ORDINANCE NO,
AN ORDINANCE ESTABLISHING A SPECIAL REVENUE FUND ENTITLED!
"MIAMI CABLE ACCESS CORPORATION" AND APPROPRIATING FUNDS FOR
THE OPERATION OF SAME IN THE AMOUNT OF $50,000 CONTAINING A
REPEALER PROVISION AND A SEVERABItITY CLAUSE; AND DISPENSING
WITH THE REQUIREMENT OF READING SAME ON TWO SEPARATE DAYS BY
A VOTE Or NOT LESS THAN FOUR -FIFTHS OF THE ME;1B> RS OF THE
COMMISSION
WHEREAS, Section 402(b) of Ordinance No. 9332, adopted October 19, 1981,
states that the City Commission shall establish an independent nonprofit com-
munity access corporation to be known as the 'Miami Cable Access Corporation
OMCAC") to manage and allocate the use of the nonmunicipal public access
channels of the System; and
WHEREAS, Resolution No. 82-303 , adopted on the first day of
April 1982, provides for the establishment of a five (5) member board
to undertake the hiring of a consultant to prepare the Articles of Incorporation
and By -Laws for the Miami Cable Access Corporation; and
WHEREAS, the $50,000 appropriation would be used to compensate the
consultant for the aforementioned work and to cover incidental expenses of
developing the Articles of Incorporation and By -Laws; and
WHEREAS, the $50,000 sliall be reimbursed from the $200,000 in start-up'
funds to be contributed by the cable licensee for the Miami Cable Access
Corporation pursuant to Section 403 of Ordinance No. 9332.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,

RESOURCES: Cable TV-MCAC Start-up Contribution $50,000
APPROPRIATION: Miami Cable Access Corporation $50,000 —
Section 2. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this ordinance are hereby
repealed,
Section 3. If any section, part of section, phrase, paragraph, clause
or word of this ordinance is declared invalid, the remaining provisions of this
ordinance shall not be affected.

Section 4. The requirement of reading this ordinance on two separate
days is hereby dispensed with by a vote of not less than fout-fifths of the
members of the Commission.

Appropriation of Funds to establish
the Miami Cable Access Corporation
(11CAC )
Intergovernmental Affairs Ordinance
"I recommend that the attached ordinance appro_pri=
ating $50,000 to cover the costs of establishing
the Miami Cable Access Corporation (MCAC) and
developing the'Articles of Incorporation and By -
Laws to be paid out of the Miami Cable Access
Corporation Special Revenue fund to be reimburs-
ed from the $200,000 start-up fund paid by the
Licensee within thirty (30) days of the incor-
poration as required in Section 403 of the Cable
License Ordinance be presented to the City Com-
mission for adoption on first and second reading."
The Cable Television License Ordinance provides for the Licensee to pay $200,000
to the Miami Cable Access Corporation (MCAC) as a start-up fee. The $50,000 appro-
priated by this ordinance will.be reimbursed to the City within thirty (30) days
of the date of incorporation of the MCAC.
Staff assistance to the MCAC will be initially provided by the Office of Intergovern-
mental Affairs until it has been sufficiently organized and staffed.
