HomeMy WebLinkAboutR-82-0452Ilk RESOLUTION NO. 82-45Z A RESOLUTION REQUESTING THE WAIVER OF DEED RESTRICTIONS FOR MARINE RELATED USES, FROM THE BOARD OF TRUSTEES OF THE INTERNAL IM- PROVEMENT TRUST FUND, IN CONNECTION WITH THE SUBMERGED LAND LEASE OF CERTAIN DESIGNATED LAND TO CORAL REEF YACHT CLUB, INC. WHEREAS, the City of Miami has been requested by the Coral Reef Yacht Club, Inc. to Petition the Board of Trustees of the Internal Improvement Trust Fund for a Waiver of Deed Restrictions, and WHEREAS, while the City of Miami did not initiate this request or feel that a Waiver is legally necessary, it will make the request in order to expedite the permitting process for Coral Reef Yacht Club, Inc; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City of Miami requests a Waiver of Deed Restrictions for marine related uses from the Board of Trustees of the Internal Improvement Trust Fund, in connection with the submerged land lease of certain designated land to Coral Reef Yacht Club, Inc. Gary - City Manager iNTER-OFF1CZ .,':EHO:iANDUrM COMA AISSION ACTION April 28, 1982 Coral Reef Yacht Club Lease T Request of Waiver of Deed Restrictions from The State of Florida C'tCL CS PCis Proposed Resolution IT IS RECON ENDED THAT THE CITY COMMISSION APPROVE THE ATTACHED RESOLUTION REQUESTING THE WAIVER OF DEED RE- STRICTIONS FOR MARINE RELATED USES, FROM THE BOARD OF TRUSTEES OF THE INTERNAL IMPROVEMENT TRUST FUND OF THE STATE OF FLORIDA, IN CONNECTION WITH THE SUB&ZUMED LAND LEASE OF CERTAIN DESIGNATED LAND TO CORAL REEF YACHT CLUB, INC. The proposed Resolution provides for a request of a Waiver of Deed Restrictions by the Board of Trustees of the Internal Improvement Fund of the State of Florida. This request, pursuant to the terms of the Lease Agreement between Coral Reef Yach'. Club and the City of Miami, is necessary, in order to obtain the necessary permits, and execute the expansion of the club facilities, as provided for in the subject lease. 1-vowamegi The June 29, 1979, Lease Agreement between the City and Coral Reef Yacht Club provided for the club to accomplish a planned expansion upon obtaining the necessary permits. These permits were denied due to the dredging needed in an area containing productive marine grasses. This lease was amended pursuant to Resolution No. 81-262 of April 9, 1981, to relocate the club's expansion project into a submerged land area of sufficient water depth so as not to require dredging. This location was supported by the local environmentally concerned organizations. Unfortunately, a topographical survey of that new lease area indicated that past dumping of dredged soil had created a shallow spot at the east end of the new leased area. This shallow ledge required dredging the low spot. The proposed lease area was then moved northward an average of 25.46 feet to accommodate the proposed expansion. This lease was then further amended pursuant to Resolution No. 82-31 of January 14th, 1982, thus relocating the expansion project. The total area of submerged land remained approximately the same and the modification allowed Coral Reef Yacht Club to increase its available wet -slip storage by 28 as originally planned. This last modification, as approved by the City Commission contains approximately the same submerged land area. Upon obtention of the requested waiver the club can proceed to request permits. f2-2�ASn,-
