HomeMy WebLinkAboutR-82-0466RESOLUTION NO. 82-466 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF A VARIANCE AS LISTED IN ORDINANCE NO. 6981, ARTICLE VI, SECTICNS 2(3) AND 3(1) (a) (2)(a), TO PERMIT CONSTRUCTION OF A DUPLEX RESIDENCE ON LOT 25; RLnr.K '+; JACKSON PEACOCK SUB (3-18); BEING APPROXIMATELY 3044 MATILDA, AS PER PLANS ON FILE, ON A T.OT WITH 38.86' AVERAGE WIDTH (40' REQUIRED), 10' FRONT YARD (20' REQUIRED), AND 5' LFIDE STREET YARD (15' REQUIRED); ZONED R-2 (TWO FAMILY DWELLING). WHEREAS, Article XXXI of the Comprehensive Zoning Ordinance No. 6871 permits an extension of a variance by the City Manager with approval of the City Commission, for a one year period; and WHEREAS, the City Manager recommends the extension of the variance granted by Zoning Board Resolution No. ZB 218-81; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of a variance granted from Ordinance No. 6871, Article VI, Section 2(3) and 3(1) (a) (2) (a), to permit construction of a duplex residence on Lot 25; Block 4, JACKSON PEACOCK SUB (3-18); being approximately 3044 Matilda, as per plans on file, on a Lot with 38.86' average width (40' required), 10' front yard (20' required), and 5' side street yard (15' required), zoned R-2 (Two Family Dwelling), be and the same is hereby granted. Perez-Lu ones .�<<<:PE 4CF9 COMMISSION AGENDA - May 27, 1982 _ Director PLANNING AND ZONING ITEMS Planning and Zoning Boards Administration_Department ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871 provides that any Variance shall expire six months after the effective date of the Variance unless a Building Permit or a Certificate of Use has been issued based upon the Variance. The Ordinance further provides that the City Manager may, after review and determination that substantial progress has been achieved by the applicant in terms of project planning, extend the expiration date of the Variance for an additional period of time not to exceed one year, subject to approval of the City Commission. The Planning Department finds no objection to the granting of the extension of time for this Variance. We are requesting -the City Attorney's office, by copy of this memo, to prepare the proper. RECOMMENDATIONS PLANNING DEPT. APPROVAL. Although the subject site does not meet•the average lot width, sufficient lot area exists to accomodate duplex development. The requested variances are reasonable in light of the preserving of trees on the site, and the reduction of the zoned street width for Jackson Avenue being recommended by the department. DADE COUNTY TRAFFIC The Department of Dade County Traffic and Trans - AND TRANSPORTATION portation has no objection on this proposal. Box 330708 Miami, Fla. 33133 Subject: Request of variance extension Dear Sir, As owners of the property located at 3044 Matilda street, Coconut Grove, we would like herewith to appply for an extension of resolution #218-81, for the variance that was granted to us on December 7th 1981. A copy is enclosed with this letter. We need this variance to be extended for one year, due to the severe recession in the construction business. We feel it is imprudent to start the building of the duplex planned for this property. By extending the validity of the variance one more year you will give us the opportunity to wait for an improvement in the real estate and construction markets.
