A RESOLUTION AUTHORIZING THE CITY MANAGER TO INCREASE
h THE TURNKEY CONTRACT BETWEEN THE CITY OF MIAMI AND
MIAMI CENTER ASSOCIATES, INC., FOR THE CONVENTION
CENTER PARKING GARAGE IN THE AMOUNT OF $127,660, IN
ACCORDANCE WITH THE PROVISIONS OF THE CONTRACT, FUNDS
THEREFOR TO BE EXPENDED FROM THE CITY OF MIAMI
CONVENTION CENTER AND PARKING GARAGE REVENUE BONDS.

i WHEREAS, there exists a Turnkey Contract between the City
?� of Miami and Miami Center Associates, Inc., dated May 20, 1980,

for the building of a parking garage of at least 1,450 spaces for
I a cost not to exceed $15,000,000 and providing for appropriate
cost safeguards, and
WHEREAS, the City Commission, on November 26, 1980, authorized
an increase in the scope of the Turnkey Contract in the amount of
$4,800,000, with the requirement said funds be provided by Dade
Savings and Loan and deposited with the Pan American Bank, in accordance
with the applicable Trust Indenture provision and that the basic
provisions of the Turnkey Contract remain the same, and
WHEREAS, the contract provides such a safeguard in that if
unforeseen and abnormal subsoil conditions that could not have been
anticipated through adequate and sound test borings and subsurface
engineering were encountered, Miami Center Associates, Inc. would
be entitled to an adjustment in contract, said adjustment requiring
Commission approval, and
WHEREAS, the contractor has provided documentation that such
abnormal subsoil conditions were encountered and the anticipated
number of piles required for the foundation was increased from 1,500
to 1,629, and
WHEREAS, the Project Director and the consultants recommend
approval of the request for the increase in contract, and
WHEREAS, funds for the increase are available from Convention
Center and Parking Garage Revenue Bond funds;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to issue
a Change Order to the Turnkey Contract between the City of Miami
and Miami Center Associates, Inc., for the Convention Center

A Resolution authorizing the City Manaaer to
increase the Turnkey Contract for the Convention
Center Parking Garage between the City of Miami
and Miami Center Associates, Inc. in the amount
of $127,660, in accordance with the provisions
of the contract, funds therefor to be expended
from the City of Miami Convention Center and
Parking Garage Revenue Bonds.
On January 10, 1980, the City Commission by Resolution No. 80-21
authorized the City Manager to negotiate a contract with Miami
Center Associates, Inc., for the turnkey design and construction
of the Convention Center Parking Garage.
On May 20, 1980, the City Manager negotiated such a contract with
Miami Center Associates, Inc. in an amount not to exceed $15,000,000,
with provisions for appropriate cost safeguards included. The Turnkey
Contract made provisions for adjustment of the contract price to
Miami Center Associates in the event that abnormal subsoil conditions
so unusual that they could not have been anticipated through adequate
and sound test borings and subsurface engineering were encountered,
said adjustment(s) requiring approval of the Commission.
Although on November 26, 1980, the City Commission authorized the
City Manager, by Resolution No. 80-856, to increase scope of the
Turnkey Contract in the amount of $4,800,000, with the requirement
that said funds be provided by Dade Savings and Loan and deposited
with the Pan American Bank in accordance with the applicable Trust
Indenture provision, the basic provisions of the Agreement remained
the same.
During the construction of the foundation, subsoil conditions were
encountered that required an increase in the piles required from
1,500 to 1,629. The increase in the number of piles was as directed
by independent soil engineers and is considered to serve as
documentation that abnormal subsoil conditions warranting adjustment
of the contract price were encountered. The soil engineers,
Langan Engineering Associates, Inc. have certified to this change
in requirements.

The contractor has billed Miami Center Associates, Inc. for theLk
extra work, and they, in turn, have requested an increase of $127,660
in their contract amount to cover the cost of the additional work.
The architectural consultants have concurred with my recommendation
for an approval of the increase. Funds for the increase in the
contract amount are available from Convention Center and Parking
Garage Revenue Bond funds.
