TO ORDINANCE NO. 871.9 ORDINANCE NO,',-*) ' 5 J AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE 8719, ADOPTED OCTOBER 26, 1977, THE SUMMARY GRANTS APPRO- PRIATIONS ORDINANCE; AS AMENDED; <` BY ESTABLISHING A NEW TRUST AND - AGENCY FUND ENTITLED: "MIAMI COM- PREHENSIVE NEIGHBORHOOD PLAN UPDATE", AND APPROPRIATING FUNDS FOR THE 4 OPERATION OF SAME IN TIME AMOUNT OF $20,000; BY AMENDING THE TRUST AND _ = AGENCY FUND ENTITLED: "302-EDA PLANNING GRANT", AND BY INCREASING APPROPRIATIONS FOR THE OPERATION OF SAME BY A TOTAL AMOUNT OF $97,350 TO AN AMOUNT OF $191,630 _ PLUS A LOCAL MATCH; BY ESTABLISHING A NEW TRUST AND AGENCY FUND ENTITLED: "METRORAIL STATION IMPLEMENTATION - STUDIES TECHNICAL SERVICES", AND APPROPRIATING FUNDS FOR THE OPERATION _ OF SAME IN THE AMOUNT OF $70,000; BY ESTABLISHING A NEW TRUST AND - AGENCY FUND ENTITLED: " DOWNTOWN - COMPONENT OF METRORAIL SUPPORT POLICIES _ ASSESSMENT", AND BY APPROPRIATING FUNDS FOR THE OPERATION OF SAME IN THE AMOUNT $15,000; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; -- _ AND DISPENSING', WITH THE REQUIREMENT - OF READING SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS — OF THE MEMBERS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 8719 on October 26, 1977, establishing resources and appropriations for grant funds anticipated by the City of Miami, Florida; and WHEREAS, by Resolution 81-867 dated October 7, 1981, the City Commission authorized the City Manager to submit a grant application in the amount of $20,000 to the Florida Department of Veteran and Community Affairs for financial assistance from the Local Government Comprehensive Planning Act Assistance Fund Program for t'e 1981-1982 program year; and WHEREAS, by letter of October 15, 1981, the Florida Depart- ment of Veteran and Community Affairs notified the City that the application had been selected for funding and was eligible for the maximum amount of $20,000; and WHEREAS, the City Manager accepted the grant award of $20,000 by letter of November 2, 1981; and WHEREAS, by Resolution 82-13 dated January 14, 1982, the City Commission retroactively affirmed the action of the City Manager in executing the contract between the State of Florida 9: f Department of Veterans and Community Affairs and the City of Miami in the amount of $20,000 for Planning Department services in updating the Miami Comprehensive Neighborhood Plan; and WHEREAS, the City Commission adopted Ordinance No. 8910 on March 8, 1979 which amended Ordinance No. 8719 by establish- ing a 302-EDA Planning Trust and Agency Fund and appropriating sources thereto; and WHEREAS, by Board of County Commissioners' Resolution R-39-80; January 8, 1980 and City Commission Resolution 79-880; December 27, 1979, execution of a City/County Agreement for $75,000 plus a 25% local match was authorized for Departments of Planning and Trade and Commerce Development economic devel- opment planning services for Fiscal Year 1979-1980 funded through an Economic Development Administration 302 Planning Grant to Metropolitan Dade County; and WHEREAS, by the Board of County Commissioners' Resolution R-1322-80; October 7, 1980 and City Commission Resolution 80-802; November 6, 1980 execution of contract amendment No. 1 was authorized which amended the personnel table; extended the time of performance to December 31, 1980, and increased the contract amount by $19,280 to $94,280 plus the local match to be provided by personnel working on other grants; and WHEREAS, by Board of County Commissioners' Resolution R-841-81; June 2, 1981 and City Commission Resolution 81-478; May 28, 1981 execution of contract amendment No. 2 was authorized which amended the personnel table, extended the time of perform- ance to March 31, 1981, and increased the contract amount by $17,815 to $112,095 plus the local match to be provided by personnel working on other grants; and WHEREAS, by City Commission Resolution 82-48, January 14, 1982 execution of contract Amendment No. 3 was authorized which amended the personnel table; extended the time of performance to December. 31, 1981, and increased the contract 0 .:, amount by $79,53Q, to $191,630 plus the local match to be provided by personnel working on other grants; and -2- gA 4 October 26, 1977, as amended, is hereby further amended as follows:l/ "Section 1. All figures are rounded to the next dollar. -4- 4 4 4,� WHEREAS, the 302-EDA Planning Trust and Agency Fund is hereby amended by increasing appropriations in a total amount of $97,350 to an amount of $191,630 pursuant to said City Commission Resolutions Nos. 81-478 and 82-48 passed on March 31, 1981 and January 14, 1982, respectively, the appropriation of said funds satisfies the account- ing requirements of this grant; and WHEREAS, by Resolution 82-309 dated April 1, 1982, the City Commission authorized the City Manager to execute a City/Metropolitan Planning Organization Agreement for Planning Department Services for Metrorail Station Implementation Technical Services; and WHEREAS, said agreement is in the amount not to exceed S70,000 funded from an Urban Mass Transportation Administration Planning Grant (FL-09-7005) through the Dade County FY 1982 Unified Planning Work Program; and WHEREAS, said planning services will promote joint public/private redevelopment adjacent to the Allapattah, Culmer and Santa Clara tran- sit stations and a pedestrian mall east of the Brickell transit station; and; WHEREAS, by Resolution 82-308 dated April 1, 1982, the City Commission authorized the City Manager to execute a City/Metropolitan Planning Organization Agreement for Planning Department Services for the Downtown Component of Metrorail Support Policies Assessment; and WHEREAS, said Agreement is in the amount not to exceed S15,000 funded from the Dade County FY 1982 Unified Planning Work Program; and WHEREAS, said planning services will assist in the assessment of the utility, safety and amenity of sidewalks, crossings and signali- zations, through block connections and arcades that serve the Downtown Component of Metrorail Stations Downtown; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By Resolution 79-880, dated December. 27, 1979 the City Commission authorized the City Manager to execute a City/County- Agreement for $75,000 plus a local match for the Department of Planning and the Department of Trade and Commerce Development economic planning sorvices . Funding was provl_dej through the Economic Development Administration 302 Planning] :;rant to Metropolitan Dade County. The Agreement has been amended three times to increase the contract- amount by $19,280 to $94,230 (Resolution 80-802, November 6, 1980); by $1/,315 to $112,095 (Resolution 01-478, May 28, 198 .) ; and by $79,535 to $191,630 (Resolution 82-48, January 14, 1902). In addition, each of the three amendments extended the time of performance to December 31, 1930, tc r rch 31, 1991, and to Doca"tr 31, 19S!, respectively. l t is reconinlended that a total amount of $97 , 350 be appropriated to the 302-EDA fund to reflect the last two amendmeIlts passed by resolution that increased the contract amount to $191,630 and extenVed the time period to December 31, 1981. On April 1, 1982, the City Commission approved Resolution 82-309, authorizing the City Manager to execute a City/ Metropolitan Planning Organization Agreement for Planning_ Department services for Netrorail Station Implementation Technical Serviccb in an amount of $70,000. The funding_ is from an Urban Mass Transportation Administration Planning Grant to the Metropolitan Planning Organization. The purpose of the contract is for Planning Department studies of joint development (private investment/public assistance) for a community shopping center adjacent to the A1l.apattah transit station, a community produce market and specialty retail food center adjacent to the Santa Clara transit station, a small shopping center and limited residential development adjacent to the Culmer Station, a pedestrian transit mall along SW loth Street east of: the Prickoll transit station. It is recommended that $70,000 be appropriated to establish the fund entitled "Metrorail Station Implementation Studies Technical -Services" to pay for.
