' 81-925 A RESOLUTION CERTIFYING AND DECLARING — -i THE RESULTS OF THE REGULAR ELECTION HELD NOVEMBER 10, 1981 FOR THE ELECTION OF CANDIDATES FOR THE OFFICE OF MAYOR AND TWO COMMISSIONERS OF THE CITY OF MIAMI, FLORIDA. WHEREAS, a Regular Election was duly held on Novem- ber 10, 1981 for election of candidates for the offices of Mayor and two Commissioners of the City of Miami, Florida; and WHEREAS, said election was duly conducted in accordance with law including the provisions of the "Electronic Voting Systems Act" (§101.5601 through §101.5615, F.S.); and WHEREAS, the official returns of each of 87 election precincts in the herein election of November 10, 1981 have been duly certified by RALPH G. ONGIE, City Clerk, Super- visor of Elections for the City of Miami, Florida, upon due certification by the Supervisor of Elections for Metropolitan Dade County, Florida, and those official returns have been delivered to and duly canvassed by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Commission finds and hereby declares and certifies that the following candidates in their respec- tive groups received the number of votes set opposite their respective names in the Regular Election held in the City of Miami, Florida, on November 10, 1981: GROUP I For Mayor Maurice A. The total number of ballots cast, includ- ing absentee ballots, at said Regular Election in the 87 voting precincts was 57,950. Section 3. It is hereby certified and declared that in GROUP I (For Mayor) Maurice A. Ferre received the greatest number of votes cast in GROUP I, and shall be con- sidered elected and hold said office for a term of two (2) years from Noon on November 12, 1981. Section 4. It is hereby certified and declared that in GROUP IV (For Commissioner) Demetrio Perez, Jr. received the greatest number of votes cast in GROUP IV and shall be considered elected and shall hold said office for a term of four. (4) years from Noon on November 12, 1981. Section 5. It is hereby certified and declared that in GROUP V (For Commissioner) Miller J. Dawkins received the greatest number of votes cast in GROUP V and shall be considered elected and shall hold said office for a term of four (4) years from Noon on November 12, 1981. -2- 81 - 925 _ f 1 = f i Section 6. The City Commission also hereby finds, declares and certifies: (a) said Regular Election was duly —i and properly held and notice thereof was duly given in accord- ance with law; (b) all steps in connection with and leading up to said Regular Election were duly, regularly and lawfully taken and had; and (c) all applicable provisions of the Con- stitution and statutes of the State of Florida, the Dade County Election Code and the City Code have been duly com- plied with. I further certify that all documents concerning these Logic & Accuracy and Tabulation tests showed the computer to be functioning correctly and that such documents are in the possession of the Supervisor of Elections of Metropolitan Dade County, under sealed vault. Steps have been taken to insure the security of said materials prior to, during and subsequent to the election, except when said materials were properly in the possession of the Elections Department staff appointed to conduct the election. 4. Except as otherwise specifically set forth and declared in this certification, in my presence and sight, no ballot card was removed from or added to any ballot card container, ballot card tray or other segregation of ballots, and no ballot card was in any manner altered or tampered with by any person, and no person touched any ballot card container, ballot card tray or ballot card, except a person authorized to do so pursuant to Section 101.5612, Florida Statutes. 5. At the completion of the ballot count, the automatic tabulating equipment was again tested to ascertain that the equipment correctly counted the votes cast for the candidates. 6.
