ORDINANCE NO, 1 ,
AN ORDINANCE AMENDING ORDINANCE NO, 6871,
AS AMENDED, THE COMPREHENSIVE CLONING ORDI-
NANCE FOR THE CITY OF MIAMI, BY CHANCING
THE ZONING CLASSIFICATION OF TRACT 9,
TOWNPARK SUB 4 (87-52) URBAN RENEWAL PRO-
JECT FLORIDA R-10t BEING APPROXIMATELY
1434-1500 NORTHWEST THIRD AVENUE, PROM
R-4 (MEDIUM DENSITY MULTIPLE) TO GU (00-
VERNMENTAL USE) AND BY MAKING ALL THE
NECESSARY CHANGES IN THE ZONING DISTRICT
MAPS MADE A PART OF SAID ORDINANCE NO. 6871,
BY REFERENCE AND DESCRIPTION IN ARTICLE
III, SECTION 2, THEREOF, BY REPEALING ALL
ORDINANCES, CONTAINING A SEVERASILITY
CLAUSE.
WHEREAS, the Miami Planning Advisory Board at its meeting
of January 6, 1982, Item No. l(a), following an advertised
hearing adopted Resolution No. PAB 3-82 by a 5 to 0 vote Gone
member absent) RECOMMENDING APPROVAL of a change of zoning
classification as hereinafter set forth; and
WHEREAS, the City Commission has found that the herein
proposed zoning classification amendment is:
(a) COMPATIBLE WITH THE SURROUNDING NEIGHBORHOOD;
(b) NOT IN CONFLICT WITH PLANNING FOR THE AREA;
(C) READILY ACCESSIBLE;
(d) NOT ADVERSE IN IMPACT TO THE SURROUNDING
NEIGHBORHOOD;
(e) WILL BE COMPATIBLE WITH SCALE OF ADJACENT
PROPERTIES;
(£) WILL BE AETHESTICALLY DESIGNED AND
(g) PROV.IDES AN ESSENTIAL SERVICE TO THE COMMUNITY;
AND
WHEREAS, the City Commission after careful consideration
of this matter deems it advisable and in the best interest of
the general welfare of the City of Miami and its inhabitants
to grant this change of zoning classification as hereinafter
set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, as amended, the Compre-
hensive Zoning Ordinance for the City of Miami, is hereby
amended by changing the zoning classification of Tract 9,
T'OWAPARK 80B 4 ( 8"1-52 ) Urban Renewal Project Florida R-lot
being approximately 1435-1500 Northwest Third Avenue, frofii
R-4 (Medium Density Multiple to aU (Governmental Use)i and by
making all the necessary changes in the zoning district maps
made a part of said Ordinance No. 6811, by reference and
description in Article III, Section 21 thereof.
Section 2. That all Ordl-nances, Code Sections or parts
thereof in conflict herewith are hereby repealed insofar as
they are in conflict.
Section 3. Should any part or provision of this Ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the Ordinance as a
Whole.
