HomeMy WebLinkAboutR-82-0469� 6" RESOLUTION NO. 82-469 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF A VARIANCE AS LISTED IN ORDINANCE NO. 6871, ARTICLE VII, SECTION 3(2) (a) (3) (a), TO PERMIT AN ADDITION TO AN EXISTING DUPLEX STRUCTURE ON S60' OF LOTS 16 AND 17; BLOCK 2; GOLF COURSE GARDENS (39-7); BEING 315-317 NORTIA-TEST 43RD AVENUE AS PER SITE PLAN ON FILE, WITH A SIDE YARD OF 4.85' (6' REQUIRED), AND A REAR YARD OF 10' (20'REQUIRED); ZONED R-2 (TWO FAMILY DWELLING) WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance No. 6871 permits an extension of a variance by the City Manager with approval of the City Commission, for a one year period; and WHEREAS, the City Manager recommends the extension of the variance granted by Zoning Board Resolution No. ZB 221-81; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of a variance granted from Ordinance No. 6871, Article VI, Section 3(2) (a)(3)(a), to permit an addition to an existing duplex structure on S60' of Lots 16 and 17; Block 2; GOLD COURSE GARDENS (39-7); being 315-317 Northwest 43rd Avenue, as per site plan on file, with a side yard of 4.85' (6' required), and a rear yard of 10' (20' required); zoned R-2 (Two Family Dwelling), be and the same is hereby granted. Perez-Lu ones COMMISSION AGENDA - May 21,1982 Director PLANNING AND ZONING ITEP1S Planning and Zoning Boards _.-rAdminJ.stration- Department-__�.-__-_-____- ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871 provides that any Variance shall expire six months after the effective date of the Variance unless a Building Permit or a Certificate of Use has been issued based upon the Variance. The Ordinance further provides that the City Manager may, after review and determination that substantial prcgress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance for an additional period of time not to exceed one year, subject to approval of the City Commission. The Planning Department finds no objection to the granting of the extension of time for this Variance. RECOMMENDATIONS PLANNING DEPT. DENIAL. No hardship exists to justify the requested variances. Any additions should comply with existing yard requirements. DADE COUNTY TRAFFIC The Department of Dade County Traffic and AND TRANSPORTATION Transportation has no objection on this proposal. Box 330708 miami,F1 33133 Gentlemen: We are requesting a one-year extension of the expiration time of the variance(resclution # 221-81) granted for an addition to our residence located at 317 N.W 43rd Ave. The extension is necessary because we had to make a large unexpected expenditure for a new roof. Due to the above expenditurev we cannot afford to begin construction of our` addition within the time permitted by the approval granted on December 7 j 1981 .
