Re: Temporary Use of the Bandshell Area - Bayfront Park
Dear Mr. Gary:
On January 25, 1981, at a regularly scheduled meeting of the City Commission
and by Motion 81-556, the City Commission accepted your recommendations
concerning the use of Bayfront Park by Holywell Construction Company.
A copy of the Agreement for the temporary use of the Bandshell area is attached
hereto.
Pursuant to the terms of the attached Agreement, our use of the Bandshell
area expired on February 28, 1982. We hereby request that the City Manager
be allowed to continue on a month -to -month basis our use of the Bandshell
area under the same terms and conditions as set forth in our Agreement.
This request is being made as a result of our parking facility located on Ball
Point not yet being completed. We anticipate completion of the facility by
June 1, 1982. This action by the City in allowing us to continue the use of
the Bandshell area will permit us to continue to make available to the public,
parking on the three remaining parking lots in DuPont Plaza.

Dear Mr. Gary:
The Holywell Construction Company and Mr. Theodore B. Gould
("Developer") hereby submit for your consideration the following proposal
for the temporary use of the south -end Bandshell area of Bayfront Park.
1. The City of Miami ("City") grants to Developer the exclusive use
of the Bandshell area of Bayfront Park as outlined on Exhibit
"A", attached hereto.
2. Developer agrees that no "hatching plant" will be erected on said
property, and that the property will be used to park construction
trailers and parking for the employees of Developer, its
contractor, sub -contractors, affiliates and related entities.
3. The term of this Agreement shall commence on July 1, 1981 and
end on February 28, 1982, both dates inclusive.
4. In consideration thereof, Developer agrees to:
(a) Pay to the City a monthly sum of Five Thousand Dollars
($5,000), said sum to be paid to the Trust Account
estabEshed for the Redevelopment of Bayfront Park;
(b) Pay all costs for the demolition and removal of the existing
Bandshell;
(c) Allow the continued operation of the parking lot located on
Block 2 of DuPont Plaza;
(d) Fence the perimeter of said Bandshell area and provide
security personnel to patrol said area on a full-time, 24-
hour-day basis;

5. The Developer further agrees that:
(a) No trees will be removed from the Park area except as
may be necessary to demolish the Bandshell;
(b) No part of Biscayne Boulevard or Biscayne Boulevard Way
will be closed to public traffic, except, when necessary,
those portions where easements exist to install or service
utility lines, storm sewers, telephone equipment and such
other under -street work as may be necessary from time to
time.
6. The City of Miami and Developer agree to enter into
negotiations for the funding of a fountain in the proposed
Noguchi Park. In the event an agreement cannot be reached
regarding the funding ofsaid fountain, Developer agrees that,
subsequent to the expiration of the Agreement, and at the
request of the City, it will sod the area described herein.
Upon your acceptance of this Agreement, Developer and City will be
bound by the terms outlined above, for the term herein specified.

A MOTION ADVISING THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION, THAT
THE PRESENT BIFURCATED PLAN FOR DUPONT PLAZA IS NOT ACCEPTABLE TO THE CITY
OF MIAMI CITY COMMISSION, AND FURTHER ADVISING THE STATE THAT WE ARE WORK-
ING ON A REVISION OF SAID PLAN AND ASK THAT THE STATE OF FLORIDA DEPARTMENT
OF TRANSPORTATION STUDY AND CONSIDER THE BARTON-ASM4AN PLAN; FURTHER REQUEST-
ING THE FLORIDA STATE DEPARTMENT OF TRANSPORTATION TO INVITE ALL INTERESTED
AN-D AFFECTED PARTIES IN THE EVENT A MEETING IS CALLED IN REGARD TO THIS

A MOTION OF THE CITY C=41SSION ACCEPTING THE CITY MANAGER"S RECOMMENDATIONS
AS DELINEATED IN A MEMORANDUM DATED JUN`E 16, 1981 CONCERNING THE USE OF
BAYFRONT PARK BY THE HOLYWEL CORPORATION AS FOLLOWS:
1. THAT EXISTING PARKING LOT 112 IN THE DUPONT PLAZA AREA REMAIN OPEN
TO PUBLIC PARKING;
2. STIPULATING THAT THE DEVELOPMENT COSTS IN BAYFRONT PARK, SPECIFICALLY
THE DEMOLITION OF THE BAND SHELL AREA, SHALL BE PAID BY THE HOLYWEL
CORPORATION;
3. THAT THE CITY OF MIAMI BE PAID A MONTHLY RENT IN THE AMOUNT OF
$5,000.00 FOR USE OF THE AREA C=—IONLY REFERRED TO AS THE BAND SHELL/
CHOPIN PLAZA AREA;
4. THAT NO TREES BE REMOVED FROM THE PARK AREA, EXCEPT IN THE AREA OF ✓
THE BAND SHELL;
5. THAT NO PORTION OF BISCAYNE BOULEVARD OR BISCAYNE BOULEVARD WAY BE./
CLOSED DURING THE CONSTRUCTION PERIOD;
FURTHER STIPULATING THAT THE INCOME DERIVED FROM THE RENTAL OF THE AFORE-
SAID PARKING LOT SHALL BE DEDICATED FOR THE EVENTUAL DEVELOPMENT OF THE.,
PARE; FURTHER INSTRUCTING THE CITY MANAGER TO CONTINUE NEGOTIATIONS WITH
HOLYWEL/OLYMPIA YORK CONCERNING POSSIBLE FUNDING BY THE DEVELOPER FOR THE
CONSTRUCTION OF A FOUNTAIN TO BE DESIGNED BY MR. NOGUCHI; FURTHER STIPULAT-
ING THAT THE SUBJECT AREA SHALL NOT BE USED AS A BATCHING PLANT AND THAT
PARKING SHALL BE LIMITED TO PARKING BY CONSTRUCTION EMPLOYEES AND FOR
TRAILERS WHICH ARE TO BE USED IN THE CONSTRUCTION; AND, FINALLY, DECLARING
THE INTENT OF THE CITY COMMISSION THAT IF A COMMITMENT IS NOT ULTIMATELY ,
OBTAINED FROM THE DEVELOPER FOR CONSTRUCTION OF THE SO-CALLED NOGUCHI
FOUNTAIN, THAT SAID AREA BE RESTORED TO GREEN SPACE.

AWARD CONTRACTS CONCERNING BUS BENCHES AND BUS SHELTERS TO "BUS BENCH
COMPANY" AND TO "CONVENIENCE & SAFETY CORPORATION OF SOUTH FLORIDA"(C & S),
