The property is not designated a historical site. The current and proposed T6 designation provides for the highest density and greatest variety of use within the designated Urban Core Zone. Under its current zoning, the site could be developed with a maximum of 282 units (density is 500 du/acre in the Omni Residential Density Increase Area) and a building of up to twenty-four (24) stories, by right and up to forty-eight (48) stories through the use of public benefit bonuses. The intent of the request to rezone from T6- 24A-0 to T6-2413-0 is to allow for the additional floor lot ratio allocated under the T6-2413-0 category. The rezoning of this property will permit the development of the Property with residential units within walkable distance to nearby metromover stations including the School Board Metromover Station and the Adrienne Arsht Metromover Station, which all connect to the nearby Historic Overtown Metrorail Station and Brightline station. The Property is also within walking distance to nearby commercial facilities as well as the Adrienne Arsht Center/Knight Concert Hall and the Ziff Ballet Opera House. Properties to the west of the proposed development especially along North Miami Avenue, which is a main thoroughfare, are currently zoned T6-24B- 0. Given the Property's similar location along NE 2nd Avenue, which also serves as a main thoroughfare, the Property is appropriately suited to be redesignated to T6-2413-0 similar to its neighboring parcels immediately to the west. Specifically, it promotes Policy LU- 1.1.10, TR-2.1.3, and HO-1.1.9 to encourage high -density residential development and redevelopment in close proximity to Metrorail and Metromover station. Additionally, this requests promotes Policy LU-1.3.15 in that it encourages a development pattern that enhances existing neighborhoods by developing a balanced mix of uses including areas for employment, shopping, housing, and recreation in close proximity to each other. Please see below for further analysis. ( ri teri n I Section 7.1.2.80 (1) (b): The need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary. Criteria 3 Support: The Application requests a rezoning from T6-24A-0 to T6-24B-0, a transect that is consistent with the development trend in the immediate vicinity and the surrounding uses. The intent of the request to rezone from T6-24A-0 to T6-24B-0 is to allow for the additional floor lot ratio allocated under the T6-24B-0 category. Today, the Property remains underutilized. The intent of the request to rezone from T6-24A-0 to T6-2413-0 is to allow for the additional floor lot ratio allocated under the T6-2413-0 category. Criteria 5 Are the proposed changes related to adjacent and nearby districts, and within the scale and needs of the neighborhood? Criteria 5 Support: The Property is currently developed with two (2) one-story buildings and served as the site for the Miami Cash Register Co., Inc., a local business which sold cash registers and scanning systems for retail and restaurant business in South Florida. Under its current zoning, the site could be developed with a maximum of 282 units (density is 500 du/acre in the Omni Residential Density Increase Area) and a building of up to twenty-four (24) stories, by right and up to forty-eight (48) stories through the use of public benefit bonuses. The rezone request from T6-24A-0 to T6-2413-0 is to allow for the additional floor lot ratio allocated under the T6-2413-0 category. This request in consistent with similarly designated parcels immediately to the west of the site, while parcels immediately to the south and the west benefit from the T6-36B-0 designation. Therefore, the "T6-2413-0" zoning classification will respect successional transition from the more intense zoning classifications to the south and west and the less intense zoning classifications immediately north of the Property. The rezoning of this property will permit the development of the Property with residential units within walkable distance to nearby metromover stations including the School Board Metromover Station and the Adrienne Arsht Metromover Station, which all connect to the nearby Historic Overtown Metrorail Station and Brightline station. Miami Neighborhood Comprehensive Plan PZ-22-15065 03/27/23 While this rezoning request does not require an amendment to the Future Land Use Map because it's current designation of General Commercial is consistent with T6-2413 O Transect, the requested rezoning is also consistent with and promotes numerous Goals and Policies of the Miami Neighborhood Comprehensive Plan as set forth below. Goal LU-1 Maintain a land use pattern that (1) protects and enhances the quality of life in the City's neighborhoods; (2) fosters redevelopment and revitalization of blighted or declining areas; (3) promotes and facilitates economic development and the growth ofjob opportunities in the city; (4) fosters the growth and development of downtown as a regional center of domestic and international commerce, culture and entertainment; (5) promotes the efficient use of land and minimizes land use conflicts while protecting and preserving residential sections within neighborhoods; (6) protects and conserves the city's significant natural and coastal resources; and (7) protects the integrity and quality of the City's existing neighborhoods by insuring public notice, input and appellant rights regarding changes in existing zoning and land use regulations. The rezoning of the Property to T6-2413 is consistent with the Property's existing General Commercial FLUM designation. The General Commercial land use category allows development at a high density residential intensity. Hence, this application does not require a FLUM amendment. However the request is also consistent with Goal LU-1 as it will promote redevelopment and revitalization of a blighted area via efficient use of land. The requested rezoning will allow the site to be developed more efficiently to realize the underlying residential density capacity, which does not increase as a result of the rezoning. Objective LU-1.1 Ensure that land and development regulations are consistent with fostering a high quality of life in all areas, including the timely provision of public facilities that meet or exceed the minimum level of service (LOS) standards adopted in the Capital Improvements Element (CIE) of the Miami Comprehensive Neighborhood Plan. The existing level of service standards established in the CIE will be maintained because the application will not result in additional residential development capacity. 12 #176122116_v1 < T NOTICE rnis submiaal neeas m me sehetleietl mr a pbuneahng Policy LU-1.1.3 nao, tlanw bmWn,,oWhin<neCiTy& Mlami Cwtl .The appli®Lie tleciWon-mahing botly will reWew the inmrmation at the pubic hearing to rentler e recommentlatlon or a final tleGWon. Strategies to further protect existing neighborhoods through the development of appropriate transition standards and buffering requirements will be incorporated into the City's land development regulations. The requested rezoning of the Property promotes and furthers Policy LU-1.1.3 by facilitating the development of high density residential development in the urban core of the City, near availably public transportation, employment opportunities, schools and recreational facilities. The site is not a waterfront, coastal high hazard area, or in a flood zone. Zoning of the Property to a transect that facilitates maximizing the residential density capacity of the site at this location promotes sound planning and sustainability goals. Policy LU-1.1.7 Land development regulations and policies will allow for the development and redevelopment of well -designed mixed -use neighborhoods that provide for the full range of residential, office, live/work spaces, neighborhood retail, and community facilities in a walkable area and that are amenable to a variety of transportation modes, including pedestrianism, bicycles, automobiles, and mass transit. The Property is located in very close proximity to recently approved multifamily developments with T6-24 B Zoning at 1424 NE Miami Place, 58 NE 14 Street and 47 NE 15 Street. These new multifamily buildings spurred the rebirth of the Omni area as a burgeoning neighborhood. The rezoning of the Property to T6-24B will promote this mixed use neighborhood with available multi -modes of transportation, including connectivity to bike paths and the Venetian Causeway, one of the highest volume corridor for cyclists in Miami Dade County. Policy LU-1.1.10 The City's land development regulations will encourage high density residential development and redevelopment in close proximity to Metrorail and Metromover stations. (See Transportation Policy TR-2.1.3 and Housing Policy HO-1.1.9.) Criteria 2 Support: The Application is consistent and compatible with the underlying Comprehensive Plan designation of General Commercial. Criteria 4 Support: As previously stated, the Application will request a rezoning from T6- 24A-0 to T6-24B-0, a transect that is consistent with the development trend in the vicinity and the surrounding uses. The intent of the request to rezone from T6-24A-0 to T6-2413-0 is to allow for the additional floor lot ratio allocated under the T6-2413-0 category. Under its current zoning, the site could be developed with a maximum of 282 units (density is 500 du/acre in the Omni Residential Density Increase Area) and a building of up to twenty-four (24) stories, by right and up to forty-eight (48) stories through the use of public benefit bonuses. 10 #180108458_vl < T NOTICE This.ubmmb i needs to be..hetlolee b, a pubk h-1,g ina Idlnwwish t1,[ 11 setioWh mthe city& Miami Code. The appli®Lie deciWon-making body will reWew the information at the pubkc hearing to rentler e Policy LU-1.1.3 e emmendeno, enaltle iWen The City's zoning ordinance provides for protection of all areas of the city PZ-22-15065 encroachment of incompatible land uses; (2) the adverse impacts of future land uses 03/27/23 areas that disrupt or degrade public health and safety, or natural or man-made amen ' • transportation policies that divide or fragment established neighborhoods; and (4) degradation o public open space, environment, and ecology. Z-22-15065 , The Department of Resilience and Public Works, Transportation, Coordinated Review Com 03/27/23 and County agencies review zoning public hearing requests and provide input, which may aff and outcome of my hearing. These reviews may require additional hearings before other City an • recorded. The submission and acceptance of a request for public hearing means that the application is ready to be scheduled for public hearing. I am also aware that I must comply promptly with any City or County conditions and notify the Hearing Boards (Hearing Boards) in writing if my public hearing application will be withdrawn. 2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to property owners up to a mile from the subject property and I am responsible for paying the additional radius mailing costs. In addition to mailing costs, I am responsible for additional fees related to application changes, plan revisions, deferrals, re -advertising, etc. that may be incurred. I understand that fees must be paid promptly. The only fees that will be refunded after the submission and acceptance of an application for public hearing has occurred will be the surcharge fees related to appeals, as expressly listed in Chapter 62 of the City Code (Code). Requests for public hearing will be scheduled by the Hearing Boards in accordance with the scheduling timeline set forth in the Code and the Zoning Ordinance of the City of Miami (Miami 21), as applicable. I must submit any requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for its consideration and vote at the public hearing on which my application is scheduled to be heard. I understand that any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, as per the Code. 4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain a building permit even if my zoning application is approved; and a building permit will probably be required. I am responsible for obtaining any required permits and inspections for all structures and additions proposed, or built, without permits. In addition, a Certificate of Use (C.U.) must be obtained for the use of the property after it has been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the property. 5. If my request is denied, deferred, or otherwise not approved, I understand that I will not be reimbursed for any fees paid. 6. Any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, as per the Code. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan. Once the covenant receives a recommendation of approval from the Planning department and as to legal form, Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda. The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per the Code. PZ-22-15065 Av 03/27/23 Dear Constituent: Welcome to the City of Miami! This package is intended to provide you with all open Code Enforcement violations and liens attached to the subject property, or properties, as of the current date and time the following report was created. Closed violations and future violations are not included. A violation may become a lien when the property owner does not timely remedy the violation. This report may include two types of liens: Certified liens and non -certified liens. Certified liens have a set amount to be paid. Conversely, most non -certified liens continue to accrue interest or a per diem fine; therefore, those liens must be satisfied with the City as quickly as possible. All outstanding violations and liens must be satisfactorily resolved before the City can issue a Certificate of Use (CU); however, the City inspects all properties prior to the issuance of a CU and those inspections may yield additional items, which must be addressed by the owner at the property prior to issuance of a CU. This search does not include encumbrances, other liens, restrictions or the like, recorded in the Public Records of Miami -Dade County, Florida. Please contact Miami -Dade County for the aforementioned items.
