A RESOLUTION RESCINDING RESOLUTION NO. 82-183,
ADOPTED FEBRUARY 25, 1982, WHICH PROVIDED FOR
APPOINTMENT OF MEMBERS TO THE ENVIRONMENTAL
PRESERVATION REVIEW BOARD.
WHEREAS, the Environmental Preservation Review Board
was established by Ordinance No. 8301, dated May 23, 1974, to
review development plans in environmentally significant areas
of the City; and
WHEREAS, it has come to the attention of the City Com-
mission that certain vacant positions filled on the Environ-
mental Preservation Review Board were not accomplished strictly
pursuant to pertinent City Code Sections relative to Committee
Organization and Professional lists; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 82-183, dated, passed and
adopted on February 25, 1.982, relative to the appointment of
certain members to the Environmental Preservation Review Board,
is hereby rescinded.

REFERLNCCS: Resolution 82-183
ENCLOSURES:
At the City Commission of February 25, 1982, six people
were appointed to the Environmental Preservation Review
Board. It has been brought to our attention that four of the
people were not appointed in accord with the requirements of
Chapter 17, Section 17-4 (a) of the City Code.
Section 17-4 (a) requires that the appointees to the
Board be from lists prepared from five designated categorical
groups. The four people, J. Middlebrooks, P. Hepburn, Dr.
Theede and T. Holmes were not recommended by any of the five
groups. Inasmuch as the subject code provisions are nondis-
cretionary in nature, it is mandatory that the positions of
the aforementioned appointees be filled in accordance with
Section 17-4 (a) of the City Code.
Resolution No. 82-183 will need to be amended to reflect
appointees from the existing lists submitted or those persons
wishing to be appointed will have to solicit endorsement of
the respective groups and then be properly appointed. It
should be noted that two of the remaining vacancies must be
filled from lists presented by the architects, and nurserymen/
groups respectively, and the remaining two vacancies may be
from any one of the five categories.
The attached draft Resolution rescinds Resolution No.
82-183 and contains the two names previously appointed by
the City Commission that meet the requirements of.Section
17-4 of the City Code.
It should be noted that the herein code section neces-
sitating this action and establishing this Board are slated
for repeal upon passage of the proposed new Heritage Conser-
vation legislative package.

It is necessary for the City Commission to appoint six members to
the Environmental Preservation Review Board since four members have
resigned - Pat Kolski, Julia Fernandez, Stephen Davis and Anthony
La,taran;i and since the terms of two of the members, Henry Alexander,
and David Scully, expired on June 25th of this year.
Vacanc,.ies created are for the architect, nurseryman, landscape
architect and environmentalist positions, therefore, at least one
replacement must be chosen from each of these categories (see
chapter 17, section 17-4 of the City Code). Two of the vacancies
will be for members -at -large and may be filled by persons qualify-..
ing for any of the above mentioned positions or by a lay person
recommended by a civic organization.
Attached are completed resume and personal information forms
and letters of recommendation which have been submitted by new ap-
plicants for these positions. Two of the remaining Board members,
Henry Alexander and David Scully are applying for reappointment.
The following chart shows the one remaining Board member (Sue

A RESOLUTION RESCINDING RESOLUTION NO. 82-183,
ADOPTED FEBRUARY 25, 1982, WHICH PROVIDED FOR
APPOINTMENT OF MEMBERS TO THE ENVIRONMENTAL
PRESERVATION REVIEW BOARD.
WHEREAS, the Environmental Preservation Review Board
was established by Ordinance No. 8301, dated May 23, 1974, to
review development plans in environmentally significant areas
of the City; and
WHEREAS, it has come to the attention of the City Com-
mission that certain vacant positions filled on the Environ-
mental Preservation Review Board were not accomplished strictly
pursuant to pertinent City Code Sections relative to Committee
Organization and Professional lists; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 82-183, dated, passed and
adopted on February 25, 1.982, relative to the appointment of
certain members to the Environmental Preservation Review Board,
is hereby rescinded.
