$155,500; INCREASING; ANTICIPATED REVENUES IN THE
SAME AIMOUNT TO BE' APPROPRIATED INTO THE HEAVY E-
QUIPTiENT MAINTENANCE DIVTS1ON TO PROVIDE ADDI-
TIONAL FUNDS FOR THE PURCHASE OF HEAVY EOUIPTIENT
REPLACEMrNT UNITS; CONTAINING A REIPEALER PROVI-
SION AND A SEVERABILITY CLAUSE,.
WHEREAS, the Cite Commission adopted Ordinance No. 9321 on September
24, 1981, establishing revenues and appropriations for the City of Miami., Florida,
for the fiscal year ending September 30, 1982; and
WHEREAS, the Department of Building and Vehicle Maintenance estimates
that a total. of $1,965,11.4 wi.l.l be required from the Heavy Equipment Maintenance
Division to fund Heavy Equipment Maintenance replacement; and
WHEREAS, $1,809,614 is currently available in the Heave Equipment
Maintenance Division budget for the aforementioned purpose; and
WHEREAS, an additional. $155,500 is needed to meet the total require-
ment of $1,965,114 for Heavy Equipment replacement and is available from the
Heavy Equipment Maintenance Division, FY '81 Retained Earnings;
NOtd, 'THEREFORE, BE IT ORDAINED BY THE C01`ir1ISSION OF TH17 CITY OF
MIAMI, FLORIDA:
Section 1. Sections 2 and 5 of Ordinance No. 9321, adopted September
24, 1981, the Annual Appropriations Ordinance for the fiscal year, ending September
30, 1982, are hereby amended in the following particulars:

Section 5. The above appropriations are made
based on the foll.owi_ng sources of revenues for
the 1.980-81 fiscal. year:

Section 2. An amount of $155,500 from the Building and Vehicle
Maintenance Department, Heavy Equipment Maintenance Division, FY '81 Retain-
ed Earnings is hereby appropriated into the Heavy Equipment maintenance Divi-
sion for the purpose of funding the purchase of Heavy Equipment replacement
units.
Section 3. All ordinances or parts of ordinances insofar as they
— are inconsistent or in conflict with the provisions of this ordinance are
hereby repealed.
Section 4. If anv section, hart of section, paragraph, clause,
phrase, or word of this ordinance is declared invalid, the remaining provi-
sions of this ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency
measure on the grounds of urgent public need for the preservation of peace,
health, safety, and property of the City of Miami, and upon the further ground
of the necessity to make the required and necessary payments to its employees
and officers, payment of its contracts, payment of interest and principal on
= its debts, necessary and required purchases of goods and supplies, and to
g0nerally carry on the functions and duties of its municipal affairs.
Section 6. The requirement of reading this ordinance on two sepa-
rate days is Hereby dispensed with by a vote of not less than four -fifths of
the members of the Commission,

It- is recommended that an appropriation of $155,500
be made for the Heavy Equipment Maintenance Division
of Building and Vehicle Maintenance from the Heavy
Equipment Maintenance Division, FY '81 Retained Earn-
ings, to supplement the funding for Heavy Equipment
unit replacement.
It is estimated by the Department of Building and Vehicle Maintenance that a'
_ total of $1,965,114 will be required to fund the aforementioned heavy Equip-
ment Maintenance units replacement. Inasmuch as an amount of $1,809,614 has
been budgeted for the Heavy Equipment Maintenance Division, an additional
$155,500 is needed to meet the total requirement. This amount is available
from the Heavy Equipment Maintenance Division, FY '81 Retained Earnings, and
can be appropriated for the above mentioned purpose.
The attached proposed ordinance has been prepared as an emergency for the
- May 11, 1982 City Commission meeting in order to expedite the replacement of
Heavy Equipmentunits.
