RESOLUTION NO.
A RESOLUTION AUTHORIZING THE PAYMENT OF
$600, 000 AS A PARTIAL SETTLE14ENT FOR
CLAIMS BY THE ARCHITECT, FERENDINO/
CRAFTON/SPILLIS/CANDELA (FGSC) FOR
SERVICES RENDERED IN CONNECTION WITH
THE CITY OF MIAMI/UNIVERSITY OF MIAMI/
JAMES L. KNIGhT INTERNATIONAL CENTER;
PROVIDING FOR MONTHLY PAYMENTS NOT TO
EXCEED $40,000 UNTIL COMPLETION OF
THE PROJECT; FURTHER RATIFYING , AP-
PROVING AND CONFIRMING THE ACTIONS OF
THE CITY MANAGER IN AGREEING TO PAY
AN ADDITIONAL $150,000 TO FINALLY
RESOLVE PENDING DISPUTES WITH FGSC,
WITH FUNDS THEREFOR ALLOCATED FROM THE
CONVENTION CENTER CONSTRUCTION ACCOUNT.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The payment of $600,000 as a partial
settlement for claims by the architect, Ferendino/Grafton/
Spillis/Candela (FGSC) for services rendered in connection
with the City of Miami/University of Miami/James L. Knight
International Center; providing for monthly payments not
to exceed $40,000 until completion of the project; is hereby
authorized.
Section 2. The actions of the City Manager in
agreeing to pay an additional $150,000 to finally resolve
pending disputes with FGSC, with funds therefor hereby
allocated from the Convention Center construction account is
hereby ratified, approved and confirmed.
PASSED AND ADOPTED this 22ND day of July, 1982.

On June 17 the City Commission, by Motion 82-491, authorized a pay-
ment of $600,000 as a partial settlement for claims by the Architect
for additional fees. The Motion also authorized the City to continue
to pay up to $40,000 per month until completion of the project for
architectural services. The Motion also left open the possibility of
additional claims by the Architect and of course did not eliminate
any opportunity that the City would have for counterclaims. It was
my feeling that this matter should be concluded and that having a
threat of an additional $400,000 claim hanging over the City's head
was not desirable.
On July 6 I met with Mr. Candela and his attorney, Mr. Stearns; also
present were George Knox and Vince Grimm. It was finally agreed
that all future claims by either the Architect or the City would be
dropped and the Architect would be paid an additional $150,000, or
a total of $750,000, to settle all disputes finally and totally. It
was understood by the Architect that this additional payment required
Commission approval. The Commission was polled and their unanimous
support was received.
