AN EMERGENCY ORDINANCE AMENDING SECTION
1. OF ORDINANCE NO. 93535 THE CITY'S
CAPITAL IMPROVEMENT APPROPRIATIONS ORDI-
NANCE FOR FISCAL YEAR 1981-82, AS AMENDED;
BY DECREASING APPROPRIATIONS FOR PROJECT
IX.C.(ii)35 VIRRICX GYM BOAT RAMP IMPROVE-
MENT BY AN AMOUNT OF $115100: AND
APPROPRIATING SAME AMOUNT TO ESTABLISH
FUELING FACILITY - ADDITIONAL FUEL TANKS
AS ITEM IX.C.(ii)9, AS A NEW CAPITAL
PROJECT; BY ESTABLISHING SPECIAL PROGRAMS
AND ACCOUNTS -LEASE PROPERTIES AS A
RESOURCE IN THE CAPITAL IMPROVEMENT FUND,
IN THE AMOUNT OF $21,200 AND APPROPRIATING
SAME AMOUNT TO ESTABLISH MARINE STADIUM
BOAT RAMP REPAIRS AS ITEM IX.C.(ii)105 AS
A NEW CAPITAL PROJECT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY
CLAUSE; AND DISPENSING WITH THE REQUIRE-
MENT OF READING SAME ON TWO SEPARATE DAYS
BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF
THE MEMBERS OF THE COMMISSION:
WHEREAS, the City Commission adopted Ordinance No:
9353 on November 19, 1981, establishing resources and
appropriations for the implementation of capital improvements
in the City of Miami, Florida, for the Fiscal Year ending
September 30, 1982: and
WHEREAS, the City Commission adopted Resolution No.
80-659 on September 15, 1980, awarding a contract to construct
the Fueling; Facility -Additional Fuel Tanks; and
WHEREAS, additional work not included in the original
contract, consisting of the construction of additional concrete
slab and additional manholes was performed by the contractor;
and
WHEREAS, this additional work exceeds the amount
appropriated for the work by approximately $11,100; and
WHEREAS, an amount of $11,100 is available from
unused monies appropriated tot the Virtitk Cym Boat Ramp
Repairs project; and
WHEREAS, the amount of $11,100 can be transferred
to establish Fueling Facility = Additional Fuel Tanks as a
new capital project in the Capital improvement Fund; and
WHEREAS, the existing boat ramp at the Marine
Stadium has had settlement of the fill under the present
concrete slabs that has reached a stage where launching
operations are affected and damage to boats has been occurring;
and
WHEREAS, the Department of Public Works has deter-
mined that the Marine Stadium Boat Ramp can be repaired by
grouting under the concrete slabs at a cost of approximately
$21,200; and
WHEREAS, the City Commission adopted Resolution No.
82-337 on April 22, 1982, authorizing the City Manager to
accept a bid for repair of the boat ramp; and
WHEREAS, the amount of $21,200 is available for the
aforementioned purpose from Special Programs and Accounts -Lease
Properties; and
WHEREAS, the amount of $21,200 can be transferred
to the Capital Impro,ement Fund and be appropriated to establish
Marine Stadium Boat Ramp Repairs as a new capital project in
said fund;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION
OF THE CITY OF MIAMI, FLORIDA:

adopted November 19, 1981, is hereby amended in the following
particulars:��

Section 2. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
Section 3. If any section, part of section,
paragraph, clause, phrase, or word of this ordinance is declared
invalid, the remaining provisions of this ordinance shall not
be affected.
Section 4. This ordinance is hereby declared to be
an emergency measure on the ;rounds of urgent public need for
the preservation of peace, health, safety and property of the
City of Miami, and upon the further ground of the necessity of
pro%.idin sufficient funds to cover the additional costs of the
construction of the Fueling Facility - Additional Fuel Tanks,
and upon the further ground of the necessity of providing
sufficient funds to cover the cost of the contract for the
Marine Stadium Boat Ramp Repairs, already awarded.

It is recommended that the attached Emergency
Amendment to the Capital Improvement Appropriations —
Ordinance No. 9353, adopted on November 19, 1981,
as amended, be approved to transfer $11,100 from -
the Virrick Gym Boat Ramp Improvement project to
a new project entitled "Fueling Facility -
Additional Fuel Tanks" to cover the increased -
construction costs of that project, and to provide
$21,200 from the Special Programs and Accounts i
Lease Properties account to a new project entitled,
"Marine Stadium Boat Ramp Repairs", to cover the
construction costs of that project; as per the
attached Ordinance.
On September 15, 1980, the City Commission adopted Resolution No.
80-659 awarding a contract to construct the Fueling Facility -
Additional Fuel Tanks. In the course of that construction, the
contractor constructed additional concrete slab and additional
manholes not included in the original contract. The negotiated cost
for this additional work is approximately $11,100. It is recommended
that $11,100 of available funds from the Virrick Gym Boat Ramp
Improvement project be transfered to the new Fueling Facility
Additional Fuel Tanks project in order to pay for this additional work.
On April 22, 1982, the City Commission adopted Resolution No. 82-337
authorizing the City Manager to accept a bid for repairs to the Marine
Stadium Boat Ramp, The cost of this construction is approximately
$21,200, which is available from the Special Programs and Accounts -
Lease Properties account, It is recommended that this $21,200 be
appropriated to the new capital project entitled, "Marine Stadium
Boat Ramp Repairs", so that construction may begin.
