HomeMy WebLinkAboutR-82-0067RESOLUTION NO. 82 -67 A RESOLUTION EXTENDING RESOLUTION NO. 80-835 (PASSED AND ADOPTED BY THE CITY COMMISSION ON NOVEMBER 6, 1980), BY EXTENDING THE TIME PERIOD FOR REVIEW BY THE CITY COMMISSION FOR A PERIOD OF ONE YEAR. WHEREAS, the City Commission on November 6, 1980, pursuant to Resolutions No. 80-835 and 79-183, amended a previous Resolution No. 74-970, by permitting an opening in the wall along the Northwest llth Street side of the Central Shopping Plaza subject to several conditions, a review by the City Commission within one-year; WHEREAS, the one-year period has expired and the applicant is requesting an extension of said period; WHEREAS, the City Commission finds it in the best interest of the residents of the City of Miami to grant said extension; Now, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution NO. 80-835, passed and adopted by the City Commission on November 6th, 1980, be and the same is hereby extended by extending the time period for review by the City Commission for a period of one year. P rez-A Direc Planning and Zoning Boards L NCL SURFS: Resolutions No. 80-835, 79-183A, Administration & 74-970 On November 6, 1980 the City Commission adopted Resolution No. 80-835 extending Resolution No. 79-183-A which amended Resolution No. 74-970 by permitting an opening in the wall along the N.W. llth Street side of the Central Shopping Plaza subject to certain conditions, one of which was a yearly review by the City Commission. W. llth Street some- where in the vicinity of N. W. 39 Avenue. The City Commission previously considered this request, June 17, 1976 and did not allow an opening. (Motion #76-597) EXPLANATION The original approval for Central Shopping Plaza required a landscaped buffer and rear walls along NW llth Street and NW 39th Avenue prohibiting any access to these two streets from the shopping plaza, except adjacent to NW 7th Street. A public hearing was held by the City Commission on Septem- ber 12, 1974 to consider a bank and drive-in teller facility; the Planning Department and the Zoning Board recommended an opening for egress only onto NW llth Street at 38th Avenue. At this hearing many local residents and the Grapeland Heights Civic Association were opposed to any additional access openings to the north or west. The Commission approved the application by Resolution 74-970 which did not allow access to the Public Hearing on June 17, 1976, was pursuant to the owners and mer- chants of Central Shopping Plaza requesting a change in the conditions and limitations imposed on Central Shopping Plaza by the City. The proposed change was to permit one or more openings for ingress/egress to NW llth Street facilitate traffic movement for two operations which have been added to the shopping center since its original development. These are a Florida State Drivers License Station and a bank drive-in teller operation. To date, the applicants have offered the following conditions to be attached to the permission to have a vehicular access open- ing to N. W. I lth Street: 1. The proposed opening will be for egress only (exiting the site only). 2. Provide appropriate stop signs at the exit. 3. Clearly mark the exit that it is to be used for exit only and for passenger vehicles only. 4. The width of the exit to be less than required for commercial trucks. 5. Install necessary speed bumps to limit vehicular exiting speeds. 6. Provide a permanent pedestrian opening in the north wall to N. W. llth Street. 4, _ 6 7 • 7. Install a conventional steel gate at the vehicle egress which would only be opened during the hours of the _+ Drivers License Testing Facility. This gate would be opened by the officials of the Testing Facility in the morning and locked by them in the afternoon. 8. Provide an on -site driving course at the N. W. corner of the shoppi-.g center for use by the State Division of i Driver Licenses. RECOMMENDATIONS PLANNING DEPARTMENT APPROVAL SUBJECT TO THE CONDITIONS SETFORTH BY THE APPLICANTS AS STATED IN THE AB OVE EXPLANATION OF THE REQUEST. DADE COUNTY DEPARTMENT OF TRAFFIC AND TRANS- POR TA TIONS APPROVAL COMMUNITY REACTION Area residents continue to oppose any opening onto N. W. llth Street. CITY COMMISSION Deferred October 27, 1976 for full Commission (1 member absent). Denied wall opening November 17, 1976, and requested investi- gation of alternative sites for the Drivers License Bureau. Deferred April 27, 1977 for neighborhood meeting to discuss alternatives, to be chaired by Commissioner J. L. Plummer. Deferred July 21, 1977 due toanticipated length of meeting. Discussion September 15, 1977 of neighborhood meeting and requested a public hearing be held in November. Deferred December 15, 1977. APPROVED, January 24, 1978, with conditions, for a one year period. APPROVED March 8, 1979 for a one year period. APPROVED November 6, 1980 for a one year period. t3N-67 .4
