HomeMy WebLinkAboutO-09413Ahcndtaht No 14 to Ordinance No, 9821 ORDINANCE NO. 9418 AM EMERGENCY ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO, 5321 ADOPTED SEPTEMBER 24, 1981, THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1982, AS AMENDED BY IN- CREASING THE APPROPRIATIONS FOR THE GENERAL FUND PLANNING AND ZONING BOARD ADMINISTRATION DEPART- MENT IN THE AMOUNT OF $41,143 AND BY INCREASING THE REVENUE FOR THE GENERAL FUND IN A LIKE AMOUNT FROM CHARGES FOR SERVICES (PUBLIC HEARING FEES) ; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, WHEREAS, the City Commission adopted Ordinance No. 9321 on September 24, 1981, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 30, 1982; and WHEREAS, the Code Enforcement Board (CEB) was established on December 17, 1980 by Ordinance No. 9224; and WHEREAS, the rationale for the creation of said board was to provide a systematic method of enforcing the various licenses, zoning, signs and other related technical codes in force within the boundaries of the City of Miami; and WHEREAS, on February 11, 1982 the six (G) members of the Board required by the legislation were appointed R-82-709; and WHEREAS, the Department of Planning and Zoning Board Administration has been assigned the additional responsibility of the management and administra- tion of the Code Enforcement Program; and WHEREAS, funds in the amount of $41,143 are needed to hire two (2) cleri- cal positions in the Department of Planning and Zoning Board Administration's budget to support the additional workload associated with the establishment of a Code Enforcement Board for the City of Miami as well as related costs asso- ciated with same; and WHEREAS, funds in the amount of $41,143 are available from Charges for Services (Public Hearing Fees) and can be appropriated in the Department of Planning and Zoning Board Administration's budget to accomplish the above task; NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI FLORIDA: 5ectibh 1, 5ecti s 1 and 5 of Ordinanee Not 9821, adopted September No 1981, the ahhUal appropriations ordinance for the fiscal year, ending Septem- ber 30, 1982, as amended is hereby further amended in the following particu- 1arst I/ "Section 1. Funding in a like amount is available from Charges for Services (Public Hearing Fees). The Code Enforcement Board (CEB) was established on December 17, 1980 by Ordi- nance Plumber 9224. The rationale for the creation of this board was to provide a systematic method of enforcing the various occupational licenses, building, zoning, signs and other related technical codes in force within the boundaries of the City of Miami. During the City of Miami Commission meeting held on February 11, 1982 the six (6) members of the Board required by the legislation were appointed (R-82-709). The management and administration of the Code Enforcement Board's activities became the responsibility of the Planning and Zoning Board Administration De- partment since the functions that they were already presently performing con- cerning zoning matters for the City closely mirrored the activities of the newly created Code Enforcement Board. In fact, the two boards could work in close harmony with each other resulting in increased code compliance in all areas of the City. Due to the additional responsibilities the Director of the Planning and Zoning Board Administration Department requested authorization to add- clerical posi- tions. to his current staff to perform the additional activities associated with same (i.e. record -keeping for board members, preparation of agendas for public hearings, processing of code violations, etc.) and additional funding to pay for related costs. The Division of Operations Analysis studied the request and concluded that two (2) positions were _necessary to process the paperwork involved in code violation cases. They also calculated the cost ($41,143) to perform this additional task for the remainder of FY '82 (inclusive of the clerical support). The attached proposed Ordinance is prepared for the April 22, 1982 City Com- mission meeting. 9418
