1981, THE CITY'S CAPITAL IMPROVEMENT
APPROPRIATIONS ORDINANCE FOR FISCAL
YEAR 1981-82; AS AMENDED; BY ESTAB-
LISHING THE ANTICIPATED IJR.BAN MASS
TRANSPORTATION ADMINISTRATION (UMTA)GRANT
FUND AS A NEW RESOURCE IN THE AMOUNT
OF $30,000 IN THE CAPITAL IMPROVEMENT
FUND AND APPROPRIATING SAME AMOUNT TO
INCREASE APPROPRIATIONS FOR PROJECT
IX.B. (i) 1.8., DOWNTOWN PEOPLE MOVER,
TO PAY FOR SERVICES PROVIDED BY THE
PLANNING DEPARTMENT IN PREPARATION
OF AN ENVIRONMENTAL IMPACT STATEMENT
REQUESTED BY UMTA IN COMPLIANCE WITH
FUNDING COMMITMENT FOR THE OVERTOWN
URBAN INITIATIVES PROJECT (PRE -CON-
STRUCTION PIiASE); CONTAINING A RE-
PEALER PROVISION AND SEVERABILITY
CLAUSE; AND DISPENSING WITH THE REnUIR-
MENT OF READING SAME ON TWO SEPARATE
DAYS BY A VOTE OF NO LESS THAN FOUR -
FIFTHS OF THE MEMBERS OF THE COMMISSION.
WHEREAS, the City Commission adopted Ordinance No. 9353 on
November 19, 1981, establishing resources and appropriations for
the implementation of capital improvements in the City of Miami,
Florida, for the Fiscal Year ending September 30, 1982; and
WHEREAS, the Board of County Commissioners did approve the
grant application to the Urban Mass Transportation Administration,
U.S. Department of Transportation,for the Overtown Urban Initia-
tives Project (Pre -Construction Phase) in the amount of $6.9
million and authorized the County Manager to submit the grant ap-
plication for and on behalf of Metro Dade County and to expend
the funds therefrom; and
WIiEREAS, the Urban Mass Transportation Administration has
granted a reservation of funds for the Overtown Urban Initiatives
Grant penciin_r the completion of an Environmental Impact Statement;
and
S%iIiEREAS, the City Commission approved Resolution 81-451 on
May 28, 1981 authorizing the City Manager to execute an agreement
with Metro Dade County for services provided by the City Plan -
nine Department in joint preparation of documentation requested
by [JMTA, including an Environmental Impact Statement, in com-
pliance with funding commitment for. the Overtown Urban Initia-
tives Project (Pre -Construction Phase); and
11HEREAS, the contract amount is not to exceed $30,000.;
and
WHEFEAS, the contract was revised by Resolution 81-779 and
approved by the City Conunission on September 10, 1981,
e:;tendinc.; the cor,iuletion date From September 30,
1981 to December 31, 1981 and clzarifyinq that compensation to the
City was not to exceed $30,000, including miscellaneous expenses;
and
WHEREAS, the Environmental Impact Statement is now complete;

WHEREAS, the amount of $30,000 is available from the
Anticipated Urban Mass Transportation Administration Grant Fund;
and
WHEREAS, said resource is hereby established in the Capital
Improvement Fund in the amount of $30,000; and
WHEREAS, the amount of $30,000 is hereby appropriated to
the Downtown People Mover project in the Capital Improvement Fund
for the purpose of paying for Planning Department services in pre-
paration of the Environmental Impact Statement as per the joint
City/County contract;
NOW, THEREFORE BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI , FLORIDA:

Section 1. Section 1 of Ordinance No. 9353, adopted
November 19, 1981, is hereby amended in the following particulars:l/
"Section 1. The following appropriations hereby
made by fund and project title include previ-
ously authorized projects and fund appropriations
for implementation of all municipal capital im-
provements of, the City of Miami, Florida. The
sources of revenue to support the herein appro-
priations are hereby identified by fund and pro-
ject:

Section 2. The appropriation of $30,000 will be used
For the purpose of pavinq .for Planning Department services
in preparation of the Environmental Impact Statement, now
complete, as requested by the Urban Mass Transportation Ad-
ministration in compliance with the funding commitment for
the Overtown Urban Initiatives Project (Pre -Construction
Phase) .
Section 3. All ordinances of parts of ordinances insofar
as they are inconsistent or in conflict with provisions of this
ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.
Section 5. The requirement of readinq this ordinance on two
separate days is hereby dispensed with by a vote of not less than
four -fifths of the members of the Commission.
