A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT, IN SUBSTANTIALLY THE FORM
ATTACHED HERETO, WITH FREILICH & LEITNER, P.C.,
FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE
PREPARATION OF AN OVERALL IMPACT FEE AND/OR
FINANCING ORDINANCE FOR DEVELOPMENT OF CAPITAL
IMPROVEMENT INFRASTRUCTURES FOR THE CITY OF MIAMI,
IN AN AMOUNT NOT TO EXCEED $30,000; ALLOCATING
FUNDS THEREFOR FROM THE DOWNTOWN PEOPLE MOVER
CAPITAL PROJECT.
WHEREAS, by Resolution No. 82-62 passed January 28,
1982, the City Commission expressed its intention of enacting
an impact fee ordinance in 90 days and authorized the City
Manager and City Attorney to negotiate with outside counsel
to secure professional services to assist the Law Department in
the preparation of an impact fee ordinance; and
WHEREAS, Freilich & leitner, P.C., have proffered a proposal
which meets the City's needs and is prepared to undertake this
assignment;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Attorney is hereby authorized to
execute an agreement, in substantially the form attached hereto,
with Freilich & Leitner, P.C., for professional services in con-
nection with the preparation of an overall impace fee and/or
financing ordinance for development of capital improvement infra-
structures for the City of Miami, in an amount not to exceed
$30,000, with funds therefor hereby allocated from the Downtown
People Mover Capital Project.

It is recommended that the Commission
authorize the Manager to execute an
agreement with Freilich & Leitner, P.C.
as outside counsel for professional
services in connection with the pre-
paration of an Impact Fee ordinance for
the City of Miami in an amount not to
exceed $30,000 per the attached reso-
lution.
Per Resolution 82-62: January 28, 1982 the Manager and City Attorney were
authorized to negotiate with outside counsel to assist the Law Department
in the preparation of an Impact Fee Ordinance for the City.
Freilich & Leitner P.C., Kansas City, Missouri, have expertise in case law
pertaining to impact fees and have proferred the proposal (attached). It
is intended to frame an agreement, substantially in accord with the prof-
feted proposal, but compressing the time period.in order to expedite the
ordinance. Funding of up to $30,000 is proposed as an off -setting credit
from the Downtown People Mover Capital Project on the basis that inves-
tigation of impact fees is an alternative funding source for the DPM.

have included Sarasota !:aunty, Florida; Orange County, Florida; the
City of San Diego, California; Lexington -Fayette County, Kentuckv;
and King County, Nashirr-ton. We have a broad range of experience
to draw upon as well as particular local experience in Florida.
We have conducted extensive legal research nationally and in
Florida on the subject of impact fees. This knowledge and experience
would be brought to bear on this project in such a way that cost and
time savings would accrue to the City. Nevertheless, because each
locality's goals and oL?ectives are different, the structure of an
impact fee for related financing) ordinance and its development
