A RESOLUTION RATIFYING, APPROVING AND CONFIRMING
THE ACTION OF THE CITY MANAGER IN AUTHORIZING DANMARK,
INC. TO COMPLETE THE EMERGENCY WAGNER CREEK OIL REMOVAL
AT A COST OF $7,291.23; AUTHORIZING A FINAL PAYMENT
TO SAID FIRM FOR COMPLETED WORK AND ALLOCATING FUNDS
THEREFOR FROM THE SELF-INSURANCE TRUST FUND, GENERAL
LIABILITY ACCOUNT, CODE NO. 260502-653.
WHEREAS, on March 25, 1982 automatic transmission fluid
overflowed at the City`s Heavy Equipment Maintenance Tank
Farm; and
WHEREAS, said overflow entered into the storm drain system
of the City of Miami leading into Wagner Creek; and
WHEREAS, immediate action was necessary on the part of
the City to halt and preclude any further pollution of the
waterways and an immediate clean-up was required by the United
States Coast Guard;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The action of the City Manager in authorizing
Danmark, Inc. to complete the emergency Wagner Creek oil removal
at a cost of $7,291.23 is hereby ratified, approved and con-
f irmed .
Section 2. A final payment for work completed by Danmark,
Inc. is hereby authorized with funds therefor in the amount of
$7,291.23 hereby allocated from the Self -Insurance Trust Fund,
General Liability Account, Code No. 260502-653.

As you are aware, this Department experienced an oil leak into the
storm sewer system ultimately finding its way into Wagner Creek
and other waterways. I was contacted at approximately 3:00 p.m.
on Friday, March 26, 1982 by representatives of the United States
Coast Guard who had traced the leak to my fueling facility.
After a brief inspection it was determined that the leak had come
from the roof of my fueling facility into the roof drains and
subsequently into the waterways. Upon this discovery I was notified
by the Coast Guard that I could either assume full responsibility
for the clean-up and be liable to pay the contractor already involved
in the clean-up operations, as authorized by the Coast Guard, or
refuse and the City of Miami would be liable for the entire cost,
including that of the Coast Guard personnel and equipment involved.
I accepted responsibility on behalf of the City of Miami and agreed
to pay for services being provided by Danmark Inc., the contractor
engaged by the Coast Guard.
Upon further investigation as to the source of the automatic trans-
mission fluid spill, it was determined that due to the system's failure
to function automatically, a manual system was devised. A valve was
inadvertently left partially open and a solenoid valve malfunctioned
creating an overflow situation wherein the fluid was pumped through
a vent stac'r,l attached to the side of the fueling facility building
and on to the roof unnoticed by personnel working in this area. The
overflow apparently occurred Wednesday night and early Thursday morning.
The cost to the City is as follows:
750 gallons automatic transmission fluid @ $2.72 per gallon $2,040.00
Contractor cost for waterway clean-up =
$7,291.23
$9,331.23
Steps have been taken to elimirate the possibility of this unfortunate
accident occurring again. Also, a copy of this letter will be for-
warded to the Law Department to include ss part of the litigation
against the architect responsible for the design of this lubricant
tank farm.

You may be financially responsible for cleanup costs. Under Federal Statutes,
the United States Government has an interest in this incident and may take
action as deemed necessary to minimize damages caused by this incident.
The discharge of a harmful quantity of oil is a violation of the Federal Water
Pollution Control Act as amended by the Clean Water Act. Under this Act, the
person responsible for the pollution is obligated to undertake removal action.
If he refuses to take adequate removal action he is financially responsible
for actions taken by the Federal Government to remove the pollutant and ade-
quately mitigate its effects. Removal is being done properly if it is in
accordance with Federal and state statutes and regulations and the procedures
and criteria of the National Oil and Hazardous Substances Pollution Contigency
Plan. If you undertake removal, the adequacy of your actions will be deter-
mined by the U. S. Coast Guard On -Scene Coordinator. The On -Scene Coordinator
for this area is CDR, GA 1_: c r_ P /o . As long as you are taking adegt
action in this matter, Federal action will be limited to monitoring the progre;
of your activities and to provide guidance as necessary.
If it is determined that you are not taking prompt and appropriate actions to
contain, cleanup and dispose of the pollutant(s), Federal response may be
initiated. You may then be held responsible for all actual costs incurred by
the Federal Government as set forth in Section 311(f) of the Federal Water
Pollution Control Act, as amended. Should you require further information

OTHER COSTS:
1. Cleanup
Upon completion of a job, all of our equipment is cleaned and
inspected. Lines are replaced, damaged items are repaired or
replaced, expendables are replenished and made ready for future
use. The customer is charged for these expenses as reqular
cleanup duties. •
2. Small Tools & Supplies
n arbitrary Small Too] Allowance will be charged to cover use
of small tools and supplies that are too small to itemize.
This will include such items as: hand cleaner, line, rags and
wipes, gas cans, flashlights, lanterns, batteries, hailers,
water coolers, cleaners & detergents, respirators, eye masks.
rakes, shovels, brooms, brushes, pitchforks, snare hooks,
potato rakes, mechanics tools, garbage cans, spray units,
radios, collection nets, first aid kits, foul -weather gear,
boots, gloves, garden hoses, fittings, magnets, photographic
equipment, wheelbarrows, hand wringers.
When significant amounts are involved; they will be itemized
and shown separately on the invoice. Items that are broken
or rendered unfit for further use will be charged at replace-

3. Subcontracts
Costs for outside work will be charged and invoice copies will
be supplied upon customer request.
