Gary City Manager Request to Restrict Vehicular Traffic Into Belle Meade Neighborhood As per the attached memorandum from the Department of Public Works, the Belle Meade Home Owners Association, Inc. has re- quested permission to restrict vehicular traffic into the neighborhood. The proposed means of restriction would be via the placement of concrete planfi3r boxes on the east side of five (5) of the six (6) intersections leading from Biscayne Boulevard into the single family residential area. It is my recommendation that the City Commission not grant the requested approval. It is noted that the attached memorandum from the City of Miami Police Department points out the possi- bility of delayed responses to service calls and also limit the effective patrolling c,f the area. Further, some thought must be given to the increased traffic that would be placed onto Northeast 76 Street, especially in the block between 6th Court and 7th Avenue as 7th Avenue would be the closest intersection for dispersing egressing traffic. In addition, it is my opinion that approval of this request would be a precedent for the entire City and permit the establishment of restricted areas throughout the City. Such restricted areas would be contrary to the right of all citizens to have unrestricted access through and along all public streets within the City of Miami. Cather Di ctor of Pub Works July 14, 1982 t Request to Restrict Vehicular Traffic into the Belle Meade Neighborhood Discussion Item for Commissior Meeting of July 22, 1982 3 memos and map The Belle Meade Home Owners Association, Inc. requested permission to restrict vehicular traffic on a six-month trial basis into their neighborhood, which is bounded by N. E. 72 Terrace, Biscayne Bay, the Little River, and N. E. 6 Court. The stated purpose of the Association for the restriction of vehicular traffic is "to cut down unnecessary traffic", "for a crime deterrent", and to "beautify Belle Meade". The Association has requested permission to install and maintain temporary planter boxes across the roadways of N. E. 72 Terrace, N. E. 73 Street, N. E. 74 Street, N. E. 75 Street, and N. E. 77 Street at the east side of the intersection with N.E. 6 Court. See the attached map indicating the location of the planter boxes and the neighborhood boundary. The installation of the planter boxes will limit vehicular ingress and egress in the Belle Meade neighborhood to N. E. 76 Street, which has a traffic signal at Biscayne Boulevard. The planter boxes will not block the sidewalks, and pedestrian traffic will not be restricted. The City of Miami Police Department "cannot enthusiastically endorse', and the Departments of Fire, Solid Waste, and Public Works do not object to the restriction of vehicular traffic on a six-month basis. The response time for emergency vehicles may be increased in some locations within the Belle. Meade neighborhood. See the attached memos from the Departments of Police, Fire, and Solid Haste. The Belle Meade Home Owners Association, Inc. should execute an agreement to indemnify, defend, save, and hold harmless the City from any claims, demands, or liabilities of any nature whatsoever arising out of the installation and maintenance of the planter boxes. The Association should also carry a U,000,000. neral comprehensive liability insurance policy in the amount of If the Director of the Public Works Department determines that the planter boxes are a hazard to the health, welfare, and safety of the general public, the City may, upon 30 days notice, require the Association to remove the planter boxes and restore the roadway to a satisfactory condition. The Belle Meade Home Owners Association, Inc. shall provide a performance bond or cashier's check in an amount to be determined by the Director of. the Department of Public Works to guarantee the removal of the planter boxes and restoration of the roadway. p e 1 nr Howard V. Gary July 14, 1982 The Association must obtain the approval of the Director of the Dade County Public Works Department, who is responsible for traffic engineering within the City. A traffic signing plan will have to be prepared by the Dade County Public Works Department, and all costs involved with the signage will be borne by the Belle Meade Home Owners Association, Inc. The plans for the planter boxes and plantings must be approved by the City Public Works Department and a permit obtained from the Fire, Rescue, and Inspection Services Department. C. has indicated to rqe that the proposed closing of the five (5) streets in Belle Meade would not present a problem on P. ternporary basis. The quicker the response, the greater the possibility of saving life or property and apprehension of a criminal. Detouring around any street vould hinder the response time and might hinder the possibility of saving a life. It t.,ould also limit patrolling of the area and the prevention resulting from police visibility. E. 73, 74, 75 and 77 Streets on the east side of N.E. 6 Court. We accept the access at 76 Street as sug- gested by the Belle Meade Home Owners Association. PROPOSAL The Home Owners of the Belle Meade Section of the City of Miami wish -to restrict vehicular traffic only into their unique neighborhood by use of landscape cement planter boxes to be placed along the east side of the following streets at their intersections with I.E. 6th Court: 72nd Terrace, 73:-d Street, 74th Street, 75 Street, 77 Street. We understand that funding for this community project will be by voluntary donation, from ourselves, our friends and neighbors; maintenance of the plants and Planters shall also be voluntary and a maintenance committee shall be formed and directed by the'Belle Meade Homeowners Association. Access to and exit from Belle Meade shall be via 76th Street only. This is to be a six-month trial program only.
