E cut rta y Civil Service Board Appointment of Public Members to the Civil Service Board :NCLOSUN!'S (2) Attached is a draft resolution providing for the appointment of three (3) public members to the Civil Service Board pursu- ant to Sec.60 of the City Charter. City Commission action is needed on the appointment of three (3) public members to the Civil Service Board. The last appointments were made in January 24, 1980 for a term of two (2) years ending January 31, 1982, as per Resolution No.80-68. During the month of January, one regular meeting of the City Commission is scheduled for January 14, 1982. After January 14, the City Commission will not meet again until February 11. The regular meetings of the Civil Service Board for the month of January are scheduled for January 5, and January 19. The next Civil Service Board meeting will not be held again until February 2. Unless there are other Commission meetings scheduled in January that have not been determined, it would be helpful if appointments could be made at the Commission meeting of January 14. Albeit the meeting of January 14 is before the expiration date of the two-year term, a question may be raised as to whether the Board would be legally constituted on February 2, unless appointments are made prior to that date. If the Commission does not make appointments before the Civil Service Board meeting of February 2, we may find it necessary to seek legal guidance from the City Attorney. We hope that this may be dealt with on January 14 or before the Civil Service Board meeting of February 2. I am sending a copy of this memorandum to the Mayor and the City Attorney for their information. /jb cc: Mayor Maurice A. Ferre George F. Knox, Jr. City Attorney, Law Department J.Q33.
