3. May the Applicant want to provide certain restrictions in uses, a voiuntarily proffered Covenant will be the
appropriate mechanism to make it formal. Staff will not consider the Covenant in it's recommendation, but the
boards will.

properties, and how this request will benefit the immediate neighbohood or the entire city

Please accept this correspondence as our letter of intent pursuant to City Code Section
62-8. The undersigned serves as special land use counsel to Brotherhood of Electrical Workers,
Inc., a Florida not for profit corporation (the "Applicant"). This request is submitted in accordance
with the requirements applicable to the City of Miami's Rezoning Cycle for the Spring of 2021.
The Applicant respectfully submits the attached application to amend the Future Land Use
Map of the Miami Comprehensive Neighborhood Plan (the "MCNP") for properties located at 1649
NW 16 Terrace, 1700 NW 15 Street Road, 1644 NW 16 Terrace and 1650 NW 16 Terrace (collectively
referred to hereinafter as the "Subject Properties"). The Subject Properties collectively comprise
approximately 0.91 acres or 39,687+ square feet in area. The Applicant is the fee owner of the Subject
Properties.
The Subject Properties comprise the local union hall and apprenticeship for the
International Brotherhood of Electrical Workers ("IBEW"), LocaI No. 349. The envisioned
redevelopment program, provided that the above -referenced application is approved, will include
a comprehensive improvement package that will substantially enhance the area with the
introduction of a mixed -use product comprised of a newly designed union hall, electrical
apprenticeship school, professional office space, convention space, structured parking and
affordable/senior living and workforce residential units.
As described in more particularity below, the Subject Properties are owned and operated
under a single form of ownership that has been the home to the IBEW since 1948, over seven
decades ago when the membership first constructed the union hall. The IBEW membership has
served as one of the primary components of the workforce within the City of Miami throughout
those years and has been a staple of the Allapattah community. As development trends continue
throughout the urban core and surrounding neighborhoods within the City of Miami, including
Allapattah, accessibility to moderately priced residential products are becoming scarce. And,
although the IBEW has no plans to leave the home that it first built within the community back in

1948, it continues to work with its membership to plan on ways to accommodate curren a"n
future needs. The adoption of the application will serve to accommodate the increasing need for
attainable housing for the union membership as well as to permit the expansion of the existing uses
of the Subject Properties with trade union/apprenticeship uses within the podium of future mid -
rise mixed -use building(s), a functionality that does not currently exist due to competing land use
designations and zoning classifications.
RE UESTED LAND USE AMENDMENT AND CONS ISTENCYANALYSIS
In addition to the Subject Properties, the Applicant is the fee owner of a larger assemblage
of contiguous lands that encompasses 1657 NW 17 Avenue, 1601 NW 17 Avenue, and 1667
NW 17 Avenue (collectively the Subject Properties and the additional contiguous properties that
comprise the assemblage are hereinafter referred to as the "Assemblage"). While located in the
Health District Regional Activity Center, where employment centers are encouraged, the MCNP
bifurcates the Assemblage into two separate, distinct and competing land use designations. The western
section of the Assemblage, those fronting along NW 17 Avenue, are designated Restricted Commercial
on the Future Land Use Map while the Subject Properties, all of which have been under a single form
of ownership for decades, are designated High Density Multifamily Residential. The Applicant is
proposing an amendment to the City's Future Land Use Map to create consistency among proximate
land uses by amending the designation assigned to the Subject Properties from High Density
Multifamily Residential to Restricted Commercial.
The requested amendments will create a uniform future land use pattern throughout the
Assemblage without increasing residential density, since both the High Density Multifamily
Residential and Restricted Commercial designations support redevelopment at a rate of 150 dwelling
units per acre. Instead, what the proposed land use amendment affords is the eligibility to seek a
uniform mixed -use development with general office and commercial activities comprising the podium
of mixed -use towers. Such uses are reflected and supportive of the existing development trends within
the area. The surrounding area is characterized by a mixture of Restricted Commercial, High Density
Multifamily and Major PUB, FAC land use designations. The Restricted Commercial designation
occupies the majority of the neighborhood including the entirety of NW 17 Avenue corridor, all areas
south of NW 14 Street to the Miami River and all areas situated east of NW 15 Street to the health
care district. The High -Density Multifamily designation currently occupies a block and a half in width,
bifurcating the Restricted Commercial designations existing on both NW 17 Avenue and NW 15
Avenue.
The Applicant's proposed land use amendments are consistent with the City's vision and
plans for the area. Pursuant to Article 7.1.2.8(c)(2)(g) of Miami 21, we provide general planning
principles and the goals and objectives of the City's Comprehensive Plan finding that the proposed
amendment and companion rezoning application covering the Assemblage are in conformity with
the MCNP, the established land use pattern for the adjacent properties, and in scale with the needs

of the neighborhood. At a minimum, the information below supports the Applicant's propos"a" a
one that is consistent with the Goals, Objectives and Policies of the MCNP.
Goal LU-1: Maintain a land use pattern that (1) protects and enhances the quality
of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted
or declining areas; (3) promotes and facilitates economic development and the growth of job
opportunities in the city; (4) fosters the growth and development of downtown as a regional
center of domestic and international commerce, culture and entertainment; (5) promotes the
efficient use of land and minimizes land use conflicts while protecting and preserving
residential sections within neighborhoods; (6) protects and conserves the city's significant
natural and coastal resources; and (7) protects the integrity and quality of the City's existing
neighborhoods by insuring public notice, input and appellant rights regarding changes in
existing zoning and land use regulations.
Policy LU-1.1.7: Land development regulations and policies will allow for
the development and redevelopment of well -designed mixed -use neighborhoods that provide
for the full range of residential, office, live/work spaces, neighborhood retail, and
community facilities in a walkable area and that are amenable to a variety of transportation
modes, including pedestrianism, bicycles, automobiles, and mass transit.
Policy LU-1.1.11: The City hereby adopts designation of the City, excluding
Virginia Key, Watson Island and the uninhabited islands of Biscayne Bay, that have a land use
and zoning classification of Conservation, as an Urban Infill Area pursuant to Miami -Dade
County's designation of an Urban Infill Area lying generally east of the Palmetto Expressway and
including all of the City of Miami. Within this area, the concentration and intensification of
development around centers of activity shall be emphasized with the goals of enhancing the
livability of residential neighborhoods and the viability of commercial areas. Priority will be given
to infill development on vacant parcels, adaptive reuse of underutilized land and structures, the
redevelopment of substandard sites, downtown revitalization and the development of projects that
promote public transportation. Maintenance of transportation levels of service within this
designated Urban Infill Transportation Concurreney Exception Area shall be in accordance with
the adopted Transportation Corridors level of service standards and the City of Miami Person Trip
Methodology as set forth in Policies TR-1. 1.2 and 1.1.3 of the Transportation Element of the
MCNP.
Objective LU-1.2: Promote, facilitate, and catalyze the redevelopment and revitalization of
blighted, declining or threatened residential, commercial and industrial areas through a variety of
public, private, and public -private redevelopment initiatives and revitalization programs including,
where appropriate, historic designations.

Policy LU-1.2.1: The City defines blighted neighborhoods as areas characterize-7 y
the prevalence of older structures with major deficiencies and deterioration, high residential vacancies,
widespread abandonment of property, litter and poor maintenance of real property. Declining
neighborhoods are defined as areas characterized by the prevalence of structures having minor
deficiencies, a general need for improvements in real property, significant declines in real property
values, high vacancy rates in commercial structures and increasing difficulty in obtaining insurance.
Neighborhoods threatened with decline are defined as areas characterized by significant but infrequent
property maintenance neglect, an aging housing stock, declining property values, general exodus of
traditional residents and influx of lower income households.

Objective LU-1.3: The City will continue to encourage commercial, office and industrial

Policy HO-11.7: The City will continue to control, through restrictions in the

development which may negatively impact any residential neighborhood and will provide
appropriate transitions between high-rise and low-rise residential developments.

The surrounding area is characterized by a mixture of T6-12-0, T6-8-0 and T6-8-R
zoning classifications. The T6-12-0 classification is located along NW 15 Street Road, a mass
transit corridor connecting to the Assemblage, and south of NW 14 Street. The modification
of the zoning classification assigned to the Subject Properties, in addition to making a uniform
regulatory platform, is to create the eligibility of building height necessary to accommodate
the proposed mixed -use buildings with a newly designed union hall, electrical apprenticeship
school, professional office space, convention space, structured parking and (most
importantly) to create the eligibility to provide the maximum number of affordable/senior
living and workforce residential units to the union membership. The building heights
permitted with the T6-1 2-0 classification, which already exist within a two -block radius, are
compatible to both the abutting T6-8 zoning classifications and the High Density Multifamily
Residential Land Use designations.
The development trend within the area is emerging as a mid -rise community.
Immediately to the south of the Subject Properties at 1569 NW 17 Avenue, TCG Allapattah
17, LLC has recently topped -off on a new development comprising twelve (12) stories in
height. Although not as recent, Somerset Towers was developed within the neighborhood,
less than two -blocks from the Assemblage, with a building height of fifteen (15) stories. Just
south of that site is another mid -rise tower, constructed Iess than 10 years ago, with a building
height of twenty (20) floors. Just a little further to the south is River Landing, a mixed -use

complex that will serve as an anchor to the existing and emerging communities
within t e
area.
The envisioned comprehensive improvement package comprised of a newly designed
union hall, electrical apprenticeship school, professional office space, convention space,
structured parking and affordable/senior living and workforce residential units cannot be
accommodated under the properties current zoning classification. First, the T6-8-R classification
prohibits the development of nearly all of these uses. Second, the current height limitation
prohibits the incorporation of structured parking with the volume of uses needed both to
accommodate the union membership and to render the development program financially feasible.

2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property
owners up to a mile from the subject property and I am responsible for paying the additional radius mailing
costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan
revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The
only fees that will be refunded after the submission and acceptance of an application for public hearing has
occurred will be the surcharge fees related to appeals, as expressiy listed in Chapter 62 of the City Code
(Code).
3. Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline
set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any
requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its
consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that
any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a
$1,000.00 fee, per instance, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has

Welcome to the City of Miami! This package is intended to provide you with all open
Code Enforcement violations and liens attached to the subject property, or properties,
as of the current date and time the following report was created. Closed violations and
future violations are not included.
A violation may become a lien when the property owner does not timely remedy the
violation. This report may include two types of liens: Certified liens and non -certified
liens. Certified liens have a set amount to be paid. Conversely, most non -certified liens
continue to accrue interest or a per diem fine; therefore, those liens must be satisfied
with the City as quickly as possible.
All outstanding violations and liens must be satisfactorily resolved before the City can
issue a Certificate of Use (CU); however, the City inspects all properties prior to the
issuance of a CU and those inspections may yield additional items, which must be
addressed by the owner at the property prior to issuance of a CU.
This search does not include encumbrances, other liens, restrictions or the like,
recorded in the Public Records of Miami -Dade County, Florida. Please contact
Miami -Dade County for the aforementioned items.
