AMENDMENT NO. TO ORDINANCE NO. 8719

AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE 8719,
ADOPTED OCTOBER 26, 1977, THE SUMMARY GRANT APPRO-
PRIATIONS ORDINANCE, AS AMENDED, BY ESTABLISHING A
NEW TRUST AND AGENCY FUND ENTITLED: "KWANZAA FESTIVAL
(5TH YEAR)"; AND APPROPRIATING FUNDS FOR THE OPERATION
OF SAME IN THE AMOUNT $39,000 TO BE RECEIVED FROM
METROPOLITAN DADE COUNTY IN THE AMOUNT OF $14,000,
SPECIAL PROGRAMS AND ACCOUNTS -QUALITY OF LIFE PROGRAMS
IN THE AMOUNT OF $14,000, AND THE NATIONAL ENDOWMENT
FOR THE ARTS IN THE AMOUNT OF $11,000; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND DIS-
PENSING WITH THE REQUIREMENT OF READING SAME ON TWO
SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS
OF THE MEMBERS OF THE COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 8719 on October
26, 1977, establishing resources and appropriations for grant funds an-
ticipated by the City of Miami, Florida; and
WHEREAS, the Recreation Department, Cultural Division, in conjunc-
tion with the Kwanzaa Festival Committee of South Florida and the Cultural
Advisory Council of Overtown, has planned a county -wide Kwanzaa Festival
[hereinafter referred to as "Kwanzaa Festival (5th Year)"], to be conducted
primarily December 26, 1981 through January 1, 1982, relating to Afro-
American heritage; and
WHEREAS, Metropolitan Dade County has awarded $14,000 from Tourist
Bed Tax monies to the City of Miami in support of Kwanzaa Festival (5th Year);
and
WHEREAS, the National Endowment for the Arts has awarded the City of
Miami $11,000 in support of Kwanzaa Festival (5th Year); and
WHEREAS, funds have been provided for in the Fiscal Year 1981-82 budget,
Special Programs and Accounts -Quality of Life Programs in the amount of
$14,000 to support Kwanzaa Festival (sin Year); and
WHEREAS, it is anticipated that community support will be in the form
of in -kind contributions and endorsements from the Urban League of Greater
Miami, Dade County Community Relations Board, United Negro College Funds
(Area Office), Pepsi Cola Bottling Company of Miami, Black Cultural Arts
Alliance (representing over 30 Afro-American arts organizations throughout
Southeastern United States), Miami Black Archives, History and Research
Foundation of South Florida, Inc., Progressive Firefighter of Dade County,
Performing Arts for Community and Education, Inc. (P.A.C.E.), Olatunji
Center for African Studies (New York), James E. Scott Community Association,

Miami Times Newspaper, Miami Courier Newspaper, Theatre of Afro -Arts, the
"M" Ensemble, Greater Miami Mass Choir, Florida State Representative Carrie
Meek, the Dade County Council of Arts and Sciences, Dade County Tourist
Development Board, and various fraternaties and sororities; and
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No. 8719, adopted October 26, 1977, as
amended, is hereby further amended as follows: 1/
"Section 1. The following Trust and Agency Funds are hereby established
and resources are hereby appropriated as described herein:

Section 2. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this ordinance are hereby
repealed.
Section 3. If any section, part of section, phrase, paragraph, clause
or word of this ordinance is declared invalid, the remaining provisions of
this ordinance shall not be affected.
Section 4. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than four -fifths of the
members of the Commission.

It is recommended that the City Commission adont
an ordinance amending Section 1 of Ordinance No.
8719, adopted October 26, 1977, the Summary Grant
- Appropriations Ordinance, as amended, by establi-
shing a new Trust and Agency Fund entitled: "Kwan-
zaa Festival (5th Year)"; and appropriating fund:
for the operation of same in the amount of $39,000
to be received from 'Metropolitan Dade County in the
amount of $1.4,000, Special Programs and Accounts -
Quality of Life Programs in the amount of $14,000,
and the National Endowment for the Arts in the a-
mount of $11.,000; containing a repealer provision
and a severabil.ity clause; and dispensing with the
requirement of reading- same on two separate days
by a vote of not .less than four -fifths of the mem-
bers of the Commission, as per attached ordinance.
Illiereas, the City Commission has supported "Kwanzaa Festival" in years past,
it is again recommended that the City Commission adopt an Ordinance esta-
blishing a Trust and Agency Fund entitled "Kwanzaa Festival (5th Year)".
Metropolitan Dade County has awarded "Kwanzaa" the amount of $14,000 from its
Tourist Bed Tay: Fund and the National Endowment for the Arts has awarded
"}:wanzan" the sum of $11,DQn. T';ae City of '!iami, throuch the Festival Ad-
visory Committee, has crnnted "K41inzaa" the amount of $14,000 from the Special
Programs a:,d accnunts-Quality of Life Fund. Additional revenues from ticket
sales and in -kind contributions could not be accurately forecasted and have
not been included in this proposed ordinance.
This year's Kwanzaa Festival will continue to provide significant cultural
and educational events to the citizens of the City of Miami and Dade County.
