ASSOCIATION DOES HEREBY AGREE THAT PRIOR TO COMPLETION OF THE PROJECT TO SUBMIT AND TO COMPLY WITH THE REQUIREMENTS OF EPRB AT SUCH TIME AS THE BOARD IS RECONVENED; FURTHER PROVIDING THAT NO TREES ARE TO BE REMOVED DURING ]'HE CONSTRUCTION PERIOD WITHOUT THE EXPRESS APPROVAL OF THE DIRECTOR OF PLANNING AND/OR THE ENVIRONMENTAL PRESERVATION BOARD; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE AND DISPENSING WITH THE REQUIREMENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE MEMBERS OF THE CITY COMMISSION. WHEREAS, the City of Miami Environmental Preservation Review Board (EPRB) is presently not operating until the City Commission appoints net, members; and WHEREAS, applications are pending, awaiting the EPKB'S review and determination; and WHEREAS, the City Commission wishes to facilitate con- struction during this period for applicants delayed by the EPRB; EOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA, Section 1. The Building Department is hereby authorized to issue the necessary building permit to the Brickellbanc Savings and Loan Association, provided that the plans and speci- fications meet with all existing requirements except for the approval by the Environmental Preservation Review Board [(EPRB) (presently not sitting)]; further providing that the Association does hereby agree that prior to completion of the project to submit and to comply with the requirements of EPRB at such time as the board is reconvened; further providing that no trees are to be removed during the construction period without the express approval of the Director of Planning and/or the Environmental Review Board, Section 2. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the Commission.
