HomeMy WebLinkAboutO-094411 4 ORDINANCE NO. ..' 1 A AN EMERGENCY ORDINANCE AMENDING SECTION I OF ORDINANCE NO, 8719 ADOPTED OCTOBER 26, 1977, THE SUMMARY GRANT APPROPRIATIONS ORDINANCE, BY ESTABLISHING A NEW TRUST AND AGENCY FUND, ENTITLED COMMUNITY DEVELOPMENT BLOCK GRANT (EIGHTH YEAR); AND APPROPRIATING $9,625,000 FOR THE EXECUTION OF SAME; REPEAL- ING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND CONTAINING A SEVERA- BILITY PROVISION. WHEREAS, the City Commission adopted Ordinance No. 8719 on October 26, 1977, establishing resources and appropriations for grant funds anticipated by the City of Miami; and WHEREAS, it is anticipated that the Department of Housing & Urban Development will award to the City of Miami a grant of $9,625,000 to provide Community Development activities for the period commencing June 16, 1982, and ending June 15, 1983; and WHEREAS, Community Development activities refers to those publicly supported physical development activities and those related social or economic development activities being carried out within a reasonable period of time in accordance with the final statement approved by the City Commission on April 1, 1982; and WHEREAS, the City Commission adopted Resolution No. 82-290 on April 1, 1982, authorizing the City Manager to submit a final statement to the U.S. Department of Housing & Urban Development for the proposed Community Development program during 1982-83; and WHEREAS, the herein Ordinance is a proper vehicle to appro- priate the aforesaid $9,625,000 grant. NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 1. Section 1. 6Section 1 of Ordinance No 108719, adopted October 26, }-` ,11 . as amended, the Summary, Gr�int Appropri-atinns Ordinance. i.s hereby further amended in r_l'it, t(-)l t/ "Section 1. The following 'Trust and Agency Funds are hereby established and resources are hereby appropriated as described herein:" FUND TITLE: Community Development Block Grant (8th Year) _ RESOURCES: Federal Grant - U.S. Department of Housing & Urban Development $9,625,000 A_P_P_R_OP_RI_ATIO_N: Community Development Block Grant (8th Year) $9,625,000" Section 2. The herein appropriation of $9,625,000 for Community Development refers to those publicly supported physical development activities and those related social or economic devel- opment activities being carried out within a reasonable period of time in accordance with the final statement approved by the City Commission on April 1, 1982. Section 3. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emer- gency measure on the grounds of urgent public need in anticipation of the City of Miami being awarded a grant of $9,625,000 to provide Community Development activities for the period commencing June 16, 1982 and ending June 15, 1983, and upon further grounds of the necessity to make the required and necessary payments to cover the administrative expenses that will be incurred by the locally based Economic Development Corporations and Community Development funded social service agencies at the beginning of their contract period on July 1, 1982. 1/ Underscored words and/or figures constitute the amendment proposed. In anticipation of this grant, it is necessary to establish the proper appropriation in order that funds may be utilized in a tir?el.y manner- when released after June 16, 1982. The er,,,erc:en'cy Or-inanceis C-,ritten to ena'Dle the Cit,: Comil?ission to dispense with tiro second reading upon a vote of four -fifths of the members of the Corianission. This is being done to ensure that funds will be properl, appropriates: in time that they may be spent in an expeditious r,,ianner upon approval of the grant. Approval of thi F err.e)rdinance by the City Commission is recommended at this time in order to cover the forthcoming admin- istrative expenses, that will be incurred by the locally based EconOlili_c Development Corporations .:Is cell as the numerous community development funded social service agencies. July 1, 1982 is the beginning of the contract period for these agencies and we are expecting an imn;ediate request from them for the expenditure of funds. The Eighth Year.
