CONDITIONS ARE AS FOLIcm: 1. THAT THE NEW STADIUM BE CONS"TRIJCTED WITHIN THE CITY OF MIAMI LIMITS. 2. THAT THE NAME "MIAMI" BE INCLUDED IN THE NAME OF THE NEW STADIUM. 3. THAT THE CITY OF MIAMI HAVE EQUAL REPRESENTATION IN THE SPORTS AUTHORITY BOARD. 4. THAT THE CITY OF MUM HAVE COMPLETE CONTROL OVER ITS APPOnMENTS AND/OR REPLACEMENTS TO THE SPORTS AUTHORITY BOARD. 5. THAT WHATEVER ADDITIONAL COMMERCIAL ACTIVITIES TO BE C010UCTED THERE- IN IN CCM=ICN WITH THE NEW STADIUM REIMBURSE THE CITY OF MUM IN TIE FORM OF TAXFS: AND 6. 271AT I%' AD VAL0101 TAX bMT Y I M EVER RZQUIRED TO IMP FnM CE THE FACILITY, THAT THE CITY WOULD RESERVE THE RIGHT TO RECONSIDER THIS DECISION; FURTHER STIPULATING THAT A REPLY TO THE AFORESAID CONDITIONS MUST BE RECEIVED BY THE CITY COMMISSION NO LATER THAN MARCH 11, 1982; FZJ MM STIPULATING THAT IF NO REPLY IS RECEIVED FROM MMWPOLITAN DADE COUNTY, THAT THE CITY OF MIAMI WILL WITHDRAW FROM THE EXISTING SPORTS AUTHORITY BOARD; AND, FINALLY, STIPU- LATING THAT, IN THE EVENT AQU220ENT IS REAC M AND THE ORANGE BOWL AND THE MIAMI BASEBALL STADIUM PROPERTIES ARE INDEED TRANSFERRED TO THE SPORTS AUTHOR] TY, AND, IF CONSTRUCTION OF SUCH PROTECT HAS NOT BEGUN WITHIN ONE YEAR FROM THE DATE OF THE TRANSFER, THE AFORESAID PROPERTIES SHALL REVERT BACK TO THE CITY OF MIAMI. A RESOLUTION AUTHORIZING THE PAYMENT OF $200,000 TO THE LAW FIRM OF FLOYD, PEARSON, Ste, RICf*M, GREER AND WEIL, P.A., AND $50,000 TO WILLIAM S. FRATES, ESQ. , FOR IBGAL SERVICES IN CmIDLTION WITH THE ACQUISITION OF THE FLORIDA, EAST COAST RAINY CO. PROPERTY AND AUTHORIZING A TOTAL ALLOCATION OF $250 r 000 FOR THIS PURPOSE FROM THE CAPITAL IMPROVEMENT FUND. A MOTION DIRECTING THE CITY MANAGER TO TAKE IM MIATELY STEPS TO TAKE POS- SESSION OF THE F.E.C. TRACT LOCATED ON BISCAYNE BOULEVARD WHICH HAS BEEN THE SUBJECT OF RECENT LITIGATION BY REMOVING EXISTING FENCES, BULDOZING THE IIaTIRE TRACT TO A TEIIRLED CONDITION, INSTALLING TOP SOIL AND GRASS SEED; FURTHER DIFE TING THE CITY MANAGER TO ESTIMATE A PROPER CHARGE TO THE FLORIDA FAST COAST RAILM CO. FOR THE USE OF EXISTING TRACKS LOCATED ON THIS PRO- PERTY AND TO SEND A BILL TO THE RAILROAD COMPANY FOR THE PROPER AMOUNT. A MOTION INSTRU(`TING THE CITY ATTORNEY TO IMMEDIATELY INSTITUTE LEGAL ACTION AGAINST ALL APPRAISERS WHO WERE I NVMVED IN CORE TION WITH THE CITY' S TAKING OF THE F.E.C. BAYFRCNT PROPERTY BASED UPCInN THEIR REFUSAL TO APPEAR IN COURT TO DEFEND ND THEIR POSITION IN CONNDGTION WITH APPRAISALS MADE BY THEM AFTER HAVING BEEN PAID FEES BY THE CITY OF MIAMI TO RIMER, SUCH APPRAISALS.
