A RESOLUTION ACCEPTING THE PLAT ENTITLED
SIMPSON ADDITION, A SUBDIVISON IN THE
CITY OF MIAMI, FLORIDA; AND ACCEPTING
THE DEDICATIONS SHOWN ON SAID PLAT; AND
AUTHORIZING AND DIRECTING THE CITY
MANAGER AND CITY CLERK TO EXECUTE THE
PLAT AND PROVIDING FOR THE RECORDATION
OF SAID PLAT IN THE PUBLIC RECORDS OF
DADE COUNTY, FLORIDA.
WHEREAS, the City Zoning Board and the Department of Public
Works have recommended the acceptance of the Plat:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The Plat entitled "SIMPSON ADDITION" is a replat
of portions of Block 5 and 6 of BUENA VISTA GARDENS EXTENSION (4-199);
a portion of Block 6 of BUENA VISTA GARDENS (5-45); a portion of
Block 3 of EASTMORELAND (41-18) and the 5 feet more or less wide strip
lying Westerly of and adjacent to Lots 1 and 2 of said Block 6 of
BUENA VISTA GARDENS and that portion of N.W. 6 Court bounded on the
North by the South right of way line of N.W. 60 Street and bounded
on the South by the North right of way line of N.W. 58 Street. All
lying and being in the City of Miami Section 13, Township 53 South,
Range 41 East, all in the Public Records of Dade County, Florida,
which by reference is made a part hereof as it fully incorporated
herein and the dedications as shown thereon together with all existing
and future planting, trees and shrubbery on said property, to the
perpetual use of the public, are hereby accepted and confirmed by
the City of Miami, Florida.
Section 2. The City Manager and City Clerk are hereby au-
thorized and directed to execute the Plat and record same in the
Public Records of Dade County, Florida.

The Department of Public Works recommends
the approval of the plat by the City Com-
mission of Miami, Florida, and certifies
its correctness as to form.
The proposed record plat entitled SIMPSON ADDITION being a replat of
portions of Blocks 5 and 6 of BUENA VISTA GARDENS EXTENSION (4-199);
a portion of Block 6 of Buena Vista Gardens (5-45); a portion of
Block 3 of East More Land (41-18) and the 5 feet more or less wide
strip lying Westerly of and adjacent to Lots 1 and 2 of said Block
6 of Buena Vista Gardens and that portion of N.W. 6 Court bounded
on the North by the South R.O.W. line of N.W. 60 Street and bounded
on the South by the North R.O.W. line of N.W. 58 Street. It will
consist of 3 Tracts, having a total area of 8.15+ acres. It is
Zoned C-1.
This plat is being forwarded to your office for City Commission
action.
Also attached are the following itemized papers necessary to present
the Plat to the City Commission of Miami:
1. Resolution accepting the Plat.
2. Print of proposed Record Plat.
3. Agreement form pertaining to subdivision improvements.
4. Opinion of Title.
5. Memorandum from the Miami -Dade Water and Sewer Authority
pertaining to water mains and appurtenances.
6. Portion of City Atlas Sheet No. 13-J showing property platted
colored in red.

REPORT OF PROPOSED RECORD PLAT OF
SIMPSON ADDITION
A SUBDIVISION IN THE CITY OF MIAMI, FLORIDA
The accompanying Plat entitled SIMPSON ADDITION was prepared by
Crowder, Mahoney, Makowski, Rice & Associates, Inc. It is in
correct form for submission to the City Commission and is forwarded
with a recommendation that it be approved.
PERTAINING INFORMATION REGARDING THE PLAT:
1. The property platted is a replat of portions of Blocks 5 and
6 of BUENA VISTA GARDENS EXTENSION (4-199); a portion of
Block 6 of BUENA VISTA GARDENS (5-45); a portion of Block
3 of East More Land (41-18) and the 5 feet more or less wide
strip lying Westerly of and adjacent to Lots 1 and 2 of said
Block 6 of Buena Vista Gardens and that portion of N.W. 6
Court bounded on the North by the South R.O.W. line of N.W.
60 Street and bounded on the South by the North R.O.W.
line of N.W. 58 Street. It will consist of 3 Tracts, having
a total area of 8.15 + acres. It is Zoned C-1.
2•. The location of the streets and the widths conform with the
standards of the Department of Public Works of the City of
Miami, Florida.
3. As certified to by Frank Makowski, Registered Land Surveyor,
this Plat complies with the plat filing laws of the State of
Florida.
4. The City Zoning Board of Miami, Florida, after Public Hearing,
has recommended the closing of N.W. 6 Court between the North.
R.O.W. line of N.W. 58 Street and the South R.O.W. of N.W. 60
Street for a distance of 630'+ subject to the voluntary dedication
of the East 12 feet of Tract 'TB" and the East 10 feet of Tract
"A". This action was confirmed by the City Commission
Resolution No. 81-725.
5. By authority of Resolution No. 216-81, adopted November 16, 1981,
the Plat was recommended for acceptance by the City Zoning Board
of Miami, Florida.
6. The attached Certificate of Title Examination dated December
7, 1981, signed by Murry A. Greenberg, Attorney, indicates that
the fee simple title to the property platted is correctly
vested in Dade County and the Plat has been correctly executed.

7. The area platted is not encumbered by any mortgages.
8. In accordance with the requirements of Chapter 54, Section
54-30, of The Code of The City of Miami, Florida, an
Agreement has been entered into between the City of Miami
and Dade County and will guarantee the completion of the
subdivision improvements according to the provisions of the
Agreement between The City of Miami and the aforementioned
owner. The improvements required at the property platted are
listed as follows: landscaping, asphaltic concrete pavement,
removal of existing sidewalk, removal of existing. curb and
gutter, removal of existing pavement, sidewalk, curb and
gutter, storm drainage structures and sanitary sewers.
9. The location of the property is shown colored in red on the
accompanying copy of a portion of City of Miami, Atlas
Sheet No. 13 - J.
10. The attached Resolution has been prepared for the acceptance
of the Plat by the City Commission of Miami, Florida.

AGREEMENT FOR CONSTRUCTION OF CERTAIN IMPROVEMENTS
WHEREAS, DADE COUNTY, a political subdivision of the State of
Florida, (hereinafter referred to as the "Owner"), concurrently with
the delivery of this Agreement, has applied to THE CITY OF MIAMI,
FLORIDA, (hereinafter referred to as the "City"), for the acceptance
and confirmation by the Commission of said City, of a certain proposed
plat of a subdivision to be known as " SI1,1PSON
ADDITION" , located on approximately N. W. 7 Avenue to N. W. 6 Avenue -
N. W. 58 Street to 60 St.,a copy of which proposed plat is attached hereto
and made a part hereof as Exhibit "A".
WHEREAS, the execution of this Agreement by the Owner does not
waive his immunity from taxes or special assessments; and
WHEREAS, this Agreement when executed will testify to the Owner's
intention to plat and install the required improvements as set forth
herein; and
WHEREAS, the completion of the improvements as set forth herein
will not be required prior to the acceptance of the plat by the City
Commission.
NOW, THEREFORE, the Owner hereby convenants and agrees with
the City as follows:
1. Within one (1) year from the effective date of the acceptance
and confirmation of said plat by the Commission of the City, or prior
to the issuance by the City of a Certificate of Occupancy for the
_..__premises, the Owner will construct, or cause to have constructed, at
his own expense and in accordance with standard specifications of the
..City, the following listed improvements:
Although one year is allowed for the completion of the afore-
mentioned improvements, it is not in the public interest that such

construction work should be prolonged to the extent that it would
have a disorganizing effect upon the neighborhood. After the work
is started., the Owner hereby agrees to prosecute said work
progressively so as to complete it in a reasonable length of time.
2. The Certificate of Occupancy for any building or buildings
constructed on the property platted shall not be issued by the City
Building Department until the Owner has fully and faithfully
performed the work in accordance with the terms of this Agreement and
has submitted to the City Department of Public Works a letter from a
Registered Land Surveyor certifying that the Permanent Reference
Monuments indicated on the plat have been installed and properly placed.

You have requested an opinion of title concerning title
to real property known as Shell City Site, located at N.W.
7 Avenue between 58 and 60 Streets and the Expressway.
An application for final approval of the plat in
accordance with -Chapter 28 of the Metropolitan Code is
being prepared.
Section 28-8(d)(3) of the Metropolitan Code provides
that the application for final approval must be accompanied
by a
"Current opinion of title from an attorney
authorized to practice law in this state."
In compliance with this provision of the Code, I certify
that I am an attorney authorized to practice law in the State
of Florida.
Dade County acquired fee simple title to the following -
described property pursuant to a Warranty Deed to County of
Dade dated January 24, 1973, filed May 10, 1973, and recorded
in Official Records Book 8273 at Page 273 of the Public Records
of Dade County, Florida:
Lot 1, the East 2.50 feet of the North 70.00 feet of
Lot 2, Lot 3, Lot 4 less the West 28.5 feet of said
Lot 4, the East 57 feet of Lot 6, and Lots 7 through
26, all in Block 5 of BUENA VISTA GARDENS EXTENSION,
according to the plat thereof recorded in Plat Book
4 at Page 199 of the Public Records of Dade County,

PORTION OF EASTMORELAND, according to the plat
thereof recorded in Plat Book 41 at Page 18 of the
Public Records of Dade County, Florida.
Based upon the premise that no liens or judgments have
been filed against the property subsequent to Dade County's
obtaining title, and based upon the title review by Dade
County HUD, I am of the opinion that, subject to any conditions,
i restrictions, covenants, easements, reservations, limitations
and liens of record, Dade County has good and marketable fee
simple title to the property described herein, which excludes
Lots 1 and 2, less the South 40 feet, Block 3, Resubdivision
of Revised Plat of a Portion of Eastmoreland, Plat Book Al at
Page 18 of the Public Records of Dade County.
