AN ORDINA4CE ESTABLISHING A NEW TRUST AND
AGENCY FUND ENTITLED "MIAKI CABLE COl`IMUiAI-
CATIONS AGENCY," AND APPROPRIATING FUNDS
FOR THE OPERATION OF SAME IN THE AMOUNT
OF $100, 000 ; CONTEMNING A REPEALER PRO-
VISION AND A SEVERABILITY CLAUSE; AND
DISPENSING WITH THE REQUIRL1%11ENT OF READ-
- ING SEIbIE ON TWO SEPARATE DAYS BY A VOTE
OF NOT LESS THAN FOUR -FIFTHS OF THE i.IEM-
BEES OF THE CO2NII-IISSIO-N,
WI
WHEREAS, the City Commission adopted Ordinance No. 9332 on
October 19, 1981 granting a nonexclusive license to Miami Tele
Communications, Inc. and Americable of. Greater Miami., Ltd, for the
privilege to use the streets and public ways within the municipal
boundaries of the City of Miami to construct, operate and maintain
a cable television system under certain terms and conditions; and
WHEREAS, Section 703 of Ordinance No. 9332 provides for the
establishment of a Cable Communications Agency (CCA) to administer
the terms and conditions of the license granted by this ordinance;
and
WHEREAS, this section further states that "the City Manager
shall be Director of the Agency and the Agency shall have such pro-
fessional, technical and support staff and capability as the City
Manager deems necessary"; and
WHEREAS, the City Manager has determined that an initial sum
of $100,000 is necessary to hire the professional, technical and
support staff, including funds for operating e::penses, to begin
administering the terms and conditions of the license; and
WHEREAS, the,City Manager established the City of Miami Cable
Communication Agency on December 18, 1981 in a memorandum to all
directors and department heads of the City of Miami; and
WHEREAS, Section 901 of Ordinance No. 9332 states that the li
censee shall pay to the City an,annual sum equal to five (5) per-
cent of the annual gross revenues of the system from all services
in the City but not less than a minimum quarterly payment of two
hundred twenty-five thousand dollars ($225,000); and
WHEREAS, sufficient funds have been received from the licensee
to
provide
the
r(,sources
necessary
to
appropriate
$100, 000
for
the,

OF MIAi II , FLORIDA,
Section 1. The following Trust and Agency Fund is hereby os-
tablished and resources are hereby appropriated as described herein:
FUND TITLE: Miami Cable Communications Agency
RESOURCES: Cable TV License Fees $100,000
APPROPRIATION: Miami. Cable Communications Agency $100,000
Section 2. All or_li:La.nves or parts of orc i nances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 3. If any section, part of section, phrase, para-
graph, clause or word of this ordinance is declared invalid, the
remaining provisions of this ordinance shall not be affected.
Section 4.' The requirement of reading this ordinance on two
separate days is hereby dispensed with by a vote of not less than
four -fifths of the members of the Commission."
