W. 36TH COURT, AS PER PLANS ON FILE, PROVIDING THE FOLLOWING: 1) 7 COMPACT SPACES (7 REGULAR SPACES REQUIRED) 2) A 19' ACCESS AISLE FOR 900 ANGLE PARKING (23' REQUIRED) 3) NO LANDSCAPED SEPARATION BETWEEN DRIVEWAY AND THE SOUTH PROPERTY LINE (2' REQUIRED) 4) NO SEPARATION BETWEEN THE DRIVEWAY AND THE SOUTH PROPERTY LINE AT THE POINT WHERE THE DRIVEWAY CROSSES THE BASE BUILDING LINE (5' REQUIRED) THIS PROPERTY IS ZONED C-4 (GENERAL COMMERCIAL). WHEREAS, the Miami Zoning Board at its meeting of September 14, 1981, Item #4, following an advertised hearing, adopted Resolution No. ZB 155-81 by a tie vote 3 to 3 DENYING variance as hereinafter set forth; and WHEREAS, the applicant has taken an appeal from the denial of the variance to the City Commission and WHEREAS, the City Commission notwithstanding the denial of the Zoning Board, and after careful consideration of this matter finds that due to peculiar circumstances affecting this parcel of land, practical difficulties and unnecessary hardships would impair the owner's right to the reasonable use of the property without the variance granted as hereinafter set forth; NOW, THEREFORE., BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a variance as per Ordinance No. 6871, Article XXIII, Section 2(2), to permit an addition connecting the existing buildings on N49' of Lot 5, Block 6; KIRKLAND HEIGHTS AMD (3-214), being 115 S. W. 36th Court, as per plans on file, providing the following: 1) 7 compact spaces (7 regular spaces required) 2) A 19' access aisle for 90' angle parking (23' required) CITY COMMISSION MEETING OF NOV 19 198t =LUitON N„ 8 1, 1 O 03 I 3) No landscaped separation between driveway and the south property line at the point where the driveway crosses the base building line W required) 4) No separation between the driveway and the south property line at the point where the driveway crosses the base building line (5' required).
