One proponent was present at the meeting. An ORDINANCE to provide for this Change of Zoning has been prepared by the City orney's Office and submitted for consideration of the City Commission. REQUEST Change of Zoning Classification to R-C (Residential Office). RECOMMENDATIONS PLANNING DEPT. DENIAL. There is no indicated need for additional residential - office zoning in the subject area. The requested change encroaches into an established low density residential area and would establish a serious precedent for similar type requests in the area. Recent plans in relation to the transit station area indicated that no changes should be made in this immediate area. g2-X'?a PUBLIC WORKS No dedication is requested. The proposed rezoning of this site doesn't significantly increase sanitary sewer flow, however, the continuing expansion of R-C zoning would effect sanitary sewer flow. This would require the upgrading and rebuilding of sanitary sewers. DADE COUNTY TRAFFIC No objection to this proposal. AND TRANSPORTATION ZONING BOARD This item was deferred from the meeting of 11-2-81 due to a short board. AN ORDINANCE AMENDING ORDINANCE NO. 6871 AS AMENDED, THE COMPREHENSIVE ZONING ORDINANCE;'* j FOR THE CITY OF MIAMI, BY CHANGING THE ZONING i CLASSIFICATION OF LOTS 24 THROUGH 26, INCLUSIVE, s, BLOCK 51: EAST SHENADOAH (14-55), BEING A1?PROX- IMATELY 1187-1193 SOUTHWEST 22 TERRACE, FROM R-2 (TWO FAMILY DWELLING) TO R-C (RESIDENTIAL - OFFICE); AND BY MAKING THE NECESSARY CHANGES `,IN THE ZONING DISTRICT MAP MADE A PART OF SAID '.ORDINANCE NO. 6871, BY REFERENCE AND DESCRIPTION iN ARTICLE III, SECTION 2, THEREOF, BY REPEAL - AG ALL ORDINANCES, CODE SECTIONS.OR PARTS TA\REOF IN CONFLICT AND CONTAINING A SEVERA- BILITY CLAUSE. 4 WHEREAS, the Mi6i Zoning Board at its meeting of Febru- ary 22, 1982, Item No. 1, following an advertised hearing, adopted Resolution No. Z$ 12-82 by a 6 to 0 vote (1 member abstaining) RECOMMENDING DENIAL of a change of zoning classifi- cation, as hereinafter set forth; and WHEREAS, the City Commission notwithstanding the denial of the Zoning Board finds that the use will not be detri- mental or injurious to,the character of the development of the immediate neighborhood; NOW, THEREFORE', BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI., FLORIDA: Section 1.// Ordinance No. 6871, as amended, the Com- prehensive Zoning Ordinance of the City of Miami, be and the same is her4y amended by changing the zoning classification of Lots 24/ through 26 inclusive, Block 51, East Shenandoah (14-55) ,eing approximately 1187-1193 Southwest 22 Terrace, from '2 (Two Family Dwelling) to R-C (Residential -Office), and, y making the necessary changes in the zoning District Map 4 m e a part of said Ordinance No. 6871 by reference and d`es- Y ription in Article III, Section 2, thereof. ` 82-272 r, If Section 2. That all Ordinances, Code Sections or parts thereof in conflict herewith be and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole.
