RESOLUTION ALLOCATING FUNDS TO THE
OVERTOWN DEMONSTRATION PROJECT --
REHABILITATION OF MULTI -FAMILY
BUILDING LOCATED AT 240 N.W. 11TH
STREET IN THE AMOUNT OF $40,000.00
AND AUTHORIZING THE CITY MANAGER TO
EXECUTECONTRACTS IN ORDER TO COM-
PLETE SUBJECT PROJECT AND WAIVE BID-
DING REQUIREMENTS. —
WHEREAS, the City of Miami by Resolution No. 80-763 has
entered into contract with M. Carter Building Contractor,
Inc. for work related to the rehabilitation of a City -owned
residential building located at 240 N.W. llth Street; and
WHEREAS, it has been determined that said contractor is
unable to prosecute the specified work to timely completion and
the value of that work which has been completed is in immediate
jeopardy of being vandalized; and
WHEREAS, the contractor's services have been terminated
by notice dated October 20, 1981; and
WHEREAS, a performance bond was not required due to the
City's desire to attract participation of minority contractors
and the understanding that the nature of the work would make
procurement of such bonds prohibitive; and
WHEREAS, the building's tenants continue to be temporarily
relocated at City expense pending completion of work and re -
occupancy; and
WHEREAS, additonal funds are needed to cover the cost of
certain work completed to date by project sub -contractors
and suppliers and to purchase and have installed those items
required to satisfactorily complete subject project; and
WHEREAS, it is essential to the health, safety, and welfare
of the community that immediate action be taken to complete the
work on sabjec:t building;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. An amount of $40,000.00 is allocated

from Community Development Block Grant funds to be used to

Section 2. The City Manager is authorized to execute
any and all contracts in order to expedite completion of sub-
ject project and to waive bidding requirements.

It is recommended that the City Commission
allocate $40,000 of Community Development
Block Grant funds to complete the rehabilitation
of a city -owned multi -family building located
at 240 N.W. llth Street and authorize the City
Manager to execute contracts related thereto.
In October, 1980, the City Commission authorized execution of a contract
with M. Carter Building Contractor, Inc. to undertake the rehabilitation
of a city -owned multi -family building located in the Overtown neighbor-
hood. The project is intended to demonstrate the feasibility of subs-
tantial rehabilitation and will be used as a housing relocation resource.
The project has progressed to the extent that approximately 80% of the
required work items have been completed. however, it has been determined
that the contractor has defaulted on his contract and is unable to com-
plete subject project. Further, it has been brought to staff's attention
that in certain cases, the contractor has failed to pay subcontractors
and/or suppliers for work performed and for which the contractor has been
paid. Substantially little progress has occurred to the building over
the past several months despite staff's concerted efforts to assist the
contractor in fulfilling his contractual obligations. The normal bonding
requirements were waived due to the desire to utilize minority contractors
and the understanding that the nature of the work to be undertaken and
the location of the building made procurement of such bonds prohibitive
to obtain.
The Contractor's right to proceed was officially terminated by notice
dated October 20, 1981. In order to complete the project it will be
necessary for the City staff to coordinate the remaining work among the
various subcontractors.
The additional cost is estimated at $40,000. This amount will be added
to monies held back from the contractor and will be sufficient to cover
unpaid work previously completed and to purchase and install those items
needed to complete the building's renovation.
It was required that the building's tenants be relocated at the time
rehabilitation work began. The City continues to subsidize their
monthly rent.

In accordance with the City Attorney's opinion dated October 27,
1981,it will be necessary to have City Manager execute contracts
with the subcontractors to cover the remaining work.
In order to protect the building from potential acts of vandalism
and to protect the healthy, safety and welfare of the community it
is essential that the project be completed as soon as possible.
City Commission approval of this item is recommended.
