THE COMPREHENSIVE ZONING ORDINANCE FOR THE
CITY OF MIAMI, BY CHANGIIG THE ZONING
CLASSIFICATION OF THE E 1/2 OF TRACT "B"
TENTATIVE PLAT NO. 1051-A - "LITTLE HAVANA
FIRST ADDITION", BEIr1G APPROXIMATELY
154-200 SOUTHWEST 17TH AVENUE FROM C-4
(GENERAL COMMERCIAL) TO R-4 (MEDIUM DENSITY
MULTIPLE, AND BY MAKING THE NECESSARY
CHANGES IN THE ZONING DISTRICT MAP MADE
A PART OF SAID ORDINANCE NO. 6871 BY
REFERENCE AND DESCRIPTION IN ARTICLE III,
SECTION 2, THEREOF, BY REPEALING ALL
ORDINANCES, CODE SECTIONS OR PARTS THEREOF
IN CONFLICT; AND C014TAINING A SEVERABILITY
CLAUSE.
IRF.REAS, the Miami Zoning Board at its meeting of
July 20, 1981, Item No. 9, following an advertised hearing,
adopted Resolution No. ZB 146-81 by a 6 to 0 vote PECOMMENDING
APPROVAL of a change of zoning classification as hereinafter
set forth; and
WHEREAS, the City Commission after careful consi-
deration of this matter, deems it advisable and in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant this change of zoning classification as
hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI , FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive
Zoning Ordinance for the City of Miami, be and the same is
hereby amended by changing the zoning classification of the E 1/2
of Tract "B", Tentative Plat No. 1051 - A - "LITTLE HAVANA
FIRST ADDITION", being approximately 154-200 S. W. 17th Avenue,
from C-4 (General Commercial) to R-4 (Medium Density Multiple),
and by making the necessary changes in the zoning district map made
a part of said Ordinance No. 6871, by reference and description
in Article III, Section 2, thereof.
Section 2. That all Ordinances, Code Sections or
parts thereof in conflict herewith be and the same are hereby
repealed insofar as they are in conflict.
Section 3. Should any part or provision of this
Ordinance be declared by a court of competent'jurisdiction to
be invalid, the same shall not affect the validity of the
Ordinance as a whole.

C O V E N A N T
This COVENANT is dated this day of
1.98 for the benefit of the City of Miami, Florida ("CITY") by
Dade County, Florida Department of Housing and Urban Development
("County"),
The COUNTY owns a property specifically described -
("PROPERTY") as:
Lots 2 and 3, Blk. 24; Lots 1, 2; and 3
Blk. 25 and the 10' alley lying between
Blks. 24 and 25, "Idlewild Park"),
P.B. 2, Page 87, Dade County, Florida,
Less any portions thereof previously
conveyed for public purposes.
The COUNTY is developing the aforementioned PROPERTY for
a Housing Project for the Elderly, known as Project Fla 5-90;
The COUNTY desires to give the CITY assurances that it
will comply with the request of the CITY Commission to restrict
vehicular access to the PROPERTY.
Therefore, the COUNTY agrees to restrict the vehicular
access to the PROPERTY so that accessibility at the PROPERTY
from S.W. 17th Avenue shall not be permitted, thereby assuring
that vehicular traffic shall ingress and egress on S.W. 17th
Court only.
`This agreement shall be a Covenant Running with the Land
and shall be binding upon the parties successors and assigns.
in the event the CITY may be required to take legal action
to enforce the terms of this Agreement, the party against whom
such enforcement is sought shall pay to the CITY the cost of
such action, including reasonable attorney fees should the CITY
;prevail.
