ORDINANCE FOR THE CITY OF MIAMI, BY
APPLYING ARTICLE XXI-7 HERITAGE COIN ;ER-
VATION: RESIDENTIAL - OU ICE SPECIAL,
OVERLAY DISTRICT TO THE FOLLOWING PROPER-
TIES: 1) PETIT DOUY - 1500 BRICKELL
AVENUE, LOTS 41 AND'-42, BLOCK 55,
BRICKEWS FLAGLER (5-44) ; 2) WARNER
HOUSE, Ill SOUTHWEST 5TH AVENUE , DOTS 8
AND 9, BLOCK 18, MIAMI SOUTH (B-4.1) , AND
INCORPORA`C'ING BY ATTACHMENT DESIGNATION

TAIN.ING A SEVERABILITY CLAUSE
WHEREAS, the Miami Planning Advisory Board, at its
meeting of Nar.ch 17, 1982, Item No. l(c), following an ad-
vertised hearing, adopted Resolution No. PAB 17-82 by a
7 to 0 vote, RLCON'119CNDING APPROVAL of applying the Heritage
Conservation Residential Office Special Overlay District
(SPD-5), as hereinafter set forth; and
WHEREAS, the Miami City Commission finds that in order
to promote
the public
welfare and to cultivate a sense
of
identity,
stability and
pride amongst City residents, it
is
necessary
to recognize
and conserve significant elements
of
Miami's cultural, social, political, architectural, and
archeological heritage; and
I)HERLAS, the City Commission after careful considera-
tion of this matter deems it advisable and in the best
ir:tarest of the general welfare of the City of Miami and its
inhabitants to grant said approval;
I-)W, `iHLItGF'ORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY i:F MIAMI, FLORIDA:
Section I. Article XXI-7 Heritage Conservation:
Residential -Office Special Overlay iistrict. (SPD-5), of
Ordinance No. 0871, as amended, the Comprehensive Zoning
Ordinance for the City of Miami, is hereby applied to the
following propert ices : 1) PGTI'r i)GUY 1500 Br ickel l Avenue,
Lots 41 and 42, Block 55, Brickell's Plagler (5-44); and 2)
WARNER HOUSE - 111 Southwest 5th Avenue, Lots 8 and 9, Block
18, Niiami South (B-41).
Section 2. This application is made after examina-
tion of Designation Reports prepared by the City of. Miami
Planning Department on the. J.C. WARNER HOUSE and PE,'rIT DOUY
properties. Said Designation Reports are attached hereto,
and made a part hereof.
Section 3. The City Commission finds PETIT DOUY and
VJARREI4 HOUSE properties meet one or more of the criteria, as
required for application of Heritage Conservation: Residen-
tial - Office Overlay District (SPD-5), set forth in Article
XXI-7, Section 3 of Ordinance No. 6871, as amended.
Section 4. The Zoning District Map made a part of
said Ordinance No. 6871 by reference and description in
Article III, Section 2 of. said Ordinance is hereby amended
to reflect the changes made necessary by the amendments.
Section 5. That all ordinances, code sections or
Darts thereof in conflict herewith are hereby repealed inso-
far as they are in conflict.
Section 6. Should any part or provision of this
ordinance be declared by a Court of competent jurisdiction
to I-)(' invalid, the sam(_ shall not affect the va 1 id ity of the
r,r.din,Anc:(' as a whole.
