HomeMy WebLinkAboutR-82-06500 *1 i RESOLUTION NO.82"'6.rj0 A RESOLUTION ACCEPTING THE PROPOSAL OF MIKARA, INC., DATED MAY 17, 1982, FOR A NONEXCLUSIVE FOOD AND BEVERAGE CONCESSION AT CORAL GATE PARK; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A STANDARD CONCESSION AGREEMENT WITH MIKARA, INC. WHEREAS, concession contracts under Florida law are akin to contracts for professional services; and WHEREAS, said concession contracts are moreover in the nature of licenses or permits and, as such, do not involve the expenditure of funds that would require competitive bidding under the City Code; and WHEREAS, the City Manager and the Director of the Depart- ment of Parks recommend that the proposal of Mikara, Inc., dated May 17, 1982, be accepted as it is the most advantageous to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The proposal of Mikara, Inc., dated May 17, 1982, for nonexclusive food and beverage concession privileges at Coral Gate Park is hereby accepted. Section 2. The City Manager is hereby authorized to execute a standard concession agreement with said firm for said City -owned park. PASSED AND ADOPTED this 22nd day of July , 1982. Howard, 16irector Department of Recreation ri. it is recommended that the City Manager accept the proposal for a hot dog/Coke non-exclusive concession agreement from Mikara, Inc., for Coral Gate Park and further authorizing the City Manager to execute a standard concession agreement, as per the attached resolution. i PURPOSE: The purpose of the proposed resolution is to accept the above - mentioned proposal for concession rights and to authorize the City Manager to execute a standard concession agreement between the City and Mikara, Inc. FUNDING/ Consideration to the City offered by the proposal is as follows: CAUSE & EFFECT: MONTHLY MINIMUM PROPOSER PARK CONSIDERATION GUARANTEE Mikara, Inc. Coral Gate 21% $50 i I BACKGROUND: Law Department ruling A-1268 exempts park concession contracts from the competitive bidding process and allows the City to award such contracts on a first -come, first -served basis. How- ever, with the large amount of activity regarding park concession, the Recreation Department will be reverting back to the Public Bid Process for future concessions; this being the last proposal accepted under the A-12GB ruling.
