"SPD-4 DIISICI-4 PLAZA OVERLAY DISTRICT;
Section 2. Tliat all Ordinances, Code Sections

Section 4. Should any part or provision of this
Ordinance be declared by a court of competent jurisdiction
to be invalid the same shall not affect the validity of the
Ordinance as a whole.

For the information of the Commission, the followinq chronology of
events summarizes previous actions reciardinq the r roposed location
Oil the South Florida Evaluation and Treatment Center (formerly
known as the Forensic Hospital) on the site of the former Sea-
board Terminal. The project is proposed by the State of Florida
De,)art:nent of Health and Rehabilitative Services and will be
considered by the Commission on May 27, 1982.

April 23,1981 The City Commission held a public hear-
inq to discuss the sale of the Munici-
oal Justice 13uildinq site to the State
of Florida for the facility. Per
Resolutions 81-345,346 and 347 the
Manager was directed to investigate
alternative sites, specifically the
Seaboard Terminal site at N<a 22nd
Street/7th Avenue and to schedule
rezoning of both the Municipal Justice
Building and Seaboard Terminal to GU -
Governmental Use to assure continued
State funding for the facility.

mended denial of= rezoning of both
sites to GU-�--,ov(-_r_nmental Use.
Per Resolution 81.-44 4 the r1anacger
was directed to negotiate with the
State of Florida for State Acquisition
of the Seaboard Terminal. The Com-
mission also approved, on first
reading, an ordinance to rezone the
Seaboard Terminal. site to GU -Govern-
mental Use.
Per ordinance 9283, the City Com-
mission approved the rezoning of the
Seaboard Terminal site to GU -Govern-
mental Use.
The Zoning Board approved the ten-
tative plat of the site.
The Planning Advisory Board recom-
mended denial for permission to con-
struct and operate the South Florida
Evaluation and Treatment Center -
Governmental Use - at the Seaboard
Terminal and denied a request for
rezoning a small parcel on the south
side of the site to C,U-Governmental
Use.
The Commission will consider the fol-
lowing items pertaining to the South
Florida Evaluation and Treatment Center:
a)Rezoning a small portion of the site
to GU -Governmental Use
b) Permission to construct and operate
the facility at the Seaboard Ter-
minal site
c) Approval of the final plat of the
site
The Law Department is currently reviewing a contract for the sale of
the 6.14 acre site of the former Seaboard Terminal to the State of
Florida.

Reading
As directed by the City Commission, the following revisions
have been made to SPD-5 for 2nd Reading on May 27:
p3. Section 4: USE REGULATIONS, paragraph (2) - banks,
savings and loans, and similar financial institutions
have been excluded from the interpretation of "mort-
gage financing".
p3. Section 4: USE REGULATIONS, paragraph (3) - retail
sale of antiques, art, handicrafts and similar items
has been reworded to be restricted to items related
to local history and historic preservation.

During the February 17th public hearing concerning the proposed Heritage t
Conservation ordinance the Board requested that a uniform policy be
established concerning the use of floor area ratio bonuses as an incen-
tive for preservation of historic structures.
The Department agrees with the Board that it is necessary to have a
uniform policy that treats all historic property owners fairly. However,
there are other types of incentives besides the FAR bonus which are
equally beneficial and often more compatible with other planninq and
and zoning policies. Thus, we would recommend a policy that would
generally assign certain preservation incentives according to the
classification of the oroperty as follows:
a. Commercial or office zoning districts (C-1, C-2, C-4, C-5, C-2A,
R-C, R-CA, R-CB, R-CC, I-1, MXD) - FAR .25 bonus
b. High density commercial districts (C-3, CBD.-2, MXD, RC-B)
- Transfer of development rights and exemptions to
yard area and amenity requirements.
C. Residential districts (R-1 through R-5) - change of use to
office or commercial where compatible with the surrounding
area (example: SPD-5 on Petit Douy and Warner House)
d. Residential districts (R-1 through R-5) - change of density
(units per acre) or limited FAR bonus where change of use
(c) is not compatible with the surrounding area.
The appropriate incentive can be provided within the overlay zoning dis-
trict which is adopted for each individual historic site or district.
The SPD-5 overlay zone, proposed as a separate item on the March 17th
agenda, is a good example of how this process would work under an HC
zoning category. The other alternative is to provide the incentive with-
in the underlying zoning district regulations (for example as provided
in C-2A and MXD). The latter approach is not recommended on a City-wide
basis because it would be cumbersone to implement and would orevent
flexibility in creating incentives tailored to the special needs of many
historic properties.
