HomeMy WebLinkAboutR-82-0598RESOLUTION No, A RESOLUTION CALLING AND PROVIDING FOR A SPECIAL MUNICIPAL ELECTION TO BE HELD ON THE `iTH DAY OF SEPTEMBER, 1982, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF MIAMI FOR THEIR APPROVAL OR DISAPPROVAL A MEASURE KNOWN AS ORDINANCE NO. _ 9459 ► PASSED AND ADOPTED BY THE CITY COMMISSION ON JUNE 24, 1982 PROPOSING A CHARTER AMENDMENT ENACTING A COMPREHENSIVE CITY PROCUREMENT PROCEDURE PROVIDING FOR THE POWER TO ACQUIRE AND DISPOSE OF ALL REAL AND PERSONAL PROPERTY AND SERVICES; DEFINING AND AUTHORIZING UNIFIED DEVELOPMENT PROJECTS; FURTHER PROVIDING FOR PROCURE- MENT METHODS TO BE IMPLEMENTED BY ORDI- NANCE FOR THE ACQUISITION AND DISPOSITION OF PERSONAL PROPERTY, REAL PROPERTY INCLUDING WATERFRONT PROPERTY, PUBLIC 4 WORKS AND IMPROVEMENTS AND UNIFIED DEVEL- OPMENT PROJECTS; THE RENAMING AND REDE- FINING OF DUTIES OF THE PURCHASING AGENT; FURTHER PROVIDING FOR AFFIRMATIVE ACTION, NON-DISCRIMINATION AND MINORITY PARTICI- PATION IN TRANSACTIONS WITH THE CITY. WHEREAS, the City Charter established the parameters within which the City prescribes procedures for soliciting and awarding contracts; and WHEREAS, the City Commission finds that said parameters as currently written and interpreted do not permit the City the necessary capability to ensure that the public interest is served; and WHEREAS, the City desires to serve the public interest by providing modern comprehensive processes for the con- tinued development and vitality of the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Notice of the election heretofore called by Ordinance No. 9459 to be held on Tuesday September 7, 1982, shall be published in THE MIAMI NEWS, DIARIO LAS AMERICAS and THE MIAMI TIMES newspapers of general circula- tion published in the City of Miami, Florida, at least twice, once in the fifth week and once in the third week CITY COMMISSION MEETING OF JUN241982 prior to the week in which said election it to be held, the date of the first publication in each of said newspapers to be at least 30 days before said election, which notice shall be substantially in the following form: NOTICE OF SPECIAL REFERENDUM ELECTION TO BE 89LO ON TUESOAY, SEPTEMBER 70 1582 IN THE CITY OF MIAMI, FLORIDA A special referendum election will be held on Tuesday, September 7, 1982 for the purpose of submitt- ing to the qualified electors of the City of Miami, Florida the following question: "Shall the measure known as Ordi- nance No. 9459 passed and adopted on the 24th day of June, 1982 and entitled 'AN ORDINANCE SETTING FORTH A PROPOSED CHARTER AMENDMENT, KNOWN AS CHARTER AMEND- MENT NO. 1, AMENDING SECTIONS 3, 52, AND 53 OF THE CITY CHARTER TO PRO- VIDE A COMPREHENSIVE PROCUREMENT PROCEDURE: PROVIDING FOR THE POWER TO ACQUIRE AND DISPOSE OF ALL REAL AND PERSONAL PROPERTY AND SERVICES; DEFINING AND AUTHORIZING UNIFIED DEVELOPMENT PROJECTS; FURTHER PRO- VIDING FOR PROCUREMENT METHODS TO BE IMPLEMENTED BY ORDINANCE FOR THE ACQUISITION AND DISPOSITION OF PERSONAL PROPERTY, REAL PROPERTY INCLUDING WATERFRONT PROPERTY, PUBLIC WORKS AND IMPROVEMENTS AND UNIFIED DEVELOPMENT PROJECTS; THE RENAMING AND REDEFINING OF DUTIES OF THE PURCHASING AGENT; FURTHER PRO- VIDING FOR AFFIRMATIVE ACTION, NON-DISCRIMINATION AND MINORITY PARTICIPATION IN TRANSACTIONS WITH THE CITY; REPEALING ALL CHARTER SECTIONS, OR PARTS THEREOF IN CON- FLICT, AND CONTAINING A SEVERABILITY CLAUSE,' be approved or disap- proved?" Such ordinance provides for the enactment of a comprehensive procurement procedure for the City of Miami and shall become effective if approved by a majority of the votes cast by the qualified electors of the City of Miami voting on said question. Said special municipal election shall be held at the voting places in the precincts desil0atedt 611 as shown on the list set forth in the foregoing notice in Section 1 hereof, such list being subject to revision by official action by the Supervisor of Elections of Made County in conformity with the provisions of law. A description of the registration books and records which pertain to election precincts wholly or partly within The City of Miami and which the City is adopting and desires to use for holding such special election is as follows: All registration cards, books, records and certificates pertaining to electors of The City of Miami and established and maintained as official by the Supervisor of Elections of Dade County, in conformity with the provisions of the gen- eral laws of the state, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, offi- cial registration cards, books, records and certificates of such the City. Section 3. For the purpose of enabling persons to register who are qualified to vote in said election and who have not registered under the provisions of the general laws of Florida and Chapter 16 of the Code of the City of Miami, or who have transferred their legal residence from one voting precinct to another voting precinct in the City, they may register at the following offices as approved by the Supervisor of Elections of Metropolitan Dade County, Florida, which are hereinafter set forth and which will be open during the following dates and times: ELECTIONS DEPARTMENT' 1444 Biscayne Boulevard Miami, Florida Monday to Friday, inclusive; 800 A.M. 5:00 P.M. 5 DADS COUNTY COURT14OUS ELO 3BY,) 73 West Flagler Street Miami, Vlorida Monday to Friday, inclusive! 5:00 A.M. - 5:00 PIM6 in addition to the above times and places, said quali fied persons may register at such other branch offices and may also use any mobile registration van for the purpose of registration in order to vote in the herein described elec- tion during such times and on such dates as may be desig- nated by the Supervisor of Elections for Metropolitan Dade County. Section 4. The City Clerk of the City of Miami is hereby designated and appointed as the official represen- tative of the Commission of the City of Miami in all trans- actions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registra- tion books and the holding of said election. Section 5. The Election Clerks and Inspectors to serve at said polling places on said date shall be desig- nated by the Supervisor of Elections for Metropolitan Dade County for such purpose. Section 6 . The official ballot to be used at said special municipal election shall be in full compliance with the laws of the State of Florida, including all provisions C 82_5�Z_ of the 119lectroniC Voting Systems Act." The ballot Used in said election of voting on the question submitted shall be that portion of the cardboard or paper or other material within the ballot frames of the voting machines which will Contain a statement of the question submitted, and said voting machines shall provide facilities with such instruc- tions on their use as will enable all qualified electors to vote for or against such question as they may choose. Said ballot as it appears within the first row of horizontal ballot frames of the voting machines shall be substantially in the following form: OFFICIAL BALLOT SPECIAL REFERENDUM ELECTION SEPTEMBER 7, 1982 FOR APPROVAL OR DISAPPROVAL OF THE FOLLOWING QUESTION: CHARTER AMENDMENT NO. 1 "SHALL MEASURE KNOWN AS ORDINANCE NO. 9459 PASSED AND ADOPTED ON THE 24TH DAY OF JUNE, 1982 AND ENTITLED 'AN ORDI- NANCE SETTING FORTH A PROPOSED CHARTER AMENDMENT NO. 1, AMENDING SECTIONS 3, 52, 53 OF CITY CHARTER TO PROVIDE A COMPRE- HENSIVE PROCUREMENT PROCEDURE: PROVIDING FOR THE POWER TO ACQUIRE AND DISPOSE OF ALL REAL AND PERSONAL PROPERTY AND SER- VICES; DEFINING AND AUTHORIZING UNIFIED DEVELOPMENT PROJECTS; FURTHER PROVIDING FOR PROCUREMENT METHODS TO BE IMPLEMENTED BY ORDINANCE FOR THE ACQUISITION AND DISPOSITION OF PERSONAL PROPERTY, REAL PROPERTY INCLUDING WATERFRONT PROPERTY, PUBLIC WORKS AND IMPROVEMENTS, AND UNI- FIED DEVELOPMENT PROJECTS; THE RENAMING AND REDEFINING OF DUTIFSOF THE PURCHASING AGENT; FURTHER PROVIDING FOR AFFIRMATIVE ACTION, NON-DISCRIMINATION AND MINORITY PARTICIPATION IN TRANSACTIONS WITH THE CITY; REPEALING ALL CHARTER SECTIONS, OR PARTS THEREOF IN CONFLICT, AND CONTAINING A SEVERABILITY CLAUSE,$ BE APPROVED OR DISAPPROVED?" In the event a mechanical voting machine shall not be used in voting on the question and an electronic or electro- mechanical voting system is used in voting on the question, the question submitted shall be the same as provided above. Section 7. If a mechanical voting machine is used, each elector desiring to vote for the approval of said 7 charter amendment shall be instructed to turn down the pointer or lever over the word "FOR" within the ballot frame containing the statement of the question relating to such charter amendment, and each elector desiring to vote against approval of said charter amendment shall be instructed to turn down the pointer or lever over the word "AGAINST" within the ballot frame containing the statement of the question relating to such charter amendment. If an electronic or electromagnetic voting system is used, electors desiring to vote for said charter amendment shall be instructed to punch straight down with the stylus through the hole next to the word "FOR" within the ballot frame containing the statement of the question relating to such charter amendment and each elector desiring to vote against said charter amendment shall be instructed to push straight down with the stylus through the hole next to the work "AGAINST" within the ballot frame containing the state- ment of the question relating to such charter amendment. Section 8. The City Clerk shall cause to be pre- pared absentee ballots in full compliance with the laws of the State of Florida containing the question set forth in Section 6 above for the use of absentee electors entitled to cast such ballots in said election.
