Section 5 - FLOOR AREA RATIO
(1) The floor area ratio shall not exceed 3.0 except
as provided in paragraphs (2) and (4) of this
section.
(2) The floor area ratio may be increased by the follow-
inc� bonuses subject to Site and Development Plan
Approval by the Urban Development Review Board;
provided that the requirements of this District are
complied with. In no case shall bonuses (b), (c)
or (e) be utilized for non-residential uses on
anv lot which abuts Biscayne Bay or the Miami
River.
(a) For every one (1) square foot of residential
floor area provided within the FAR 3.0 per-
mitted in paragraph (1) above, a bonus of
one (1) additional square foot of floor area
may be granted for any permitted use up to a
total bonus of ._
(b) Subject to the limitation in paragraph (2)
above, for lots having a depth of at least
one hundred and fifty (150) feet measured
from anv one street frontage, the floor area_
ratio may be increased on the basis of said
street frontage as follows:

(c) Subject to the limitation in paragraph (2)
above, where the depth in (b) above exceeds
three hundred (300) feet, the floor area ratio
may be increased by .10 for lots with a minimum
street frontage of one hundred and fifty 150)

(d) For every four (4) square feet of underground
parking, a bonus of one (1) additional square

mitted use.
(e) For every one (1) square foot of ground level
retail space provided within the FAR 3.0 per-
mitted in paragrapn (1) above, ana wnicn
meets the following requirements, a bonus

subject to the limitations for waterfront
lots in paragraph (2) above.
1. Ground floor retail space shall be
designed for occupancy by retail and
service uses listed in paragraphs (7)
and (8) in Section 1 - USE REGULATIONS
2. Ground floor retail soace shall be
plazas, baywalks or through-biocK con-
nections. Furthermore, qualified
around floor retail space shall have
window openings adjacent to all such
pedestrian areas in order to maximize
the visibility of activities within.
(f) For every twenty (20) lineal feet of
an scape water rant walkway with an
average width of at least twenty (20)
feet, made permanently accessible to
the public and designed in accordance
with approved Baywa k Design Guidelines,
a bonus of FAR .01 may be granted for
any permitted use.
3. Wherever a floor area ratio bonus has been granted
based upon a specified use category, a record o
suci use requirements shall be filed with the
Bus inq Department and no Certificate of Oc-
cupancy shall be granted for any use in viola-
tion of that requirement.

(2) The following exceptions to the lot coverage limitations
in paragraph (1) above may be authorized by the Urban
Development Review Board, provided that in no case
shall the combined lot coverage of principal and acces-
sory structures exceed the maximum lot coverage provi-
sions in paragraph (1) of Section 9 - Structure Parking.
( a) Ground floor retail space which meets the criteria
set forth in item e 2 of Section n - Floor
Area Ratio, may be exempted from the maximum
lot coverage provisions in paragraph (1) above
where such space is located in an accessory parking
structure or in a one story enclosed accessory
s ructure.
(b) In addition to item (a) above, up to 100 of the
building floor area may be exempted from the lot
coverage limitations in paragraph (1) above,
where such floor area is located in the exterior
face of an accessory parking structure such that
the parking structure would not be visible from
the front yard area or from waterfront setback
areas.

4. Add a new Section 12 - PARKING as follows:
For mixed use developments including both office and resi-
dential uses, up to 30% of the required off-street parking
spaces for residential use may be credited toward meeting
the required number of off-street parkinq spaces for office
use, provided that no more than 30% of the total number of
parking spaces, residential and non-residential, are as-
s ignedg and that all spaces are within a single parking garage serving
both office and residential uses.

Section 3 - YARDS
(1) Except as greater dimensions are renuired in para-
grat�h (2 minimum yard :areas shall be as foilo,�rs:
(a) Adjacent to Brickell Avenue, all yards shall

(b) Adjacent to other streets, frontyards-shall
be a minimum of 20 feet in depth.
(c) Side yards, rear yards, and side street yards
shall be a minimum of 15 feet in depth.

(2) The location, design and access/egress of all
parking structures shall be subject to review
and approval by the urban Development Review
Board to assure the efficient and compatible
relationship between such structures and on -site
plaza spaces, pedestrian facilities and amenities
nrincipal. use structures, adjacent (love lopments,
Biscayne Bay and the special character of Brickell
Avenue. The following review guidelines shall be
applied:
(a) No parking structure shall front directly on
Brickell Avenue or any waterfront unless the
Board finds that exceptional design, use of
materials and landscaping would make such
structure visually compatible with the archi-
tectural desiFm of principal use structures,
plaza spaces, waterfront access walkways and
the special character of Brickell Avenue.
(b) Parking structures and attendant vehicular
access ways Should be located to avoid
exposure to or functional conflict with
required urban plazas, Pedestrian through -
block connections, waterfront walkways or
principal landscaping features. Access
drives should not divide required urban
plaza spaces or intersect principal pedes-
trian access routes linking public streets,
required urban plazas and primary use struc-
tures.
(c) Parking structures visible from public wa,,s
should incorporate one or more of the fo7167-
ing design features:
1 Use of identical facade design, materials
and/or architectural skin as primary
use structure;
2 Incorporation of principal uses including
residential, office or retail within the -
perimeter of parking structures;

Underground parking structure shall be defined
as a parking structure not exceeding a height
of three (3) feet six (G) inches above the
average established grade of the abutting; right-of-
way or private property. Any parking structure
exceeding such height shall be considered above
grade and shall be subject to all limitations for
accessory parking s ruc ures.

INTENT
In the interests of reduction of travel and traffic within
the City generally, conservation of energy, maintenance of
principal views from within the district and adjoining
areas preservation and enhancement of the design, land-
scaping. appearance of existing; development within the
area, and due to increased building intensities herein
provided, it is required that new development shall be so
designed as to assure open character, attractive and
secure pedestrian open space available to the general
public at ground level, physical and visual access to
waterfront areas, and appropriately located open space
serving residential useF, where annlicable. Concerning uses, it is
intended that multifaraily residential occupancy be nromoted,
especially along the waterfront, and generally encouraged
either in separate uildings or in combination with office
uses; and that supporting retail and service uses shall
be scaled and designed to serve needs of the district,
and not to attract traffic from outside the area.
9. Adding a new Section 13 - Public Amenity Requirements as
follows:
Section 13 - PUBLIC AMENITY REQUIREMENTS
(1) Urban Plazas - In order ensure that new high
intensity development within this district will
provide adequate open space designed for public
use and en,joytnent, a minimum of 25; of the lot
area shall be developed as Urban Plaza space accord -
in€; to the following design standards:
a) Urban Plaza space shall be open to use
the general public auring normal business
hours.

(b) Urban Plaza space shall be no more than 3.5
feet different in elevation from the adjoin-
ing public sidewalk for at least 700 of its
total area. The remaining 30% of the total
area may step up to meet minimum flood Zone
criteria for the ground floor elevation of
buildings.
(c) Urban Plaza space shall be open and unob-
structed to the public sidewalk for at least
50,; of its total length of frontage. Steps
shall not be considered as obstructions provided
that a ratio of tread to riser noless than
2:1 is maintained.
(d) Urban Plaza space shall have a minimum dimen-
sion of 20 feet.
(e) Urban Plaza space shall provide a minimum of
1 linear root seating for every 30 square
feet of Urban Plaza Space. Required seating
may be in the form of benches or walls 15 to
jo inches in height, or up to 30'-- of the
required seating; may be provided hr moveable
chairs intended for overnight storage.
(f) Urban Plaza space shall provide shade for at
least 50`�, of its required seating.
(g) Urban Plaza space shall provide at least one
tree per 1000 square feet of Urban Plaza
Space -
(h) Urban �Plaza space shall contain at least one
activity generating feature, including but
not limited to a large fountain with seating
along the ed-es; outdoor cafe; amphitheater
or stage _for outdoor performances; ground
oor retail shops with direct access to the
plaza; open pavilions for vendors; kinetic
sculpture.
Urban Plaza space may contain roofed shelters
( open at least 40`,0 of perimeter) , fabric roofs
or windbreaks, exhibit and display stands and
cases, community bulletin boards or kiosks
and facilities for outdoor food and drink
service. Such items shall be exempted from
limitations on occupancy of yard areas,
parking requirements, maximum lot coverage
requirements and floor area ratio calculations.
Such shelters, structures, and facilities
may not exceed 50% of the Urban Plaza area.
(j) Urban Plaza space shall have at least 60c of
its total surface area designed for pedestrian
access. This may include pavement, grass,
or seating space, but not including planting
beds or similar obstructions.
(k) Urban Plaza space shall provide access for the
handicapped. —
(1) Urban Plaza space shall not include driveways
or other vehicular circulation spaces. Vehic-
ular circulation spaces should avoid bisecting
Urban Plaza spaces at any point.
