HomeMy WebLinkAboutO-094480RDINANCE No, ,4 4 8 AN ORDINANCE REPEALING SECTION 31-11�tNTITLBU "FIVE-DAY OCCUPATIONAL LICENSE IN CONJUNCTION 141TR OPEN Alit, OUTDOOR, CULTURAL, ART, FOLK OR STREET FESTIVALS",ANU SECTION 31-483E-EXHIBITORS (b) (LICENSE FEE SCHEDULE] OF THE CODE OF THE CITY OF MI&Mt, FLORIDA, AS AMENDED; AND BY AMENDING CODE SECTION 31=10, ENTITLED "OCCUPATIONAL LICENSE PREREQUISITE.FOR MAKING REAL PROPERTY AVAILABLE FOR EXHIBITION, ETC., OF GOODS IN CONJUNCTION WITH OPEN AIR ACTIVITIES", BY REQUIRING COMPLIANCE WITH CERTAIN STANDARDS AND REQUIRING AN OCCUPATIONAL LICENSE PRIOR TO MAKING SAID REAL PROPERTY, PREMI- SES OR SPACE AVAILABLE; ESTABLISHING AN OCCUPA- TIONAL LICENSE FEE SCHEDULE; PROVIDING A PENALTY CLAUSE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, significant annual cultural displays and public exhibi= tions have become a vital and essential part of this community; and WHEREAS, these annual demonstrations afford "common life -shar- ing experiences" to all citizens, thereby creating goodwill and resulting in shared understanding of one another and a stronger appreciation of society's goals; and WHEREAS, the aforesaid public art and folk festivals require a tremendous logistical effort to marshall the necessary resources for a successful and peaceful community project; and WHEREAS, from time to time the control over vendors of wares and merchandise becomes necessary in localities where a particular event or project is being staged; and a WHEREAS, the health, safety, welfare of the Community must be safeguarded; and WHEREAS, the herein ordinance contains reasonable restrictions . upon the use of real property, premises or space regarding the appro- priate occupational license in conjunction with art, folk or street festivals, and adherence to appropriate safety measures; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1, Section 31-11, entitled "Five-day occupational license in conjunction with open air, outdoor, cultural, art, folk or street festivals", of the Code of the City of Miami, Florida, t,�d Section 2, Section 31-48-t-txhibitors (b) [which deals with the cost of a five-day occupational licensel of the Code of the City of Miami; Floridai as amended, is hereby repealed in its entirety. Section 3. Section 31-10 of the Code of the 'City of Miami§ Florida, as amended, is hereby further amended in the following l/ partideiars:— "Sec. 31-10, Occupational license prerequisite for making real property available for exhibition, etc., of goods in conjunction with open air activities, (a) No person, firm, organization, or corporation shall knowingly lease, sell or otherwise make available real property or premises to another for the purpose of per- mitting other such €+rmT person, firm, organization, or corporation to exhibit, sell or offer for sale, goods, merchandise or wares, in conjunction with an open air, outdoor, cultural, art, folk or street festival, unless such ethev person, firmer organization, or corporation shall first have obtained the proper occupational license(s) to so engage, prior to making said property or premises avail- able. (b ) (c) Each person, firm, organization, or corporation leasing or subleasing property shall be required to pay the following amounts foran occupational license: 1 - 50 spaces $ 50 per day 51 - 100 spaces $100 per day over 101 spaces $150 per day These fees are due and payable prior to the event occurring. (d) Any person, firm, organization, or corporation violat-' ing provisions of the herein section shall, upon conviction, be fined not more than Five Hundred Dollars ($500.00), or be imprisoned for not more than sixty (60) days, or both." Section 4. All ordinances or parts of ordinances in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 5. If any section, part of section., paragraph, clause, phrase, or word of this ordinance is declared invalid, the remain- ing provisions of this ordinance shall not be affected.
