITY OF MIAMI FROM ALL CLAIMS AND DEMANDS. WHEREAS, Claribel Matteo, through her attorney, Gary'B. Sack, filed a claim against the City of Miami and alleged bodily injury, personal injury protection liens and work- men's compensation liens, resulting from an accident that occurred on August 14, 1976, at or near South Dixie Highway and Southwest 19th Avenue, in the City of Miami, Florida; and WHEREAS, the above claim has been investigated by the Torts Division of the City Attorney's Office in accordance t with Ordinance No. 8417, which created the City of Miami Self -Insurance Program, and said Office recommends that this f claim be settled for the sum of Five Thousand Dollars i ($5,000.00) ; i I� NOW, THEREFORE, BE IT RESOLVED. BY THE COMMISSION OF THE 1 CITY OF MIAMI, FLORIDA: Section 1. Knox, Jr. R@ERENCES Circuit Court Case #76-27933 City Attorney (40) - D/A: 8/14/76 f NCLOSURES: P/A: S. Dixie Highway & S.W. 19th Avenue This claim arose from an automobile accident wherein Claribel Matteo was a passenger in a motor vehicle which was driven northbound on South Dixie Highway which struck a large puddle, lost control and ran into a concrete wall. Shortly before this accident occurred a similar accident was investigated by the Miami Police Department. Unfortunately, no warning devices were left at the scene after the first accident. As a result of the accident, Claribel Matteo, broke several ribs, fractured her jaw, broke a tooth and fractured her pelvis. She incurred $11,818.60 in medical expenses. She will incur approximately $2,500.00 for future cosmetic sur- gery. Medical expenses and other items of damage have been verified. After extensive settlement discussions and nego- tiations, it has been determined that this matter can be settled for $5,000.00. The State of Florida is contri- buting an additional $25,000.00 to settle this claim. The above claim has been investigated by the City Attorney's Office and in accordance with Ordinance No. 8417, which created the City of Miami Self -Insurance Program, we re- commend that the attached Resolution be adopted authorizing payment in the amount of $5,000.00.
