A RESOLUTION ACCEPTING THE BID OF AVIS RENT -A -CAR, INC.
FOR FURNISHING APPROXIMATELY 25 RENTAL AUTOMOBILES FOR
THE DEPARTMENT OF POLICE ON A CONTRACT BASIS FOR ONE
YEAR; AT A TOTAL ESTIMATED COST OF $127,500.00; ALLOCAT-
ING FUNDS THEREFOR FROM THE 1981-82 OPERATING BUDGET OF
THAT DEPARTMENT; AUTHORIZING THE CITY MANAGER AND THE PUR-
CHASING AGENT TO ISSUE THE PURCHASE ORDER FOR THIS SERVICE.
WHEREAS, pursuant to public notice, sealed bids were received
January 20, 1982 for the furnishing of approximately 25 rental auto-
mobiles for the Department of Police on a contract basis for one
year, and
WHEREAS, invitations were mailed to 21 potential suppliers
ans 3 bids were received; and
WHEREAS, funds for this purchase are available in the 1981-82
Operating Budget; and
WHEREAS, this will be used by the Department of Police for
the purpose of undercover investigations; and
WHEREAS, the City Manager and the Department of Police recom-
mend that the bid received from Avis Rent-A-Car, Inc. be accepted as
the most advantageous bid to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The January 20, 1982 bid of Avis Rent-A-Car, Inc.
for furnishing approximately 25 rental automobiles for the Depart-
ment of Police on a contract basis for one year at a total estimated
cost of $127,500.00 is hereby accepted with funds therefor hereby
allocated from the 1981-82 Operating Budget of that department.
Section 2. That the City Manager is hereby authorized to
instruct the Purchasing Agent to issue the Purchase Order for this
service.

Purchasing Agent
It is recommended that the award be made and a
resolution be passed accepting the most advan-
tageous bid as received from Avis Rent-A-Car. Inc.
for furnishing rental of automobiles on a contract
basis for one year at a total estimated cost of

Pursuant to public notice, sealed bids were received January 20, 1982
for furnishing rental of approximately 25 automobiles to the Depart-.
ment of Police, on a contract basis for one year.
Invitations were mailed to 21 potential suppliers and 3 bids were re-
ceived as listed on the attached Award of Bid. 2 "No -Bids" were also
received.
Funds for this purchase are available in the 1981-82 Operating Budget.
The rental of automobiles which can be exchanged frequently by the
Department of Police is necessary for use in undercover investigations
of narcotics, gambling, pornography, vice, organized crime, terrorist,
police corruption, and integrity cases.
The automobiles are used by the Special Investigations Section, the
V.I.N. Detail, and the Internal Security Unit.
The Department of Police concurs with this recommendation.

Confiscated Vehicles
Pursuant to Commissioner Carollo's inquiries, I am providing you with a copy of a
report that was prepared in reference to confiscated vehicles. Additionally, the
last page of the report contains a summary listing the vehicles confiscated since
October 1980 and where they are currently assigned.
Since October 1980, nineteen vehicles have been confiscated. Two were returned
to the insurance company after they were legally seized. Six vehicles are presently
being utilized by the Police Department with four additional vehicles being
assigned to the Miami Police Department pending final paperwork, for a total of
ten. Of the remaining seven vehicles, one has a questioned title, one will be
assigned to Public Works, one is assigned to Labor Relations, and four vehicles have
been unrequested.
Problems stemming from the utilization of confiscated cars by the Police
Department are many. Confiscations require a lengthy forfeiture process
(minimum of 120 days), very few late model cars are not claimed by the owners
leaving a poor quality of vehicle to confiscate, and the few remaining serviceable
vehicles left could be sold at auction realizing a profit of several thousand dollars
to the City.
Among the advantages of rental cars are:
(1) They avoid the lengthy forfeiture process.
(2) Convenient availability of replacement vehicles.
(3) Rentals blend into the community.
(4) Downtime for repairs are kept at a minimum.
In the interest of officer safety and the ability to be more effective, the advantage
of using rental vehicles exceed those negatives created by confiscations.

The ability of the Miami Police Department to seize vehicles is authorized
by Article III Sec. 42-40 of the City Code which states:
"The police department is hereby authorized
and directed to seize and reduce to the
possession of the police department any
lost, captured, abandoned, stolen, or
wrecked property, including vehicles,
which may be found upon any of the public
streets and highways of the City and to
store such property as provided in sections
42-21 and 35-31 et seq.
Sec, 42-41 Storage.'
The City: shall keep and maintain a storage
warehouse where the property seized under
the provisions of this article shall be
stored and kept for a period of at least
forty-five (45) days from the date of such
seizure. Code 1967, 43-21.
Sec. 42-42, Notice.to owner; redemption
During the period of forty-five (45) days
provided in section 42-41, the police
department shall make every effort to
notify the owner of any such property that
the same is being retained under the pro-
visions of this article, and shall, through-
out such period of forty-five (45) days,
permit the owner to regain possession thereof
upon proof of ownership. (Bode 1967, 43-22)
Sec. 42-43. Lein for storage and keeping.
The costs and charges for storage and keeping
of all property seized pursuant to this
article shall constitute a lien against such
property. (Code 1967, 43-23)

After the expiration of the period of forty-five
(45) days provided in section 42-410 the City
Manager is authorized to dispose of or sell any
such property, including vehicles not claimed
or reduced to possession by the owner thereof,
at public sale, after advertising in a news-
paper of general circulation in the City at
least one (1) time ten (10) days prior to such
sale. Such publication may be made before
termination of such 45-day period, for a sale
thereafter, (Code 1967, 43-24; Ord. No. 8766
1, 2-23-78).
Florida Statute Ch. 713-78 addresses the issues of liens, towing, storage,
and the public auction of seized vehicles. The City Code and the State
Statute are similar in procedure.
The following steps chronologically outlines the steps involved in the
confiscation procedure once a vehicle is impounded.
1) The Property Unit inspects all claim checks daily noting
make, license tag and YIN number, They run a computer
i check and notify ill owners by mail of the location
of their vehicle.
2) Every three days the confiscation officers (Officer
Davis and Sgt. English) prepare vehicle information
cards and send them to the DMV from the State which
the tag is issued using a form letter (both attached).
3) At this point check to determine if vehicles have
been claimed. If not claimed determine first avail-
able auction date after 45 days of impoundment.
4) Auction procedures are now instituted. Owners and
lienholders are sent notice that their vehicles will
be put up for auction on the next auction day (approxi-
mately 3 weeks later). State law mandates that owner or
lienholder must be notified at least 15 days in advance
of the auction. (All notices made by certified mail).
5) At the time notices are sent to owners and lienholders
of the upcoming auction a manifest is prepared listing
all the vehicles to be sold. This manifest is forwarded,
to Art Mullins in purchasing for advertising in the
newspaper at least once ten days prior to the sale. This
procedure satisfies Article III, Sec. 42-44 of the City Code
and F.S. 713.78. Note; Owners and lienholders have until
the actual auction to claim their vehicles.

The selected vehicles are then
pulled off the auction line and held until the auction
has been completed.
7) Once the vehicles for confiscation are selected and
the auction is over, legal proceedings to take title
to the vehicle begins.
8) Building and Vehicle Maintenance prepares forms (attached)
requesting release of vehicles for City use. At this
time the form is initiated by Ed Cox and sent to Art
Mullins who forwards to Chief Harms, The Police Chief

Normally the Property Unit has a'vehicle in the pound for eighty to 90
days before it is placed up for auction. A minimum of 120 days from
the date of impoundment to conversion for City use.
Problems associated with - Confiscations:
1) After the date of the auction and confiscation procedures
implemented, owners have on occassion demanded return of
their property and we have returned it. For various reasons
owners had not been contacted; i.e. out of the country,

insurance company had not been, and they later laid claim
to the vehicle. Historically we have returned them.
3) Most owners do not claim vehicles because the cars are in
such poor condition that they are of no use to us or the
owners.
4) Motor Pool does not have a supply of parts and equipment
to properly maintain different makes of vehicles thus
accumulating additional down time..

Mullins who forwards to Chief Harms, The Police Chief

Normally the Property Unit has a vehicle in the pound for eighty to 90
days before it is placed up for auction. A minimum of 120 days from
the date of impoundment to conversion for City use.
Problems associated with. -Confiscations:

1) After the date of the auction and confiscation procedures
implemented, owners have on occassion demanded return of
their property and we have returned it, For various reasons
owners had not been contacted; i.e. out of the country,
2) Although owners and lienholders have been notified the
insurance company had not been, and they later laid claim
to the vehicle. Historically we have returned them,
3) Most owners do not claim vehicles because the cars are in
such poor condition that they are of no use to us or the
owners,
4) Motor Pool does not have a supply of parts and equipment
to properly maintain different makes of vehicles thus,
accumulating additional down time..

Since October 1980 nineteen vehicles have been confiscated. rNo were returned
to the Insurance Company after they were legally seized. Six vehicles are
presently being utilized by the police department with far additional vehicles
being assigned to MPD pending final paperwork for a total of ten. Of the
remaining seven vehicles cne has a questioned title, one will be assigned to
P ublic Works, one is assigned to Labor Relaticns, and four vehicles have been
unreauested.

(2) Confiscation Procedures
1) Vehicle impounded - Property Unit picks up claim checks - computer
tag check - owners notified by mail.
2) Vehicle cards sent to Tallahassee on all vehicles requesting owner
information,
3) If vehicles are not calimed within,45 days, auction procedures are
instituted.
4) Owners are again sent notice by mail advising of upcoming auction.
5) State Law mandates that owners/lienholders be notified at least
15 days prior to auction. (Notices made by certified mail).
6) Manifest is prepared lisitng vehicles to be sold. Manifest sent to
purchasing for legal advertising with copy to B1dg,bVeh. Maintenance.
7) Representative from Bldg, b Veh, manitenance determines which vehicle
to be set aside for confiscation.
