HomeMy WebLinkAboutO-09366/dm Amendment No, 3 to Ordinance No. 9321 ORDINANCE NO.0 6 6 �A AN EMERGENCY ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO. 9321 ADOPTED SEPTEMBER 24, 1981, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1982, AS AMENDED, BY INCREASING THE APPROPRIATION FOR THE ENTERPRISE FUND, IN THE AMOUNT OF $122,200 FOR MARINE STADIUM, AND BY INCREASING ENTER- PRISE FUND REVENUE IN THE SAME AMOUNT FROM FACILITY RENTALS ($62,500),CONCrSSrow REVENUE ($42,000) AND REIMBURSEMENT REVENUE ($17,000) AT MARINE STADIUM FOR THE PURPOSE OF OPERATING SAME FOR THE REMAI14DER OF FY '82; CONTAINING A REPEALER PROVISION; AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9321 on September 24, 1981, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1982; and WHEREAS, the City had every intention to lease the Marine Stadium for fiscal year 1982, but negotiations to finalize a contract with the principal have been terminated; and WHEREAS, funds are needed by the City to operate the Marine Stadium for the remainder of fiscal year 1982 in the amount of $122,200; and WHEREAS, funds in the amount of $122,200 are available from additional revenue generated by the Marine Stadium during fiscal year 1982 and can be allocated for the aforementioned purpose; NOW, THEREFORE, BE IT ORDAINED 8Y THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 1 and 5 of Ordinance No. 9321, adopted September 24, 1981, the annual appropriations ordinance for the fiscal year ending September 30, 1982, as amended, is hereby further amended in the following particulars: 1/ 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures constitute the amendment proposed. The remaining provisions are now in effect and remain unchanged, Asterisks indicate omitted and unchanged material. All figures are rounded to the next dollar. "Section 1, The following appropriations are made for the municipal operations of the City of Miami, Florida, for the fiscal year 1981-82, including the payment of principal and interest on all General Obligation Bonds: Departments, Boards and Offices Appropriation ENTERPRISE FUND Marine Stadium $ -A- 122,200 TOTAL ENTERPRISE FUND $ s,-867;167 $ 5,989,367 TOTAL GENERAL OPERATING APPROPRIATIONS $1605-7065-1:28 $160,827,328 Section 5. The above appropriations are based on the sources of revenues for the 1981-82 fiscal year: ENTERPRISE FUND Revenue Marine Stadium $ -8- $ 122,200 TOTAL ENTERPRISE FUND $ S 867FI67 $ 5,989,367 TOTAL OPERATING APPROPRIATIONS $16gj 705,-128 $160,827,328 Section 2. The herein appropriation of $122,200 for Marine Stadium is for the purpose of operating same for the remainder of fiscal year 1982. The revenue needed to accomplish the aforementioned is derived from facility rentals, concession revenue and reimbursement revenue at Marine Stadium. — Section 3. All ordinances or parts of ordinances insofar as they = are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. -2- 6 Section 4. If any section, part of sections paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section b. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four - fifths of the members of the Commission. Gary City Manager Manohar S, Cana, Director Department ,Management and Budget December 15, 1981 Marine Stadium FY 182 Appropriation It is recommended that the City Commission approve the appropriation of $122,200 to fund the operating costs of Marine Stadium for the remainder of fiscal year 1982. Revenues in like amount are to be provided from increased facility rentals, concession revenues and reimbursement revenue at the stadium. As you are aware, it was the City's intention to lease Marine Stadium to outside interests for fiscal year 1982. However, after many months of negotiations, the City and the principal bidder were not able to finalize a contract that would be acceptable to both parties, resulting in the termination of the process. Due to this development, it is requested that $122,200 be appropriated to Marine Stadium for the operation of said facility for the remainder of fiscal year 1982. The attached proposed ordinance appropriates $122,200 into the Enterprise Fund (Marine Stadium) for fiscal year 1982, This appropriation is funded from additional revenues at Marine Stadium. y MSS`Rm Attachment y !
