W. 19TH ROAD, AS PER E PLANS ON FILE, WITH AN AVERAGE LOT,t4IDTH OF 54' REQUIRED), A LOT AREA OF 3.942 SO, FT. (6,000 SQ. FT. REQUIRED), AND A REAR YARD OF 3' (20' RE- QUIR ); Z014ED R-C (RESIDENTIAL OFFICt). WHEREAS, tNe Miami Zoning Board at its meeting of October 5, 1981, Item No. 9, following an advertised hearing, adopted Resolution No. ZB 191-81 , which faile&to pass by a 2-4 vote constituting a denial of variance, as hereinafter set forth; and WHEREAS, the applicant has taken an appeal from the denial of the variance to the City Commission; and WHEREAS, the City Commission notwithstanding the denial of the Zoning Board, and after careful consideration of this matter finds that due to peculiar circumstances affecting this parcel of land, practical difficulties and unnecessary`,hardships would impair the owner's right to the reasonable use of the,property without the variance granted as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE CbMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Two proponents present at the meeting. A RESOLUTION to provide for this Variance has been prepared by the City Attorne office and submitted for consideration by the City Commission. Box 330708 Miami, Florida 33133 TELEPHONE (305) 358-0060 Re: Appeal of Decision Denying Application for Variance for Property located at 264-66 S.W. 19th Road, Miami, Florida Dear Mr. Gary: This letter shall serve as our request on behalf of the owner of the above -referenced property that the split decision of the Zoning Board, which resulted in the denial of our application for a variance, be heard on appeal before the City of Miami Board of City Commissioners. The legal description of the property for your reference is: NW'ly 73' of Lot 1; Block 19; Holleman Park, according to the Plat thereof as recorded in Plat Book 8, Page 23, of the Public Records of Dade County, Florida The purpose of the variance is to permit conversion of a two-family dwelling structure to office use with an average lot width of 54' (60'required); a lot area of 3,942 square feet (6,000 square feet required); and a rear yard of 3 feet (20 feet required). The property is presently zoned R-C. Accompanying this request that the decision be heard on appeal before the City of Miami Board of City Commissioners is a petition containing the names of in excess of 10% of the lot owners within Howard V. Gary October 27, 1981 Page 2 375 feet of the property for which the variance is sought supporting our request for an appeal. It is of great importance that this appeal be heard as early as possible, preferably on the November 19, 1981 agenda, if at all possible.
