RESOLUTIONT NO. 8 2 7 3 A RESOLUTION GRANTING A ONE-YEAR EXTENSION OF A COND. USE GRANTED FROM ORDINANCE 140. 6871, ARTICLE XV, SECTION 2(8)(d), TO PERMIT CON- STRUCTION OF A 154-UNIT APARTMENT BUILDING ON LOTS1, 2, 3, AND N40' OF LOTS 18, 19 & 20, BLOCK 79N; MIAMI (B-41), BEING APPRO- XIMATELY 190 N.E. 5TH STREET, AS PER PLANS ON FILE; SUBJECT TO THE VOLUNTARY DEDICATION OF THE EAST 10' OF LOT 1 AND THE EAST 10' OF THE N40' OF LOT 20; ZONED C-3 (CENTRAL COMMERCIAL) . WHEREAS, Article XXXII of Ordinance 6871, the Comprehensive Zoning Ordinance for the City of Miami, permits an extension of a Cond. Use by the City Manager, with approval of the City Commission for a one year period; and WHEREAS, the City Manager recommends the extension of the Cond. Use granted by Zoning Board Resolution No. ZB130-81; NOW, TFEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one-year extension of the Cond. Use granted from Ordinance No. 6871, Article XV, Section 2(8)(d), to Permit construction of a 154-Unit apartment building on Lots 1, 2, 3 and 1440' of Lots 18, 19 & 20, Block 79:1; MIAMI (B-41), being approximately 190 N. E. 5th Street, as per plans on file; subject to the voluntary dedication of the East 10' of Lot 1 and the East 10' of the N40' of Lot 20; zoned C-3 (Central Commercial) be and the same is hereby granted. PUBLIC WORKS The dedication of the east 10 feet of lot 1 and the east 10 feet of the north 40 feet of lot 20 is requested. D.O.T.T. The Department of Traffic and Transportation has no objection to this proposal. Gary City Manager ,. r i o gon s Dir Planning and Zoning Boards Administration ^.TE December 14, 1981 FILE! ,,..-- REQUEST FOR EXTENSION OF TIME CONDITIONAL USE - 190 NE. 5th Street COMMISSION AGENDA - January 28, 1982 PLANNING & ZONING ITEMS ENCLOSURES: ARTICLE XXXII of the Comprehensive Zoning Ordinance No. 5871 provides that any Conditional Use shall expire six months after the effective date of the Conditional Use unless a Building Permit or a Certifcate of Use has been issued based upon the Conditional Use. The Ordinance further provides that the City Manager may, after review and determination that substantial progress has been achieved by the applicant in terins of project planning, extend the expiration date of the Conditional Use for an additional period of time not to exceed one year, subject to approval of the City Commission. The Planning Department finds no objection to the granting of the extension of time for this Conditional Use. We are requesting the City Attorney's office, by copy of this memo, to prepare the proper Resolution for this extension. Gary, City Manager City of Miami Dinner Key ISiami , Florida Dear Sir: Department of HOUSING & URBAN DEVELOPMENT December 5, 1981 Re: Request for Extension of Conditional Use On July the 5th, the City of Miami Zoning Board granted a conditional use to provide for the construction of Harry Cain Towers, a 154 unit housing project for the elderly to be located at N. E. 2nd Avenue and N.E. 5th Street. Bids have been received and the lowest price is an awardable figure. The bid documents, bond,insurance, etc. are now in re- view by the County Attorney and by the staff of the Florida Area Office. Following the review, there remains a resolution to be passed by the County Commission to award the contract. Even though the review of the plans by the City Building Department is almost completed, we will be unable to meet the January 5th expiration date of the conditional use. This is our formal request for an extension of tisN ditional use for a period of six (6) months.
