AN EMERGENCY ORDINANCE AMENDING SECTIONS 2 AND 5
OF ORDINANCE NO, 9321, ADOPTED SGPTEiBER 24, 1981,
THE ANNUAL APPROPRIATIONS ORDINANCE FOR THE FISCAL
YEAR ENDING SEPTEMBER 30, 1982; by APPROPRIATING
FROM THE BUILDING AND VEHICLE MAINTENANCE DEPART=
MENT, HEAVY EQUIPMENT MAINTENANCE DIVISION, FY '81
RETAINED EARNINGS, AN AMOUNT OF $312,000, IN-
CREASING ANTICIPATED REVENUES IN THE SAME AMOUNT
TO BE APPROPRIATED INTO THE HEAVY EQUIPMENT MAINT-
ENANCE DIVISION FOR A DISTINCT AND SEPARATE PRO-
GRAM CALLED "RUBBISH CRANE REBUILDING PROGRAM"
TO PROVIDE FUNDING FOR THE COSTS OF LABOR AND PARTS
FOR THE PURPOSE OF REBUILDING FOURTEEN (14) CRANES
IN A ONE-YEAR PERIOD; CONTAINING A REPEALER PRO-
VISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 9321 on September 24 ,1982,
establishing revenues and appropriations for the City of Miami, Florida, for the
fiscal year ending September 30, 1982; and
WHEREAS, the Department of Building and Vehicle Maintenance, Heavy Equipment
Maintenance Division would accelerate its Rubbish Crane Rebuilding Program for the
purpose of rebuilding fourteen (14) cranes in a one-year period; and
WHEREAS, this program would require the hiring of three Heavy Equipment Mecha-
nics, three Heavy Equipment Mechanic Helpers, and one Welder on a one year temporary
basis, for an estimated cost of $130,000; and
WHEREAS, an estimated amount of $182,000 would be required for parts to rebuild
the cranes; and
WHEREAS, the total cost of $312,000 needed -for labor and parts is available from
the Heavy Equipment Maintenance Division, FY '81 Retained Earnings;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Sections 2`and 5 of Ordinance No. 9321, adopted September 24, 1981,
The Annual Appropriations Ordinance for the fiscal year ending September 30, 1982
are hereby amended in the following particulars: 1/

Section 5. The above appropriations are made
based on the following sources of revenues for the
1981.-82 fiscal year:

Section 2. An amount of $312,000 from the Building and Vehicle Maintenance
Department, Heavy Equipment Maintenance Division, FY '81 Retained Earnings is hereby
appropriated into the Heavy Equipment Maintenance Division, Rubbish Crane Rebuilding
Prcgram, for the purpose of funding the costs of labor and parts to rebuild fourteen
(14) cranes in a one-year period.

Section 3. All ordinances or parts of ordinances insofar as they are inconsis-
tent or in conflict with the provisions of this ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase, or word
of this ordinance is declared invalid, the remaining provisions of this ordinance
shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency measure on the
grounds of urgent public need for the preservation of peace, health, safety, and
property of the City of Miami, and upon the further ground of the necessity to make

the required and necessary payments to its employees and officers, payment of its
contracts, payment of interest and principal on its debts, necessary and required pur-
chases of goods and supplies, and to generally carry} on the functions and duties of

Section 6, The requirement of reading this ordinance on two
separate days is Hereby dispensed with by a vot of not less than four -fifths
of the members of the Commission.

Heavy Equipment Maintenance Retained
Earnings for Heavy Equipment Mainte-
nance Rubbish Crane Rebuilding pro-
gram,
It is recommended that an appropriation of $312,000
be made for the Heavy Equipment Maintenance Division
of Building and Vehicle Maintenance from the Heavy
Equipment Maintenance Division, FY '81 Retained Earn- _
ings, to supplement the funding for Heavy Equipment
Maintenance Rubbish Crane Rebuilding program.
It is estimated by the Department of Building and Vehicle Maintenance that a total of $312,000 will be required to fund the cost bf Labor
and Parts for the purpose of rebuilding fourteen (14) cranes in one
year. This amount is available from the Heavy Equipment Maintenance _ -
Division, FY '81 Retained Earnings, and can be appropriated for the
above mentioned purpose.
The attached proposed ordinance has been prepared as an emergency for -_
the May 11, 1982 City Commission meeting in order to expedite the
Rubbish Crane Rebuilding program. _
