S2-387 A RESOLUTION CONCERNING THE SIXTH ANNUAL BAHAMAS GOOMBAY FESTIVAL, WHICH IS TO BE HELD JUNE 5 AND 6, 1982, CLOSING CERTAIN STREETS TO THROUGH TRAFFIC ON THOSE DATES DURING SPECIFIED HOURS AND ESTABLISHING A PEDESTRIAN MALL; SAID STREET CLOSINGS SUB- JECT TO ISSUANCE OF PERMITS BY THE POLICE AND FIRE DEPARTMENTS; AND PROVIDING A GRANT OF CASH ASSISTANCE IN THE AMOUNT OF $33,000 TO "MIAMI/BAHAMAS GOOMBAY FESTIVAL IN COCONUT GROVE, INC."; SAID FUNDS TO BE ALLOCATED FROM SPECIAL PROGRAMS AND ACCOUNTS, QUALITY OF LIFE -CONTINGENCY FUND; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY SUPPORT AGREEMENT SETTI14G FORTH THE CONDITIONS UNDER WHICH THE CITY WILL PROVIDE THE CASH ASSISTANCE GRANT; AND ESTABLISHING THE AREA PROHIBITED TO RETAIL PEDDLERS DURING THE FESTIVAL PERIOD. WHEREAS. the Miami/Bahamas Goombay Festival in Coconut Grove, Inc. has requested assistance in connection with the Sixth Annual Goombay Festival; and WHEREAS, the City Commission, by Motion No. 79-257, recog- nized the Miami/Bahamas Goombay Festival in Coconut Grove, Inc. as the official organization to sponsor and organize the annual Goombay Festival in Coconut Grove; and WHEREAS, the Miami City Commission has supported this effort in 1977, 1978, 1979, 1980 and 1981; and WHEREAS, the Miami City Commission has established a policy by Resolution No. 81-189 to deal with requests to provide assist- ance to festivals, cultural and sporting events; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. In order to establish a temporary pedestrian mall, the following streets are hereby closed to through traffic on June 5 and 6, 1982, during the following hours, such closing streets being subject to the issuance of permits by the Police and Fire Departments: CITY COMMISSION ' MEETING OF MAY 1 11982 ma'E..�. Grand Avenue - from McDonald Street to Matilda Street Commodore Plaza - from Main Highway to Franklin Avenue Fuller Street - from Main Highway to Grand Avenue These streets are to be closed from 9:00 A.M. to 9:00 P.M. on June 5 and 6, 1982. Section 2. The sum of $33,000* is hereby allocated from Special Programs and Accounts, Quality of Life -Contingency Fund as a grant of cash assistance to Miami/Bahamas Goombay Festival in Coconut Grove, Inc., subject to the requirements of City Commission Policy No. 100-4, Resolution No. 81-189, and subject to the provisions of any agreement required by that Policy. Section 3. The City Manager is hereby authorized to execute a support agreement setting forth the conditions under which the City will provide total cash assistance not to exceed $43,000. Section 4. Pursuant to the provisions of Ordinance No. 8851, enacted September 28, 1978, all retail peddlers' occupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be valid in the following designated area between the hours of 9:00 A.M. and 9:00 P.M. on June 5 and 6, 1982: Grand Avenue - From McDonald Street to Matilda Street Commodore Plaza - from Main Highway to Franklin Avenue Fuller Street - From Main Highway to Grand Avenue. S Vending in(orm�t3n4 4�16�3371 (after 5pm 445-5991) Proposal for additional financial assistance for the 6th Annual Miami -Bahamas Goombay Festival in Coconut Grove, June 4-69 1982. Rationale for Request of Additional Financial Assistance The City of Miami Police Department has indicated that it would cost approximately $259000.00 for services to be rendered during the festival. Our anticipated income from various sources will not be adequate to cover the expenses indicated by the police department. Secondly, the Department of Solid Waste estimated that it would cost approximately 060000.00 to clean the streets after the festival. Again, the anticipated income would not be adequate to meet these financial obligations. Thirdly, during the 5th Annual Festival, the City of Miami assumed these responsibilities through in -kind services. However, we were informed that these services will not be available for the 6th Annual Festival; therefore, it is essential that additional financial assistance be obtained for making the Festival a success. Recommended Proposal In order to assist with meeting the various financial obligations, the following suggeations are being proposed: 1. According to the City of Miami Ordinance #9236, each vendor will be required to obtain an occupational license for the Festival. It is anticipated that approximately 300 vendors will fulfill this obligation at $30.00 each for an estimated amount of $9,000.00. This money will be submitted prior to the beginning of the Festival. It is recommended that the money collected from the occupa- tional licenses be used to defray the expenses of cleaning the streets after the Festival and a portion of this money be used to :defray some of the anticipated police security expense. 82-387 2. Give wa r of rental fees for theote of the Coconut Grove Exhibition G,,nter on Thursday, June 3, 1982. The Centel will be used for the opening ceremony and a dance in conjunction with the event as a fund raising activity. Money from this event will be used to defray the expense of the Opening Ceremony for the Goombay Festival, 3. Give waiver of the rental fees for the use of the two snowmobiles during the Festival. 4. Remove the present stipulation from the $10,000.00 allocated for talent during the Festival and give the option of using 50% to defray other anticipated expenses if needed. If this proposal cannot be accepted, we are requesting an additional amount -of 031,000.00 ($25,000.00 for police security and $6,000.-00 for street cleaning) for the Goombay Festival. Box WITNESSETH (hereinafter referred WHEREAS, the City of Miami desires to enhance and to promote the quality of cultural life in the City of Miami; and WHEREAS, the City Commission via Resolution No. 81=1040 voted to provide funding for community -run festivals from the Fiscal Year 1981-82 Quality of Life Account -City Wide Events and Community Festival; and WHEREAS, proposals for said community -run festivals were received and processed for the allocation of funds; and WHEREAS, Resolution No. 81-421 requires the execution of an Agree- ment embodying the terms of the grant and stipulating the conditions under which the award is to be made; NOVI, THEREFORE, in consideration of the mutual covenants and con- ditions hereing contained, it is agreed by the parties hereto as follows: THE GRANTEE AGREES: 1. To conduct the following festival on the following dates: Miami/Bahamas Goombay Festival in Coconut Grove, June 4 - 6, 1982 2. To match one dollar to every dollar received from the CITY and to furnish to the CITY a complete financial statement of this festival showing all receipts, expenditures and disposition of profits (if any). `j 3. To provide the CITY a copy of the GRANTEE'S accounts, audited for the current fiscal year,as per City Commission Policy 100-4. 4. To hold said festival before September 30, 1982. 5. To earmark 60 percent of the total allocated City funds for local talent fees. 6. That all police, fire, publicity, showmobiles, city and park facilities, clean-up costs and insurance shall no longer be 82-887 allocated as in -kind services by the CITY, but must be defrayed from the GRA,ITEE'S total allocation to their budget. 7. That the GRANTEE shall comply with Equal Opportunity } t Employment laws as set forth by Pederal,State and Local governments. 8. That the CITY reserves the right to monitor any and all festival activities and that any breach of agreements made with the CITY shall be reported by the Department of Leisure Services, Cultural Division, to the City Manager for appropriate action under the circumstances. CITY reserves the right to terminate this Agreement at any time and for any cause upon notice of termination to the GRANTEE. 9. That the GRANTEE is solely liable and responsible for damages which might arise out of the acts or omissions of the GRANTEE, its officers, employees, agents or persons under its direction and control and to the City of Miami, its agents, servants, employees and officers who may be named in a suit which arises out of the acts or omissions of the GRANTEE, its officers, employees, agents or persons under its direction or control, the GRANTEE shall indemnify, defend and forever hold the CITY, its agents, servants, 1 employees and officers harmless from and against any and j all damages, penalties, fines or judgments. THE CITY AGREES: 1. To grant the amount of Ten thousand dollars and no cents " ($10,000.00) for this festival. 7 BOTH PARTIES AGREE: 1. Howard, Director REFFREv17E3 Department of Recreation ENCLOSURLS Proposed Resolution Attached for your review please find proposed legislation granting the 1982 Miami/Bahamas Goombay Festival in Coco- nut Grove an additional $33,000 from the Special Programs and Account Quality of Life Contingency Fund. Prior to this proposed resolution, Miami/Bahamas Goombay Festival in Coconut Grove was granted the amount of $10,000 via Resolution 81-1040, passed and adopted on December 10, 1981. After consultation with the Police and Solid Waste Depart- ments, and evaluating the prestigious impact this festival will have on the community and the entire City, it is recom- mended that additional funds be provided to ensure the suc- cess of the Festival. Department of Recreation It is recommended that the City Commission adopt a resolution concerning the Sixth An- nual Bahamas Goombay Festival, which is to be held June 4, 5 and 6, 1982, closing cer- tain streets to through traffic on those dates during specified hours and establishing a pedestrian mall; said street closings sub- ject to issuance of permits by the Police and Fire Departments; and providing a grant of cash assistance in the amount of $33,000. to "Miami/Bahamas Goombay Festival in Co- conut Grove, Inc."; said funds to be allo- cated from Special Programs and Accounts, Quality of Life -Contingency Fund; further authorizing the City Manager to execute the necessary support agreement setting forth the conditions under which the City will provide the cash assistance grant; and establishing the area prohibited to retail peddlers during the festival period, as per attached resolution. PURPOSE The purpose of this resolution is to provide the necessary financial support for the success of the Sixth Annual Goom- bay Festival in Coconut Grove, to be held June 4, 5 and 6, 1982, and to provide for the closing of certain street to through traffic on those dates and establishing a pedestrian mall. CAUSE/EFFECT This resolution provides for the timely coordination of the Miami/Bahamas Goombay Festival in Coconut Grove, an esta- blished traditional festival.
