HomeMy WebLinkAboutR-82-0518� RESOLUTION NO. 82--51�3 A RESOLUTION WAIVING THE REQUIREMENTS OF CHAPTER 2, ARTICLE V, SECTION 2-302 (CON- FLICT OF INTEREST) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY FINDING THAT IT IS IN THE BEST INTEREST OF THE CITY TO PERMIT PAULINE MUMFORD, AN EMPLOYEE OF THE PARKS & RECREATION DEPARTMENT, TO PARTICIPATE IN THE CITY'S HOUSING REHABILITATION PROGRAM ADMINI- STERED BY THE COMMUNITY DEVELOPMENT DEPARTMENT. WHEREAS, the City of Miami, through the Community Development Block Grant Program of the United States Depart- ment of Housing and Urban Development, has embarked upon a home renovation and rehabilitation program for its resi- dents; and WHEREAS, the Community Development Department's Housing Division administers this program; and WHEREAS, PAULINE MUMFORD a City of Miami Parks and Recreation Department employee, who resides within the City, has applied for rehabilitation assistance under this pro- gram; and WHEREAS, said employee qualifies in all respects for participation in said program, except that she is employed by the City of Miami and would be in technical violation of Chapter 2, Article V, Section 2-302 of the City's Conflict of Interest Law; and WHEREAS, a waiver must be obtained for PAULINE MUMFORD's participation in said program; and WHEREAS, the City can only avail itself of the oppor- tunity to participate in a valid housing redevelopment pro- gram through offering the program to all residents of the City, notwithstanding their employment by the City of Miami; and WHEREAS, other City employees who have applied for and qualified for participation in this program have been given a waiver of the Conflict of Interest provisions; CITY COMMISSION MEETING OE J UN 192s �ww� _ NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MIAMI, FLORIDA: Section 1. The requirements of Chapter 2, Article V, Section 2-302 of the Code of the City of Miami, Florida, as amended, with respect to the transaction of PAULINE MUMFORD with the City's rehabilitation program, administered by the Community Development Department, is hereby waived, with respect to any possible conflict of interest. Section 2. The participation by PAULINE MUMFORD.in the City's Housing Rehabilitation Program is in the best interest of the City. PASSED AND ADOPTED this 17th day of Junn , 1982. Maurice A. Gary Uji�• 3 Nib 27, 1982 City Manager Waiver. of Conflict of Interest Dena Spillman, Director City Commission Agenda Department of Community Development June 17, 1982 It is recommended that the Cite Commission waive the Coni ict of Interest provision, Article V, Section - _ of t e Code of the City of Miami to allow Pauline Mumford an employee of the Parks and Recreation Department of the City to receive assistance through the Housing Rehabilitation Program. The Rehabilitation Assistance Progra-m administered by the Community Development Department with Community Development Block Grant Funds is available to all residents of the City, living in the designated Great Neighborhoods and meeting the published eligibility requirements. The program guidelines prohibit persons involved in the direct administration of the program and members of the governing body of the City of Miami from participating in the program. City employees who are not members of the Commission and who are not involved in the administration of the program are eligible for assistance if they meet the eligibility criteria. From time to time, city employees have met the eligibility criteria and have requested assistance through the Rehabilitation Program. These employees are required, by the Code of the City of Miami, Article V, Section 2-102, to obtain a waiver from the City Commission before such assistance can be approved. The program guidelines established by the United States Department of Housing and Urban Development do not allow the City to set up separate classes of citizens based on their employment as a criteria for eligibility for assistance programs. They do require that program staff and members of governing bodies be ineligible for assistance from certain programs. Based on the above, it is recommended that the City Commission approve the Waiver of the Conflict of Interest provision to allow approval of the subject application. /wh 82-518_..
