IMPROVEMENT APPROPRIATIONS ORDINANCE
FOR FISCAL YEAR 1981-82; AS AMENDED;
BY INCREASING APPROPRIATIONS FOR THE
CITY OF MIAMINNIVERSITY OF MIAMI=
JAMES L. KNIGHT INTERNATIONAL CENTER
AND PARKING GARAGE (ITEM X.B.I.) IN
AN AMOUNT OF $2 MO ,000 FROM CONVEN-
TION CENTER REVENUE BONDS ACCRUED
INTEREST EARNINGS FOR ADDITIONAL WORK AND
IMPROVEMENTS TO THE CONVENTION
CENTER; CONTAINING A REPEALER PROVI-
SION AND SEVERABILITY CLAUSE,
WHFREAS, the City Commission adopted Ordinance No. 9353 on November
19, 1981, establishing resources and appropriations for the implementation
of capital improvements in the City of Miami, Florida, for the Fiscal
Year ending September 30, 1982; and
WHEREAS, the City Commission adopted Resolution No. 81-758 on
September 10, 1981, authorizing the City Manager to expend funds earned
as interest in the construction account for the City of Miami/University
of Miami -James L. Knight International Center for additional work; and
WHEREAS, the City Commission adopted Ordinance No. 9330 on October
7, 1981, increasing appropriations to pay for increased costs associated
with the James L. Knight International Center by an amount of $400,000
from interest earnings on the construction account; and
WHEREAS, an additional amount of $2,600,000 has accrued as interest
_ earnings in the Center's construction account; and
WHEREAS, the City Commission adopted Motion 82-102 on February 11,
1982, authorizing the City Manager to expend funds for additional improve-
ments to the City of Miami/University of Miami -James L. Knight International
Center so that construction may continue on a reasonable schedule; and
WHEREAS, said amount of $2,600,000 from interest earnings in the
construction account is available and can be appropriated to pay for
additional improvements to the Center as authorized in Motion 82=102; and
WHEREAS, ih said Motion 82-102 the City. Commission further directed
the City Manager to advise the develooer of the Center's hotel that he
will ultimately bear responsibility for any and ail costs incurred at the
completion of such improvements for the hotol;
NOW, THEREFORt X IT ORDAINED BY THE COMMISSION 05 THE CITY OF MIAMI,
5LORIDA.
Section 1. Section l of. Ordinance No. 9353,.adopted vovember 19, 1981, the
City's Capital Improvement Appropriations Ordinance for Fiscal. Year 1981.-612, as
amended, is hereby further amended in the folloudng particulars I/
"Section 1. The following appropriations hereby made by fund
and project title include previously authorized pro,iects and
fund appropriations for implementation of all municipal capital
improvements of the City of Miami, Florida, The sources of
revenue to support the herein appropriations are hereby identi-
fied by fund and project:

Section 3, Any and all costs incurred at the completion of
improvements for the hotel in the City of Miami/University of Miami"
James L. Knight international Center will be borne by the developer of
the hotel,
Section 4. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict With provisions of this ordinance are
hereby repealed,
Section 5, If any sections part of section, paragraph, clauses
phrase or word of this ordinance is declared invalid, the remaining
provisions of this ordinance shall not be affected.
Section 6. The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than
four --fifths of the members of the Commission.
Section 7. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for preservation of peace,
health, safety, and property of the City of Miami and upon the further
ground of the necessity to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions and duties of
municipal affairs.

It is recommended that the attached
amendment to Capital Improvement
Ordinance No, 9353 be approved to
appropriate $2,600,000 from Convention
Center Revenue Bonds interest to cover
increased costs of the City of Miami/`
University of Miami James L. Knight
International Center.
On September 10, 1981, the City Commission approved Resolution
No. 81-758, which authorized the City Manager to expend funds
earned as interest in the construction account for the James L.
Knight Convention Center for additional work, On February 11, 1982
the City Commission passed Motion No. 82-102 authorizing and directing
the City Manager to expend funds to keep the construction of the.
Convention Center on a reasonable schedule.
The City Commission further directed the City Manager to advise the '
Developer of the Hotel that he will ultimately be responsible for any
and all costs incurred at the completion of such improvements for the
hotel.
An additional $2,600,000 in interest earnings is available and it is
recommended that these funds be appropriated to pay for increased
costs of construction at the Convention Center,
It is --requested that this Ordinance be scheduled on the City Commission f
meeting of April 1, 1982.
