HomeMy WebLinkAboutCC 1982-03-25 City Clerk's ReportCITE OF MPAMI CITY CLERK REPORTS MEETING DATE: PLANNING & ZONING ---- March 25-82 CITY HALL -DINNER KEY A MOTION OF INTENT OF THE CITY COMMISSION TO TIGHTEN UP PRESENT GUIDE- LINES GOVERNING CITY OF MIAMI BOARDS INSOFAR AS NON-ATTENDANCE OF BOARD MEMBERS TO BOARD MEETINGS IS CONCERNED, AND MAKING FULLY KNOWN ITS IN- TENT TO ADOPT NEW AND MUCH STRICTER RULES AND REGULATIONS GOVERNING THE NON-ATTENDANCE OF BOARD MEMBERS TO BOARD MEETINGS; FURTHER REQUEST- ING THE CITY ATTORNEY TO FULLY RESEARCH THIS ISSUE AND BRING BACK PRO- POSED LEGISLATION SIMILAR IN NATURE TO THAT GOVERNING THE DOWNTOWN DE- VELOPMENT AUTHORITY SO THAT THE CITY CODE MAY BE CHANGED ACCORDINGLY; AND FURTHER REQUESTING THE CITY MANAGER TO PLACE THIS ISSUE ON THE APRIL 1ST AGENDA FOR FURTHER CONSIDERATION BY THE CITY COMMISSION. A MOTION OF THE CITY COMMISSION EXPRESSING ITS ACCEPTANCE OF THE PROPOSED LANGUAGE TO BE INSERTED AS SECTION 8(a) OF ORD.9382 (PREVIOUS- LY PASSED AND ADOPTED BY THE CITY COMMISSION AT ITS MEETING OF MARCH 16, 1982) WHICH LANGUAGE SHALL CONSTITUTE PAGE 13 OF THE AFOREMENTIONED ORDINANCE AND SHALL READ AS FOLLOWS: side drop-off lanes are requested by private development, minimum setbacks and sidewalk develop- ment standards shall be adjusted to compensate for the loss of sidewalk area. (8) HISTORIC PRESERVATION (a) No demolition permit shall be issued by the Building Department for any structure, or parts thereof, of major significance in local history or architectural history as determined by the Dade County Historic Survey, after a_hearing on such designation has been held by the City of Miami Commission or the appropriate Board or Commission, after the owner of such structure or part thereof has received due notice of such hearing and an opportunity to present evidence thereat unless the City Commission has first approved such demolition following a Public Hearing. The City Commission may at any time initiate and/or accelerate a Public Hearing on the approval of such demolition provided that prior thereto the developer shall meet with and discuss the proposed demolition with all interested parties as determined by the City of Miami Planning Department. The purpose of such Public Hearing is to ensure that structures, or parts thereof, of major historic sig- nificance are preserved for the health prosperity, education and welfare of the people of Miami unless an undue economic hardship would result which destroys reasonable and beneficial use of property, at the sole discretion of the Miami City Commission.
