A RESOLUTION UPHOLDING THE GRANTING OF A
CONDITIONAL USE AS LISTED IN ORDINANCE NO.
6871, ARTICLE IV, SECTION 43, TO PERMIT THE
OPERATION OF A COMMUNITY BASED RESIDENTIAL
FACILITY FOR A MAXIMUM OF SIX CHILDREN WITH
NO RESIDENT STAFF (ONLY SHIFT STAFF) ON SOUTH
80.48 FEET OF LOTS 34 AND 35; BLOCK 4: JACKSON
PEACOCK (3-18); BEING 3175 JACKSON AVENUE,
PER PLAN ON FILE, MEETING ALL THE CRITERIA FOR
A CBRF, AND WAIVING FOUR OF FOUR REQUIRED
OFF-STREET PARKING SPACES FOR STAFF AND OCCUPANTS
ON OWNERSHIP AND VISITATION; SUBJECT TO: a)
A REPORT SHALL BE MADE TO THE CITY COMMISSION
6 MONTHS AFTER C.O.; b) A REVIEW SHALL BE
MADE ONE YEAR AFTER C.O.; c) THERE SHALL BE

WHEREAS, the City of Miami Zoning Board at its meeting of
April 19, 1982, Item No. 8, following an advertised hearing, adopted
Resolution No. ZB 61-82 by a 6 to 1 vote GRANTING A CONDITIONAL
USE to permit a community based residential facility, as herein-
after set forth; and
WHEREAS, objectors have taken an appeal to the City Com-
mission, and
WHEREAS, notwithstanding the objections of these citizens,
the City Commission, after careful consideration and due de-
liberation of this matter, has determined that the CONDITIONAL
USE requested meets all the City's requirements for said use;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Conditional Use, as listed in Ordinance No.
6871, Article IV, Section 43, to permit the operation of a com-
munity based residential facility for a maximum of six children
with no resident staff (only shift staff) on South 80.48' of Lots
34 and 35; Block 4; JACKSON PEACOCK (3-18); being 3175 Jackson
Avenue, per plan on file, meeting all the criteria n rguar- '

a resport shall be made to the City Commission 6 months after

an advertised hearing, adopted Resolution No. ZB 61-82 by a 6 to 1 vote

Twenty-seven objections received in the mail; five objectors present at the meeting.
Four replies in favor received in the mail; fourteen proponents present at the
meeting.
A RESOLUTION to provide for this Conditional Use -has been prepared by the City.
Attorney's office and submitted for consideration of the City Commission.

RECOMMENDATIONS
PLANNING DEPT. APPROVAL. The proposed facility meets all

the surrounding area.
PUBLIC WORKS Request the dedication of the south 11' of
lots 34 and 35 and the west 5' of lot 35.
DADE COUNTY TRAFFIC Recommend on -site parking be provided.

and enter this Appeal from the decision of the City of Miami Zoning

The Parent Resource Center/Crisis Nursery
is making application to the City of Miami for
Conditional Use of 3175 Jackson Avenue in Miami.
This duelling vrill be used as a Community -based
residential facility to serve children ages

The lease at our present location expires
March 31, 1982. It might become necessary that
we move our persanal effects to the net:• location

of information and understand that no business

Re: Request for conditional use of 3175 Jackson Avenue
as a community -based residential facility
Dear Ms. Fox:
Enclosed you will find an Application for Conditional Use
from the Crisis Nursery program component of the Parent Resource
Center of Dade County Inc., a non-profit organization to use the
above address as a community -based residential facility.
Granting permission for conditional use will allow the
continuance of 24 hour respite care to infants and young children.
These services are basically child guidance, phone counseling
community education and phone referrals to appropriate community
resources.
Why the Services - The prevention of Child Abuse/Neglect is a
very serious problem. Actual reported cases in Dade County in
1980 were 7,200. For each case reported nine (9) occur which
do not reach the court/authoritative systems.
In Dade County, child abuse reports are being received at the
rate of 600-800 calls per month. In 1978 over 2,000 live births
occured to girls under 18 years of age in our county. Children
are being physically, emotionally and sexually abused daily in
our community. Some of these children will die without ever
being noticed.
This facility came into existence as a result of the persistent
efforts of The Junior League, National Council of Jewish women,
and The Federated Junior Women's Clubs. Present funding for the
nursery is directly attributable to the Legislative leadership of
Senators Jack Gordon and Robert McKnight.
The denial of our request for conditional use would close
the only child abuse/neglect prevention facility in Dade County.

I understand the Crisis Nursery in Coconut Grove
must relocate. I feel it is very important that this facility
remain open for the benefit of abused children. The program
works closely with the Court and with Health and Rehabilitative
Services and has been extremely effective in its efforts.
Crisis Nursery is open twenty-four hours a day and
acts as a refuge for abused and battered children. Coconut
Grove is centrally located for all areas of Dade County and
is accessible by major thoroughfares. If Crisis Nursery
id not allowed to relocate in Coconut Grove, in my opinion
it would be a great loss to the community and to all of
Dade County.

The Parent Resource Center's Crisis Nursery Program has
made application for conditional use of 3175 Jackson Avenue
as a community based residential facility.
The goal of this program is to prevent child abuse and
neglect. It is the only center in the community that cares
for infants and young children on an emergency basis. The
nursery has been in operation for four years and has provided
an invaluable service to this community and HRS. It is also
an excellent example of a joint venture between the community
and the state.
To deny conditional use of this facility would mean
that children in jeopardy would be left without advocates
or respite care, and thousands of dollars and unknown hours
of volunteer services which have made this center operational
would have been wasted.
I appeal to you to approve operation of this facility
since the community is in need of the services being provided
at the center.

The Junior Woman's Club of Cocount Grove would like to take this
opportunity to encourage the City of Miami to allow the relocation
f othe Community Crisis Nursery to the address referred to above.
The Nursery was a culmination of four (4) years of hard work
and determination to do something community our conunity to help
combat a serious social proble-n, child abuse. They nursery has
suroassed even our wildest expectations and provides an invaluable
community service the prevention of abuse and neglect through
not only serving as an alternative to the frustrated mother but
to provide her with much needed counseling.
The nursery has in no way been disruptive or had a detrimental
effect on its present neighborhood and it would be unforseeable
that it could change in any way its future neighborhood or pose
a threat to the other property values in said neighborhood.
The Junior t-loman's Club and its Potpourri Service Club at Coral
Gables High School, have in the past and will continue in the
future support the nursery as well as provide the necessary upkeep
for aesthetically conforming to its future home.

Dear Miss Fox:
On behalf of the National Council of Jewish Women, Greater Miami
Section, I wish to express our support for the Crisis Nursery's
needed zoning variance. We have been closely involved in nurtur-
ing the Crisis Nursery from its inception four years ago. This
innovative and very worthwhile project, a pre -abuse facility, is
the first shelter for children of parents in distress in South
Florida. It gives us great satisfaction to see the legislative
and community support for this project continue to grow.
The nursery,currently located in Coconut Grove at 3401 Williams
Avenue, has proven to be an asset to all who live in the neighbor-
hood; especially the children who congregate there and are treated
in a warm, friendly manner.
We urge the zoning board to approve the variance needed for our
new location, 3175 Jackson Street, so that the Crisis Nursery may
continue to serve the children of Dade County.

I am writing in support of the Parent Resource Center's request
for conditional usage of property located at 3175 Jackson
Avenue for its Crisis Nursery.
The Crisis Nursery provides invaluable service to our community
by affording a refuge to young children whose families are

Gloria Simmons, director of the nursery, and I have worked on
various projects over the last ten years and I know her to be
