HomeMy WebLinkAboutR-82-0132411k OK RESOLUTION NO. 8 2" 13 2 A RESOLUTION GRANTING TO DADE COUNTY A QUIT CLAIM DEED CONVEYING PREVIOUSLY ACQUIRED PUBLIC RIGHT-OF-WAY FOR IMPROV- EMENT PURPOSES ALONG 46TH STREET, RES- ERVING TO THE CITY OF MIAMI THE RIGHT TO USE SAME FOR UTILITY PURPOSES. WHEREAS, Dade County is improving North West 46th Street and in the process of acquiring right-of-way for the improvement from the North -South Expressway (195) to North West 19th Avenue (City Limits); and WHEREAS, the City of Miami has been requested to quit claim to Dade County the public right-of-way previously acquired, for this improvement; and WHEREAS, it is deemed to be in the best interest of the City of Miami to relinquish the aforesaic: right-of-way to Dade County, reserving, however, to the City of Miami the right to use same for utility purposes, if necessary; and WHEREAS, it is now in order for the City Commission to approve the conveyance of the aforesaid right-of-way to Dade County; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager and the City Clerk of the City of Miami are hereby authorized to execute and deliver to Metropolitan Dade County, Florida, a quit claim deed for highway improvement of the public right-of-way previously acquired by the City of Miami on North West 46th Street, more particularly described as follows: All that portion of Sections 22, 23, and Section 24, Township 53 South, Range 41 East, Dade County, Florida, which lies within the right-of-way for N.W. 46 Street, from North -South Expressway (I-95) to to North West 19th Avenue (City Limits) and connections thereto, as said right- of-way is shown on the Dade County Public Works Department Right -Of -Way Map, Project No. 660027, as recorded in Road Map Book 10 at Page 75 of the Public Records of Dade CITY COMMISSION County, Florida, reserving to the City of M ami MEETING OF F E B 1 1p19982 v2 - 1_ e RESOLUTION NO. the right to use the aforesaid property for utility purposes. Subject to existing covenants, agreements, easements, restrictions, reservations, zoning ordinances, and limitations of record, if any. PASSED AND ADOPTED this 11TH day of FEBRUARY , 1982. THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS ADOPTION OF THE ATTACHED RESOLUTION CONVEYING TO DADE COUNTY PREVIOUSLY ACQUIRED RIGHT-OF-WAY ON N.W. 46TH STREET; AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND THE CITY CLERK TO EXECUTE A QUIT CLAIM DEED THEREFOR. :made Ca:-ty is in the process of reconstructing N.W. 46th Street ana of acquiring the necessary right-of-way for the improvement from North. Since the City of Miami has previously acquired certain right-of- way within its corporate limits along 46th Street, we have been requested to quit claim the City's interest thereof to Dade County. We hav- been advised by the City Attorney that the City of Miami may quit claim its interest to such right-of-way, but that certain easements for the maintenance of public facilities should be retained.
